The Attack On Birthright Citizenship And The 14th Amendment By Donald Trump, Mike Pence, And Lindsey Graham

Donald Trump has opened up a new area of attack on constitutional law, claiming that he can, by executive order, end birthright citizenship for infants born of undocumented immigrants, bypassing the 14th Amendment’s guarantee of citizenship for all born in the United States in 1868, exactly 150 years ago.

Speaker of the House Paul Ryan, for once, is correct when he says that is not possible legally, as executive orders cannot end what is in the Constitution or its amendments.

It is also a fact, despite some, like Vice President Mike Pence, and South Carolina Senator Lindsey Graham who claim otherwise, that legislation by Congress also cannot end what is in the Constitution or the amendments.

The only way to change what is in the Constitution or its 27 amendments is by another constitutional amendment, as occurred when the 18th Amendment banning liquor (Prohibition) was passed in 1919 and fourteen years later, with much discontent, the amendment was repealed by the 21st Amendment, the only way Prohibition would ever have ended.

If it was that easy to change what is in the Constitution or its amendments, then there would be a move to end the Electoral College, but that will never happen legally unless an amendment is passed by two thirds of each of the two houses of Congress, and three fourths of the states’ legislatures (38 out of 50).

The idea that Lindsey Graham is suddenly a great friend of Donald Trump, after the way that Trump trashed his good friend, the late Arizona Senator John McCain, is infuriating. One can be certain that McCain would fight this idea that Trump has suggested that he has the authority, all on his own, to destroy the language of the 14th Amendment. It is certain that McCain would be angry at Graham for his changed behavior, and it makes one wonder what is going on in Graham’s disturbed mind that he does not know the basic reality of constitutional law.

Of course, those on the Right would say the Supreme Court could justify what Trump wishes to do, and in theory, a lawless Court, which has already made decisions clearly and purely political in the last ten years, could by a 5-4 vote, including compromised Justice Brett Kavanaugh, do such. But it is hard to imagine that Chief Justice John Roberts would wish to be part of a majority that would undermine his reputation and that of his Court in the long run of history.

If such a disgrace were to happen, the Supreme Court would lose its credibility for all time, and would be helping Donald Trump to destroy our democracy, and impose an authoritarian dictatorship on our nation.

There is absolutely no moral or ethical way that this could happen, and be allowed to stand!

And also, the thought that an infant would not have the opportunity for a good life in America, simply because his or her parents were not documented at the time of his or her birth, is to deny the whole point of the Statue of Liberty and Ellis Island, and the reality that tens of millions of immigrants, and not all legal, with many “slipping in” through our borders and not realized what they had done, contributed to our nation’s greatness.

Think of the refugees from Cuba and Vietnam who came to a nation welcoming them from their personal tragedies in the past half century, and think of the refugees who came from all over the world over two centuries to a nation that gave them a chance to succeed and prosper, and benefit all of the American people!

Syrian Refugees, International Holocaust Remembrance Day, The Statue Of Liberty, And Donald Trump: This Will Condemn Him In History!

We are commemorating International Holocaust Remembrance Day, a reminder of the massive tragedy of the Holocaust, the slaughter of 6 million Jews and 7 million others by Adolf Hitler and the Nazis in World War II.

Ironically, on that day yesterday, Donald Trump has issued an executive order for a total ban of Syrian refugees–women and children primarily–who have been victims of the Syrian Civil War and Holocaust, that has led to massive numbers of deaths and dislocation of nearly half of the Syrian people.

This reminds us of the immoral ban on Jewish and other refugees trying to escape Nazi control, and the uncaring attitude in America, the nation that sat by and allowed ships to be turned back, and public opinion polls demonstrating widespread antisemitism.

As Chuck Schumer said yesterday, the Statue of Liberty is shedding tears right now, and the image of Ellis Island being sullied by what Trump has done, demonstrating absolutely no morals, ethics, compassion, empathy, but then what is new about that?

Donald Trump’s whole life has been one of total selfishness, greed, and lack of concern for others, including his own wives, children, associates, contractors, and workers, and he has no decent bones in his body.

The man is a monster, elected with the help of Vladimir Putin and the Russians, and about to gut the penalties put on Russia for the takeover of the Crimean section of Ukraine in 2014.

