22nd Amendment In Effect In Second Half Of Presidential Term Of Office

When the 22nd Amendment was added to the US Constitution in 1951, after being passed by Congress in 1947, it limited Presidents to two complete terms of office, or eight years, OR if becoming President by succession during a term, allowing any successor who came to the Presidency in the last two years of the term, to be elected twice, but if succeeding during the first half of a Presidential term, such person could only be elected once.

Therefore, when Lyndon B. Johnson succeeded John F. Kennedy with one year and two months left of the term, he was eligible, in theory, to be elected twice, although he withdrew from running for a second full term in 1968.

No one else has had that opportunity, and since Richard Nixon resigned, and was replaced by Gerald Ford with two years and five months left in the term, no vacancy in the Presidency has occurred, now for the past 40 years, the longest such period since the first Presidential replacement in 1841.

Now that the second half of the second term of Barack Obama has passed its midpoint at 12 noon two days ago, Vice President Joe Biden has the situation, whereby IF he succeeded to the Presidency at any time from this point forward, he could, in theory, serve up to 10 years in the White House, from ages 72 to 82.

While this is highly hypothetical, it could happen, with the constant death threats against President Obama, with many of these reported threats discussed in my forthcoming book on Presidential Assassinations and Threats.

The point to be made is that IF Joe Biden suddenly became President before the 2016 primaries, caucuses and elections take place, this scenario could occur, and no one should do what is so common—to underestimate the potential of Vice President Joe Biden, who has added so much to the Vice Presidential office’s history in his six years as number 2 man in American Government.

Obama’s State Of The Union: A Liberated President Making The Democratic Values Case!

Barack Obama is finally liberated as he began his seventh year in the Presidency on the sixth anniversary of his inauguration as the 44th President of the United States.

Obama made an appeal to the opposition Republicans to cooperate and work together, but he also made clear he was going to charge ahead on a list of goals that are a marker for the next Democratic Presidential nominee and the Presidential Election of 2016.

He called for infrastructure spending; free community college tuition; child care tax credits; paid leave for workers; immigration reform; effective regulation of gun purchases; tax cuts for the middle class; tax increases on the wealthy and large financial institutions; pointed out the greatest economic success and growth since 1999; threatened use of the veto when necessary; called for authorization of force against ISIL (ISIS); called for action on climate change; used the term transgender in his call for fair treatment of gays and lesbians; called for more support in dealing with improved relations with Cuba; emphasized the need to fight against anti semitism, but also try to come up with a nuclear agreement with Iran; and work to avoid more troops on the ground overseas.

Much of this agenda will not be accomplished, but sets a goal line for the future.

Meanwhile, Senator Joni Ernst of Iowa surprised many observers by NOT totally falling on her face in her Republican response to the State of the Union address, but her speech was mainly platitudes and folksiness, not substantial alternatives to what Obama proposed, but rather a condemnation of what Obama has done, particularly ObamaCare. She also did not speak on such important issues as climate change, immigration, foreign policy, and helping working families, but then, the Republicans always stand in the way of progress on so many issues, so it is not surprising that her speech was lacking.

Iowa Freshman Republican Senator Joni Ernst To Give Response To Obama State Of The Union Address: What A Comedy Routine It Will Likely Be!

One of the nuttiest, wackiest new Republicans in the new 114th Congress has been compared to former Minnesota Congresswoman Michele Bachmann and former Alaska Governor Saran Palin.

That is Iowa Republican Senator Joni Ernst, who, like Bachmann and Palin, has a great personal appearance, but it is clear that she, like Bachmann and Palin, has very little brain matter upstairs.

This woman acted in a goofy way when she accepted victory in the Iowa Senate race against Congressman Bruce Braley in November. She has spouted Tea Party values, which promote taking us backward and are narrow minded and intolerant. It will be interesting to see how she presents herself tonight, as the Republican response to the State of the Union address of President Obama.

She is an extremely poor replacement for Iowa’s distinguished former Senator Tom Harkin, who was one of the bright lights in the Senate, and sought the Presidency on the Democratic side in the 1992 Presidential race, with this blogger being in support of his candidacy, as the best person in that race.

Despite losing that competition, Harkin served for 30 exceptional years in the US Senate, and Iowa has made a mistake in electing this lightweight woman to be his replacement.

