Supreme Court Will Take Up Colorado Ballot Access Case Of Donald Trump!

A month from now, on February 8, the Supreme Court will hear the case of Colorado barring Donald Trump from the Presidential primary ballot.

Maine has also gone in that direction, and many other states are in process of doing so.

This case will need to be decided in an expedited manner, with Super Tuesday primaries coming up in early March.

The Court would wish to stay out of the political thicket, but cannot do so, and this will be the most important such intervention since the Bush V Gore case in 2000.

Arguably, it is even more important, since Donald Trump is a threat to American democracy, the Constitution, and the rule of law, a series of realities that was not the same with George W. Bush in 2000.

Many conservative scholars and jurists think the Court will bar Trump from the ballots, which would be a victory for sanity and democracy, because Trump’s own rhetoric is Fascist oriented, and he advocates retribution and revenge, and speaks in Adolf Hitler rhetoric.

Also, this Court majority has emphasized their belief in “textualism” and “originalism” interpretation of the Constitution, so if they keep to that viewpoint, they will bar Trump from running for President.

The most corrupt President in American history needs to be stopped in his quest to undermine the future of America as his personal agenda, and his 25-35 percent support makes one wonder about the mental stability of his followers, who fail to see the danger of his attempt to regain power!

The Supreme Court Has Lost All Dignity, Respect, And Legitimacy, And The John Roberts Led Court Will Face Historic Repudiation!

The Supreme Court of the United States was created in 1789 to judge the constitutionality of all laws and actions, and promote the rule of law.

In recent decades, it has become a weapon of right wing extremism, and has lost all dignity, respect, and legitimacy, and is in the worst constitutional crisis in a century!

The conservative movement to promote an extremist Court will cause a repudiation in history, as they have done great damage in the past generation in such cases as Bush V Gore in 2000 (interfering in the Presidential Election of that year); Citizens United in 2011 (that allowed corporations to be considered people); Shelby County V. Holder in 2013 (gutting of the Voting Rights Act of 1965); and now are almost certain to do in the abortion case before the Court (Dobbs V Jackson Women’s Health Organization).

Never has the Supreme Court taken away a right once granted, as in the case of Roe V Wade, alloing abortions in the first two trimesters of a pregnancy, and including the factors of rape, incest, and the life of the mother.

It is unseemly, and reprehensible, that women are being informed that religious fanatics can interfere with their personal rights to control their own bodies, and it will lead to many self mutilations and suicides by women desperate to end an unwanted pregnancy, often brought about by violence perpetrated by men!

The Chief Justice, John Roberts, will see his reputation as the 17th person to hold that position, sullied and repudiated in history, if he cannot convince at least one other conservative Justice to join him and the three Democratic appointments to uphold Roe V Wade!

The move to add membership to the Court, and promote term limits in the future, will be encouraged to occur, as the Supreme Court has lost whatever halo it has had over the past generations!

The Corruption Of The Supreme Court, With Five Appointees By Presidents Who Lost The Popular Vote!

With the likelihood that Amy Coney Barrett will be successfully confirmed to be the replacement of Associate Justice Ruth Bader Ginsberg on the Supreme Court, we are about to have a Court with five appointees by Presidents who lost the national popular vote, but still won the Electoral College.

George W. Bush lost the national popular vote to Vice President Al Gore in 2000 by a 540,000 margin, but was able to select Chief Justice John Roberts and Associate Justice Samuel Alito in 2005 and 2006.

And now Donald Trump, who lost the national popular vote to Hillary Clinton in 2016, by a 2.85 million margin, has been able to select Associate Justices Neil Gorsuch in 2017, Brett Kavanaugh in 2018, and now Amy Comey Barrett in 2020.

And even more infuriating is that three of these five appointees helped the George W. Bush campaign in the Bush V Gore Supreme Court case, assisting him winning the case in a majority Republican selected Court in December 2000–specifically, John Roberts, Brett Kavanaugh, and Amy Comey Barrett!

And the right wing Federalist Society, which has been on a 40 year campaign to make the federal court system move to the extreme right on such issues as health care, abortion, gay marriage, gun rights, so called freedom of religion, deregulation of the economy and the environment, suppression of voting rights and labor rights, has fully succeeded in its campaign to undermine American democracy and a sense of humanity!

So when one complains from the right side of the political spectrum at the “horror” of Democrats “packing the Court” if they were to add seats to the Supreme Court, one has to say the level of hypocrisy is enormous, when that has been the commitment for four decades of the Right in American politics.

And who can say that if the Republicans were to win control of both houses of Congress and the Presidency, that they would not be willing to promote “packing of the Court’, so that they could add two to four more seats to the Supreme Court, and make the Court not just the 6-3 margin it will now be, but possibly 8-3 or 10-3, if two to four seats were to be added!

And one more point: Two of the six member Republican majority have had sexual misconduct hanging over their heads, although it has not affected their tenure on the Court, speaking specifically of Clarence Thomas and Brett Kavanaugh. So the ethical and moral standing of the Court has been damaged irrevocably!

But do the conservatives and the Federalist Society care about this? Not one iota!