The question is, with this ban of Syrian refugees and a pure anti Islamic ban from many countries, using religion in a discriminatory manner, and with the tension raised with Mexico about the proposed Wall that will not accomplish its goal in the long run, how long until the American people rise up in massive demonstrations on a regular basis and demand the removal of this dangerous demagogue from the Presidency?

The War Against Latino And Other Immigrants And Latino American Citizens Begins, Including Crisis With Mexico Over Proposed Wall

The war against Latino immigrants and Latino American citizens has begun, less than one week after Donald Trump took the oath of office.

We will see victimization of people from not only Mexico, but also Central America, South America, Caribbean Islands, and also from the Philippines, Vietnam, Korea, India, Pakistan, China, Japan, and other Asian nations, as well as Muslim nations all over the world.

Racism and nativism is in full swing, and the lady on the Statue of Liberty near Ellis Island is weeping, as we have now seen the worst attack on immigration and minorities from Latin America, Asia and the Middle East that we have had in our lifetime, except for those who were alive and remember the terrible victimization of Japanese American citizens and Japanese immigrants 75 years ago after Pearl Harbor, with 120,000 interned in camps.

Not only will the government now seemingly deport more immigrants and break up more families, but one can be sure that there are plans to intern Muslim Americans when and if a few Muslim terrorists strike in America.

Civil liberties, Civil Rights, and liberty and justice are being ignored as the Trump Fascist era begins, and the question is how to bring it to an end as soon as possible, since the possibility of a dictatorship and martial law is not something we can be assured will not happen at this delicate time.

And expect a possible low level war situation at the 2,000 mile long Mexico-US border, with the plan moving ahead to build a wall, and make Mexico pay for it, which the President of Mexico declared would not occur, leading to the cancellation of a meeting at the White House. Tension will certainly rise, and we are in the worst relationship since the 1920s with our neighbor to the south.

We do not need a new foreign policy and national security headache, but Donald Trump is insuring it with his reckless and dangerous decisions.

The Immigrant Children Of El Salvador, Honduras, Guatemala And The History Of Children Escaping Persecution And Death!

Nativism in its most incendiary way is rearing its ugly head in regards to the mass migration of women and children, some of them babies, but all under adult age, who are fleeing persecution, bloodshed, and potential death in the unstable nations of Central America, some of the most violent nations on earth.

This is specifically the case of El Salvador, Honduras, and Guatemala, with about 90,000 expected to flee their nations, walking on foot, going through tough terrain, many drowning or being overcome by the elements otherwise, but all wanting a better, more secure existence in America.

But the hysteria has grown, that somehow, these women and children are involved in drug smuggling, or are future terrorists over the next generation, or other such ridiculous, hard hearted views of their plight.

One must not forget, however, that this kind of nativism is nothing new in America!

It was visited upon Jews, Italians, Irish, Polish, Chinese, Japanese, and migrants from Mexico and other Latin American countries over the long haul of American history!

This nation refused to open its borders to Jews wishing to escape Adolf Hitler and Nazi Germany in the 1930s and 1940s, and very small numbers of children were ever allowed in, and many died in the Holocaust!

Nativism was also utilized against Vietnamese escaping the collapse of South Vietnam forty years ago, with many “Boat People” dying in the South China Sea or the Pacific Ocean, but others making it to America, of all ages.

Cubans escaping Fidel Castro, including many children in the Mariel Boat Lift in 1980, were seen as dangerous and should not be admitted, but eventually were, since they could not be returned to Cuba.

The attempts to bring some Iraqis and Afghans of Muslim religion to this country has been a long battle as well.

But we have a tendency to forget we are a nation of immigrants, and particularly in times of political, social, and economic turmoil, we are the last best hope of mankind to offer asylum!

So now, IF the families of these children from El Salvador, Honduras, and Guatemala can be reunited, then they may be returned to their host nations, but that should only be if their lives are not in danger, as to return them to certain death is unconscionable!

But IF the families cannot be reunited, sad as that may be, we have no realistic choice but to house, feed, and educate them, and give them the possibility of the “American Dream”!

If we simply reject these children and young mothers, we are losing the whole purpose of the American experiment, as expressed by the Statue of Liberty and Ellis Island. We cannot turn our back on these children and condemn them to death, particularly in a nation which claims to support life itself as a goal!