Watching her deliver the response to the State of The Union Address on Tuesday night will, likely, be entertaining, a comedy routine that will likely be repeated on Saturday Night Live, and joked about on Bill Maher’s show on HBO.

It is great to have more women in the Senate and House of Representatives, but somehow, the GOP seems incapable of getting bright, intelligent women to run for public office, as compared to those women who run on the Democratic line. This is a tragedy of major proportions!

“Selma” Film Brings Back Memories Of Bloodshed And Deaths Over Voting Rights, As We Look At Crippled Law Due To Supreme Court!

Watching the “Selma” film, which has been nominated for Best Film in the Oscar Awards competition, one is reminded of the turmoil, bloodshed, and deaths that occurred over the issue of voting rights in the South a half century and more ago.

The Voting Rights Act, which became law exactly 50 years ago, was designed to prevent any more such denial of the right to vote, but the right wing Supreme Court, including African American Associate Justice Clarence Thomas, changed the effectiveness of the law two years ago, causing new voting restrictions in the past two years in Republican controlled states, and not just in the South, but also in the heartland of the nation, the Midwest and Great Plains States, and even some Western states.

Shelby County V. Holder made it possible once again to create barriers to voting, and the battle for voting rights has new challenges, which already has had an effect on voting in the midterm elections of 2014.

But seeing this film about the Selma to Montgomery march fifty years ago, motivates those who believe in fairness and democracy, to do whatever can be done to restore the purpose of what those people who died or were injured then did, a sacrifice that should not be forgotten!

The 14 States Fighting A Rear Guard Action Against Same Sex Marriage

As the Supreme Court considers the idea of making same sex marriage legal in the entire nation, 14 states stand in resistance.

It would be instructive to list those 14 states and indicate them by region.

The South—8 states—Alabama, Mississippi, Georgia, Tennessee, Kentucky, Arkansas, Louisiana, Texas

The Midwest—3 states—Ohio, Michigan, Missouri

The Great Plains—3 states—North Dakota, South Dakota, Nebraska

The only large populated states on this list are Georgia, Texas, Ohio and Michigan.

More than 70 percent of the nation’s population has the right to same sex marriage.

Once the Supreme Court considers the case of Tennessee, Kentucky, Ohio and Michigan, we will have more than 80 percent covered, assuming the Court rules in favor of gay marriage, but it is likely that the Court will go all the way and make it legal in the other 10 resistant states left on the list!

Supreme Court Accepts Same Sex Marriage Case: The Final Push For Marriage Equality Has Arrived!

The Supreme Court has finally accepted a same sex marriage case, to be argued in April, and decided by the end of June!

This will be a blockbuster case, coming at a time when 36 states already allow gay marriage, and the final push for marriage equality has finally arrived!

While there is no guarantee that the Supreme Court will rule in favor of same sex marriage, it is hard to conceive of the Court rejecting it at a time when all but 14 states have accepted it, as the momentum is clearly in favor of acceptance.

Beyond that, the odds are good that at least five members of the present Court would support it, enough to bring it about, but it would be desirable if the vote was greater than that thin margin.

Associate Justices Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor, and Elena Kagan, all Democratic appointments of Bill Clinton and Barack Obama, are seen as assured votes.

Ronald Reagan appointee Anthony Kennedy is the typical “swing” vote, and has supported gay rights in the past, and most particularly, in the case of Lawrence V. Texas in 2003, so it is expected he will go the same direction again.

But there is a chance that Chief Justice John Roberts could join the majority, and some observers imagine that Samuel Alito could join, also.

And even some think that Clarence Thomas and Antonin Scalia, seeing the handwriting on the wall, might join and make it unanimous, which would be the most fantastic situation imaginable!

Imagine the extremist Christian Right bigots, and conservatives and Republicans, and how they will, figuratively, commit suicide if the Court rules in favor of same sex marriage!

It will transform the Presidential Election of 2016, as how could any Republican nominee come out and condemn the Court, and run on some crazy idea that he would lead a movement to overcome the Supreme Court decision?

Just the thought that many Republicans, including those running for President, will be squirming in public, is a source of delight, as human rights wins out once again!

