Supreme Court Once Again Stands Up To Presidential Assertion Of Executive Privilege, And Limits It!

The Supreme Court of the United States for the third time in 48 years has stood up to a President who asserted “Executive Privilege”, and was smacked down by a court including members appointed by the President who was involved in the Court case.

First, we had US V Nixon in July 1974, having to do with Richard Nixon and the Watergate tapes, which the Court unanimously, 8-0, ordered them handed over to the Watergate Special Prosecutor and the House Judiciary Committee. This led within weeks to the resignation of Richard Nixon. Associate Justice William Rehnquist recused himself from the case, appropriately, as he had worked earlier in the Nixon Justice Department, but the other three Nixon appointees, Chief Justice Warren Burger, and Associate Justices Harry Blackmun and Lewis Powell, joined the unanimous decision.

Next, we had Clinton V Jones, 1997, which involved the issue of whether Bill Clinton could be required to testify in a civil trial while in office, a case brought by Paula Jones against Governor Clinton for sexual harrassment. The Court unanimously, 9-0, including his two appointees, Ruth Bader Ginsburg and Stephen Breyer, ruled that he had to give testimony, and this helped to lead to his impeachment in 1998. So there was no immunity from civil law litigation for acts done before taking office, and unrelated to the office.

And now, we have Trump V Thompson, a lawsuit brought by Donald Trump against the January 6 House Committee investigation of the January 6, 2021 Insurrection, in the name of Chairman Bennie Thompson. So documents to show the series of events leading to the Insurrection are now to be made available to the House committee, as it investigates the wrong doing of the 45th President. This is a major victory, and all three Trump Supreme Court nominees—Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett—voted with the majority 8-1, with only Clarence Thomas in oppostion.

This is a conflict of interest by Thomas, who should have recused himself, as William Rehnquist did in the Nixon case. Since Thomas’s wife was involved in the planning of the January 6 Insurrection, encouraging lawlessness, this should be grounds for removal of Clarence Thomas from the Supreme Court, highly unlikely, but would be appropriate!

US V Nixon; Clinton V Jones; And Now Trump Lawsuit Against January 6 Committee Appeal To Supreme Court!

The Supreme Court has come out with two decisions in the past half century that made it clear of the limits of Presidential power!

In 1974, in US V Nixon, the Supreme Court, including three appointees of President Richard Nixon, unanimously by an 8-0 vote, declared that Nixon had to hand over the Watergate tapes to the Special Prosecutor, leading to the resignation of Nixon from the Presidency within weeks!

In 1997, in Clinton V Jones, the Supreme Court, including two appointees of President Bill Clinton, unanimously by a 9-0 vote, declared that a President had no immunity from civil law litigation in federal court for acts done before taking office. This case involved the sexual harrassment charge brought by Paula Jones against Governor Bill Clinton

Clinton’s evasiveness in testifying in court about Paula Jones led to the Monica Lewinsky scandal, and charges of perjury and obstruction of justice, and his impeachment by the House of Representatives in 1998, although found not guilty by the Senate in the impeachment trial in 1999.

Now, Donald Trump wants “executive privilege” to be in effect to prevent evidence in White House records of what he was doing on January 6, 2021 involving the Capitol Hill Insurrection, to be presented to the January 6 House Committee, investigating the events of that day. President Joe Biden has authorized waiver of such privileges, since Trump is a former President.

Despite having three Trump appointments to the Supreme Court, the strong likelihood is that the Court will, unanimously, reject such arguments, as earlier Courts did involving Richard Nixon and Bill Clinton.

If such does not happen, which seems like a long shot, then the Court will have besmirched its reputation for the long term, and the reputation of Chief Justice John Roberts will be damaged forever.

And that will promote the likelihood of attempts to add four new members to a Court which will be the most condemned and pilloried since the time of Chief Justice Roger Taney during the Civil War!

A Glorious Day For Democracy, The Rule Of Law, And The Supreme Court Saying “NO” To A President!

Friday, December 11, 2020, will go down in history as a glorious day for Democracy, the Rule of Law, and reaffirming the Supreme Court for, once again, having had the courage to say “NO!” to a President who thought he was unaccountable!

In 1974, in US V Richard Nixon, the Supreme Court ordered that the Watergate Tapes be handed over to the Special Prosecutior, by a 8-0 decision, leading to the resignation of the President. Three of the votes against Nixon came from Justices he had appointed.

In 1997, in Clinton V Jones, the Supreme Court ordered that the President testify in a civil trial dealing with sexual harassment, leading to his impeachment for lying before a grand jury. The vote was unanimous, with even the two Clinton appointees in the majority!

