US V Nixon; Clinton V Jones; And Now Trump Lawsuit Against January 6 Committee Appeal To Supreme Court!

The Supreme Court has come out with two decisions in the past half century that made it clear of the limits of Presidential power!

In 1974, in US V Nixon, the Supreme Court, including three appointees of President Richard Nixon, unanimously by an 8-0 vote, declared that Nixon had to hand over the Watergate tapes to the Special Prosecutor, leading to the resignation of Nixon from the Presidency within weeks!

In 1997, in Clinton V Jones, the Supreme Court, including two appointees of President Bill Clinton, unanimously by a 9-0 vote, declared that a President had no immunity from civil law litigation in federal court for acts done before taking office. This case involved the sexual harrassment charge brought by Paula Jones against Governor Bill Clinton

Clinton’s evasiveness in testifying in court about Paula Jones led to the Monica Lewinsky scandal, and charges of perjury and obstruction of justice, and his impeachment by the House of Representatives in 1998, although found not guilty by the Senate in the impeachment trial in 1999.

Now, Donald Trump wants “executive privilege” to be in effect to prevent evidence in White House records of what he was doing on January 6, 2021 involving the Capitol Hill Insurrection, to be presented to the January 6 House Committee, investigating the events of that day. President Joe Biden has authorized waiver of such privileges, since Trump is a former President.

Despite having three Trump appointments to the Supreme Court, the strong likelihood is that the Court will, unanimously, reject such arguments, as earlier Courts did involving Richard Nixon and Bill Clinton.

If such does not happen, which seems like a long shot, then the Court will have besmirched its reputation for the long term, and the reputation of Chief Justice John Roberts will be damaged forever.

And that will promote the likelihood of attempts to add four new members to a Court which will be the most condemned and pilloried since the time of Chief Justice Roger Taney during the Civil War!

Republican Presidential Administrations From Richard Nixon To Donald Trump: Indictments, Convictions, Prison Time, Plus Warren G. Harding And Ulysses S. Grant

We are in the midst of the most corrupt series of Presidential scandals in American history in the 15 months of the Trump Administration.

An investigation of Presidential scandals since Richard Nixon left office demonstrates the following:

Under Gerald Ford and Jimmy Carter, there were no serious, protracted scandals of note.

Under Ronald Reagan, there were serious scandals that led to 26 indictments, 16 convictions, and 8 sent to prison–most outstanding being the Iran Contra Affair, which led to indictments of the Secretary of Defense, the head of the Central Intelligence Agency, two National Security Advisers, Deputy Chief of Staff, as well as criminal prosecution or resignation of the head of the Environmental Protection Agency, and the Federal Emergency Management Agency.

Under George H. W. Bush, he gave pardons to a number of people convicted under Reagan, and some wondered if the President was covering his own rear end, and potential involvement in the Iran Contra Scandal in particular.

Under Bill Clinton, while there were a lot of investigations under Republican Congresses after 1995, and the President was impeached in regards to the sex scandals with Paula Jones and Monica Lewinsky, there were no serious scandals that led to any indictments or convictions.

Under George W. Bush, there were a lot of scandals, leading to 16 indictments, 16 convictions and 9 sent to prison, and many people working for Bush resigned rather than testify in many investigations. There were many abuses centered around the wars in Iraq and Afghanistan, and in the promotion of national security, and led to resignation of Attorney General Alberto Gonzalez, Lewis “Scooter” Libby who was the aide to Vice President Dick Cheney, and White House Adviser Karl Rove among others.

Under Barack Obama, there were no serious violations of the law or scandals, despite many investigations by Republican Congressional committees, including Hillary Clinton after the Benghazi Libya attack on the US Embassy by Muslim extremists.

When one adds the massive scandals under Richard Nixon, and now Donald Trump, it is clear that under Republican administrations, corruption and abuses have been widespread, although not under Gerald Ford, and that the three Democratic Presidents, despite much criticism, had no serious scandals on the level of Nixon, Reagan, Bush 2 and now Trump!

And when one goes back to earlier scandals under Warren G. Harding in the 1920s and Ulysses S. Grant in the 1870s, both Republican Presidents, it only adds to the image and reality of Republicans presiding over scandalous times, as well as nine of the last ten economic downturns since 1953, along with the Great Depression under Herbert Hoover after 1929!

“The Nineties” Series On CNN, Part 2, This Evening, Examines The Truth About The Bill Clinton Presidency, Warts And All!

This evening, CNN’s “The Nineties” Series, Part 2, will examine the unvarnished truth about the Bill Clinton Presidency, warts and all.

It will NOT be a whitewash of the Clinton Presidency, arguably the most scandal ridden Democratic Presidency in American history.

Some of the Clinton “Scandals” were conjured up by the right wing hatemongers, no question about that.

But Bill Clinton caused a lot of his own damage, and he cannot be made blameless, and one could say that the Monica Lewinsky Scandal, and other scandals surrounding women, including Paula Jones, disgraced the Presidency.

I wish to point out that when the scandal became public news in January 1998, this author felt that it was a disgrace, and that Clinton should resign immediately, but he refused, and put the nation through hell for an entire year, until he was found not guilty of impeachment charges by the US Senate. It was not an issue of morality, but rather the fact that his behavior could have compromised the national security if any of the women had been connected to Russia or some other foreign enemy, who know how to utilize women spies to blackmail a President or other public figure.

I never believed that Clinton should be impeached, and the hypocrisy of Republican leaders who were cheating on their wives with women, and yet putting Clinton through a constitutional crisis, was infuriating.

But CNN is not glorifying the Clinton Presidency, as much more could have been done during his Presidency, if only the President had known how to behave!

So my suggestion is to watch and think about the damage Bill Clinton’s behavior did to harm the nation, and remember that the first or second paragraph of his eventual obituary will mention that he was the second President impeached by the House of Representatives and brought to trial before the US Senate, after Andrew Johnson.

And now, we face the eventual possibility of the impeachment of Donald Trump, at some point, if he does not resign!

US V Nixon; Clinton V Jones; And Now US V Trump?

In 1974, the Supreme Court, by 8-0 vote, told Richard Nixon that he had to hand over the Watergate tapes to the Special Prosecutor, which led to Nixon’s resignation a few weeks later.

In 1997. the Supreme Court, by 9-0 vote, told Bill Clinton that he could not avoid trial on sexual harassment charges brought by Paula Jones, simply because of his Presidential duties, which led to the impeachment and trial in 1998-1999.

The point of these two cases, US V Nixon, and Clinton V Jones, is that the President is not in total charge, and can be held to account by the Court system of America.

Donald Trump is about to get the same reality check, as the case involving the ban of all immigration from seven Muslim nations goes to the 9th Circuit Court, after a District Court Judge showed courage in stopping the enforcement of the President’s executive order. This is seen by most legal experts as unconstitutional, as a violation of the First and 14th Amendments, and being used against nations that have sent no terrorists to America, while other nations that have, are not included in the ban.

Donald Trump seems to think he is above the law, and his authoritarian, autocratic and tyrannical behavior must be nipped in the bud right now!

The Likelihood Of An Obama Impeachment Grows, But It Will Not Lead To Removal From The Presidency!

With the growing possibility that the Republicans MIGHT win control of the US Senate, and keep control of the House of Representatives by a tight margin, the likelihood of President Obama facing impeachment, as Bill Clinton did in 1998, grows.

But there is no case for impeachment, as Barack Obama has NOT committed high crimes and misdemeanors in office!

He has not even had an illicit love affair as Bill Clinton did, and he has not lied under oath, as Bill Clinton sadly did when asked about his love life by a prosecutor under oath, once the Paula Jones accusations came to light.

Obama has been accused of abusing power, but nothing he has done is any different than what George W. Bush, Bill Clinton, or other Presidents did, without the invective that the 44th President has had to deal with.

Obama has faced a constant assault like no one since Richard Nixon, who deserved it, due to his illegal actions. So much of what is said is outrageous, and disrespectful of the office he holds.

But remember that all that is needed for impeachment is a majority of the House of Representatives to vote on one or more articles of impeachment, and the charges need not be substantial or legitimate, as impeachment is a political action, not based on the law, as it was not based on law with Andrew Johnson and Bill Clinton.

The likelihood of an impeachment, therefore, is very high, but as stated at other times by this blogger, it will never lead to the removal of the President, since even if the GOP gains the Senate majority, there will never be a situation where enough Democrats, or in fact, any Democrats, would vote to remove him from office!