And now in 2020, the Supreme Court unanimously, with even the three Justices appointed by Donald Trump, throwing out the frivolous case backed by 17 state Attorneys General and 126 House Republicans (two thirds of the party in that chamber), that wished to throw out the votes of the four swing states that went to Joe Biden, insuring him of victory in the Presidential Election of 2020!

The Supreme Court has its critics, and has some members whose ethics and morals are suspect, but the Supreme Court proved its mettle in a crisis moment, and once again limited Presidential power. It prevented a dictatorship from being established by the most corrupt President in American history who, even with a potential pardon by himself (which would be illegal) or by Mike Pence, will pay the price for his violations of the law in New York State, and face likely conviction and a prison sentence!

Donald Trump’s Character On Display In Public Appearances: Worst By Far In American History!

Donald Trump is the most insufferable public figure ever known, with his disgraceful character on display in public appearances, and no sign that he cares about his image or reputation!

He lies more than anyone ever has in the Presidency.

He insults everyone imaginable, except authoritarian dictators.

He has no compassion, empathy, or common decency, and does not care how much he hurts others.

He has no sense of propriety, and manages to make everything centered around himself.

He has particular venom for women, and people of color, including calling them animals or having low IQ!

He has no respect for anyone who works for him, using them, and then disposing of them.

Everything on a daily basis is connected to how it affects him, and he is always on the attack on Twitter and in public events, where he speaks to a admiring and loyal audience.

One wonders how his adoring followers, and particularly, women, can tolerate his horrible behavior.

It makes one wonder about the intelligence and basic decency of millions of followers, who seem almost like a cult.

It demonstrates the failure of the family unit, that you could have parents who admire Trump, and apparently, think their son or daughter should act like he does, a shocking thought!

No President has ever acted like Donald Trump, not even Richard Nixon, who may have used salty and degrading language in private on the Watergate tapes, but NEVER in public, as he had too much dignity to behave in such a gross manner as Donald Trump.

Donald Trump has damaged the image and history of the American Presidency, and he will not escape the condemnation he deserves in historical writings in future generations!

The American Presidency And Racism Nothing New, But Donald Trump’s Comment Way Beyond The Pale, And Should Force His Resignation!

The American Presidency and racism is nothing new, but Donald Trump’s comment about Haiti and the continent of Africa being a “shit hole” is way beyond the pale, and should force his resignation as a moral and ethical disgrace!

We know that nine of the first 12 Presidents were slave owners.

We know that Andrew Jackson slaughtered native Americans, and forced thousands to Oklahoma, the disgraceful “Trail of Tears”, and condemned abolitionists and worked to prevent their literature from going through the US Mail.

We know that John Tyler and James K. Polk worked to expand slavery territory.

We know that Andrew Johnson was a white supremacist in a disgraceful way.

We know that Theodore Roosevelt was critical of the mass migration of Catholics and Jews (the “New Immigration”) to America, and did not care about racial discrimination in the South.

We know that Woodrow Wilson was a white supremacist, who segregated the nation’s capital by executive order and refused to give any honors for military service to African Americans, and looked at Japan and China as inferior nations.

We know that Franklin D. Roosevelt failed to take adequate action against the Holocaust that killed millions of Jews and others in World War II, and failed to move against racial discrimination, although his wife Eleanor did speak up and take whatever actions she could, as First Lady.

We know that Richard Nixon was antisemitic, and said biased statements against Jews and African Americans on the Watergate Tapes, which were recorded in the Oval Office.

We know there were other actions by Presidents which showed reluctance or refusal to take action against racism and antisemitism.

But Donald Trump, by his public utterance yesterday, and so many other statements and actions before he became President, and since he became President, is the most vile racist of them all, including his wish to deport tens of thousands of Haitians, Salvadorans, and Hondurans, and his lack of concern about the horrible damage done to Puerto Rico and the US Virgin Islands during the hurricane season.

For that, Donald Trump will go down as the bottom of the list of all of our Presidents, and we MUST work to get him out of office before he does much more damage beyond what he has done!

40th Anniversary Of Richard Nixon Resignation, Due To Watergate Scandal

It is hard to believe, but it is now 40 years since Richard Nixon was forced out of the Presidency, due to the Watergate Scandal.

It was stunning that a President, who had won 49 of the 50 states, and all but 17 electoral votes, would be the only President to resign after only one year and almost seven months of his second term.

It was also amazing that Nixon was the only President facing impeachment, and resigning after the House Judiciary Committee, in a bipartisan vote, adopted three articles of impeachment, who truly deserved impeachment.

Andrew Johnson was wrongfully impeached and found not guilty in 1868, and Bill Clinton was to face the same circumstances and results in 1998-1999. And now, there is a threat of Barack Obama facing the same scenario next year, but with the same results assured.

The point was that Richard Nixon had actually been abusive of his powers as President, and had led a lawless administration unmatched before or since.