The effect of an impeachment will be, simply, to besmirch the record of Barack Obama, making him the fourth President to face impeachment charges, but it will only matter as part of his obituary, since it will certainly be one of the key points always remembered if it ends up happening.

The impeachment battle would also cause a dramatic rise in Obama’s popularity, much like Bill Clinton experienced.

It would also help to undermine, ever further, any legitimacy that the Republican Party has with the American people at large, and it would further insure that a Democratic President will be elected in 2016.

Impeachment would be seen as petty, vindictive, and unfortunately, racist, and it would reflect badly on Republicans who wish to run for President.

No good could come out of such an action, but it would be a high moment for those who wish to divide America ever further, but with no satisfaction of their desire for blood.

And the true beneficiary of all this, if by some miracle, Obama was forced out, would be Vice President Joe Biden, who by becoming President with less than half the term left, would have a step up for the Presidency in 2016 and 2020, thus destroying the last opportunity for Hillary Clinton or any Republican to become President before 2025!

And anyone who thinks Joe Biden is a “joke”, who is not to be taken seriously, will have their comeuppance when they discover they might have created the monster of a President Biden for the next decade!

Urgent That Barack Obama Take Leadership In Investigation Of Alleged Scandals In His Presidency!

President Barack Obama has been President for more than four years, and is in the crucial first year of his second and last term in the White House.

The time for applause over his second term victory is over, and he must face the facts that his administration is in crisis, caused by his own lack of outfront leadership over what goes on during his watch in the Oval Office!

The Benghazi matter is being politicized, but more needs to be revealed about that tragedy, and no coverup is going to work, although it seems clear there is no “smoking gun” on that issue.

The confusion over the IRS checking out conservative and Tea Party groups is reprehensible, and it must be made clear who was involved, people appointed by the President, or civil service bureaucrats who have gone way beyond their authority, and abused their positions. Heads must roll, and if it is the bureaucracy, then the whole agency must be cleaned up of those who have broken the law, and prosecutions must follow quickly!

The Associated Press matter, if related to national security matters, must also be revealed in total, as media should never be interfered with by the Justice Department, and a full investigation must be pursued, with Attorney General Eric Holder properly recusing himself in this matter.

The point is, that despite Republicans gleefully jumping on these controversies, it is yet possible that nothing that Obama could have done would have been able to prevent these controversies, but he MUST be proactive, not laid back and withdrawn, which has too often been his mode of operation in his first term.

Obama is in danger of ending up like other second term Presidencies, in the midst of scandals which undermine their legacy, no matter how good those legacies might be.

Progressives do not want Obama to end up in the troubled historical legacy of such predecessors as:

Ulysses S. Grant–Credit Mobilier Scandals
Harry Truman–several minor scandals
Dwight D. Eisenhower—Sherman Adams Scandal
Richard Nixon–Watergate Scandal
Ronald Reagan–Iran Contra Scandal
Bill Clinton–Monica Lewinksy–Paul Jones Scandals
George W. Bush—Scooter Libby Scandal

The only way to avoid this fate is PROMPT, ASSERTIVE, PROACTIVE leadership by our 44th President, who has done so much good, and should not allow his enemies to destroy him by a policy of passivity, and leading from behind!

The Second Term Presidency: A Burden For Nixon, Reagan, Clinton, George W. Bush! What Will It Be For Obama?

In the midst of all the euphoria over the second term victory of Barack Obama, many observers are sobered by the history of recent second term Presidents.

Richard Nixon, after victory in 1972, faced impeachment in the Watergate Scandal, and resigned in 1974.

Ronald Reagan, after victory in 1984, faced the Iran Contra scandal, and indications that he was mentally lacking in alertness.

Bill Clinton, after victory in 1996, faced the Paula Jones-Monica Lewinsky scandal, and was impeached by the House of Representatives.

George W. Bush, after victory in 2004, had major disasters with Hurricane Katrina in 2005, and the stock market and economic collapse (The Great Recession) in the Fall of 2008.

Can Barack Obama avoid tragedy and disaster, and go on to have an outstanding second term, with the reality of being a “lame duck” President?