It is also a tragic story as, in reality, Richard Nixon had many accomplishments in foreign and domestic policy, many of which remain part of American life 40 years later, particularly so in domestic affairs, including the Environmental Protection Agency, Consumer Product Safety Commission, and Occupational Safety and Health Administration, among others.

The evaluation and interpretation of Richard Nixon will continue to be controversial, and a new HBO special, “Nixon on Nixon,” has been unveiled this week, demonstrating the man’s illegalities and prejudices and biases, straight from the Watergate tapes themselves. Additionally, a new book has been published with the revelation of these tapes, authored by historian Douglas Brinkley of Rice University, with the assistance of Professor Luke Nichter of Texas A & M University.

So Nixon will be written about for generations, both for the good he did, as well as the bad!

A Great Moment In American History 39 Years Ago Today As The Rule Of Law Triumphed, And Sanity Returned With Gerald Ford Becoming President!

39 years ago today, President Richard Nixon resigned from office, as the rule of law triumphed, and America returned to sanity with the the inauguration of Gerald Ford as our 38th President.

Nixon might have accomplished a great deal in his five and a half years in the White House, but he represented the greatest threat to our government stability since the Civil War, as he abused power, showed definite signs of mental illness, and had proved on the Watergate tapes that he had obstructed justice and broken the law, and had expressed what we did not know clearly at the time, overt racism and anti semitism!

The Constitution worked, as the Congress and the Supreme Court intervened and saved America from a President out of control, and we were blessed with a man who replaced him, who we now realize was the right person to take the helm at a time when we desperately needed a person of conscience, decency, and principles.

We found that man in Gerald Ford, who never had ambitions to be President, but came along as an acceptable choice under the 25th Amendment, which had only been added to the Constitution six years earlier, in 1967. We were saved from a fate worse than Nixon, the crooked, unqualified, and demagogic Spiro Agnew, who scared the living daylights out of many decent, principled Americans.

Ford came into the Presidency, moved us past the nightmare of Richard Nixon by pardoning him, so that the nation could look to the future, and deal with the many problems it faced at that time in the mid 1970s…He suffered defeat for a full term in 1976 by a small margin, certainly caused by that controversial pardon. But he steadied the ship of state, and gained respect for his handling of a terrorist incident, the Mayaguez Affair with the Khmer Rouge of Cambodia; gave us one of the greatest recent Supreme Court Justices, John Paul Stevens, who served 35 years, longer than any Justice except William O. Douglas; graced us with his wonderful wife, Betty Ford, who set a modern standard for First Ladies to follow, as the most active since Eleanor Roosevelt; and held off the right wing tilt of the Republican Party for four years, by stopping Ronald Reagan’s attempt to turn the party to the Right. He also gave us one of our best and most activist Vice Presidents, Nelson Rockefeller, and bravely survived two assassination attempts within 17 days of each other in September 1975. Ford also showed us how a Republican President could be a responsible, mainstream conservative.

Gerald Ford restored the dignity and status of the Presidency at a time when it desperately needed a boost, and graced our nation for a longer life than any President of the United States.

Having visited the Gerald Ford Museum in Grand Rapids, Michigan, last month brought this author and blogger to a greater understanding and appreciation of the contributions of Gerald and Betty Ford. While he served the shortest term of a President who did not die in office, it was a significant 895 days, and we owe him a debt of gratitude for his service in the Presidency, as well as his 25 years in the House of Representatives.

The Ghost Of Richard Nixon Returns To Haunt Us! Ethnic Slurs On Newly Released Watergate Tapes! :(

Sixteen years after the death of President Richard Nixon, and 36 years after he resigned the Presidency in disgrace, the evil side of the 37th President again arises to haunt us.

With the transcription and release of more of the Watergate tapes that has continued as a project of the National Archives for many years now, the voice and thoughts of Richard Nixon and those around him keep on coming back to remind us of the tragedy of this man.

A really brilliant person, Nixon had his demons, which includes insecurity, paranoia tendencies, and the belief that his critics were enemies that had to be investigated and destroyed. But he also had disgraceful attitudes toward different ethnic groups in America, and it shows in great detail on the latest revelations of the White House tapes.

His rants against Jews, African Americans, Italian Americans and Irish Americans are despicable, and contribute to a lowering of his historical image, even with the effort of many scholars to try to show the major contributions he made to foreign and domestic policy.

It is clear that Richard Nixon in many ways had an admirable record as President, but his use of foul language, his ethnic hatreds, his mental instability that led to his authorization of illegal and unethical acts in office, and the fact that his top staff people knew that they could engage in reprehensible behavior and that Nixon would approve of such actions, continues to weigh down on the 37th President, and prevent a full rehabilitation of his character and record.

This is a sad set of circumstances, and in a way, Nixon continues to haunt us and mystify us at the same time! 🙁