Personality DOES Matter: Why Chris Christie Will Never Be President!

New Jersey Governor Chris Christie may be described as the most centrist Republican Presidential candidate, and also as one of the “Establishment” Republican Presidential contenders, which includes Jeb Bush and Mitt Romney.

But we have NEVER had a person as confrontational, as rude, as bullyish, as loudmouth, as obnoxious, as Chris Christie has been with ordinary New Jersey citizens who dare to challenge or question him!

Can one imagine such a person as President, speaking to foreign leaders, directly or indirectly, in such a undiplomatic manner? We would have World War EIGHT, as he would inspire wars just with his dripping sarcasm and lack of tact!

It might be entertaining to some in New Jersey that Christie is such a character, and we have seen staff and supporters around him who laugh heartily when he goes after a tax payer, a parent, a critic, but there is nothing laughable about such behavior!

We have never had a President with such a personality, and have never had a nominee with such a personality, and we are not about to witness that happening!

Chris Christie, if he enters the Presidential fray, will be repudiated in the Iowa Caucus in January of next year, not only for his comparative moderation on issues and views, but also on his brusque personality, which does not wear well in the Midwest, a comparatively low key, friendly environment of people who are laid back in nature, and do not like rudeness or nastiness. And New Hampshire citizens in their primary, and New Englanders, will also not take well to Chris Christie’s New Jersey “in your face” mannerisms and speech!

So the best suggestion for Chris Christie: Stay out of the Republican Presidential race, and avoid embarrassing yourself, and being soundly repudiated1

Crowdpac Website Traces All Potential Presidential Candidates On Issues, Determining How Liberal Or Conservative They Really Are!

This blogger just discovered a great website that he wishes to pass on to his readership.

It is www.crowdpac.com, a site which researches and compares potential Presidential candidates of both parties on their issue positions, as well as seeing how they perform in the multitude of polls; check on their political donors; and try to judge if they are of the right qualities to be President of the United States.

The comparison as to how liberal or conservative they are is the most fascinating, and a total of 7 Democrats and 17 Republicans are assessed and evaluated.

So, in a broad sense, the 7 Democrats are seen as most liberal to least liberal in the following order:

Joe Biden comes across as the most centrist Democrat, which COULD give him a boost.

Chris Christie is the most centrist Republican, more than Jon Huntsman? That is a surprise! But Jeb Bush and John Kasich also comes across as quite centrist, along with comparatively unknown, and not seen as a serious candidate, Governor Rick Snyder of Michigan. And Carly Fiorina, the failed Senate candidate against Barbara Boxer in California in 2010,and often a commentator now on CNN, suddenly is on the list, and could be the only woman Republican candidate for President, even though her career is totally corporate, never having served in public office!

Crowdpac looks like a site that will often be utilized by this blogger and by other political junkies!

Mitt Romney Fighting History, And Common Sense, By His Stated Plan To Run For President Again!

Mitt Romney has a massive ego, a sense of divine direction, a belief in himself as the only person who can move America forward!

What else can explain why the losing Republican Presidential nominee in 2012 is telling his supporters that he intends to run for President once again?

What can Mitt Romney say or do which will change our view of him, a view of a chameleon, with no principles, no convictions, no ethics, except to advance himself, despite being one of the wealthiest people ever to run for President, and having no real need to be President, except he wants to be President!

Mitt Romney is NOT going to be the 2016 GOP nominee, and trying to run to the right of Jeb Bush is a guaranteed lost cause, as there are more than enough true right wingers available, so why should he expect to beat out the likes of Ted Cruz, Rand Paul, Marco Rubio, Mike Huckabee, Rick Santorum, or Rick Perry, among others?

Romney does not even offer the idea of greater experience in public office, as he had the least such experience in American history, with the exception of Woodrow Wilson and Wendell Willkie, who had two years and no years of public government experience, as compared to Romney’s one term as Massachusetts Governor, but eager to run for President even as he just began his Governorship!

Romney has run two Presidential races, and lost one, and the list of Presidents who have lost and then won is small indeed.

It includes Thomas Jefferson, Andrew Jackson, William Henry Harrison, Grover Cleveland, and Richard Nixon.

All five had much more experience in government and or the military (in the case of Jackson and Harrison) than Mitt Romney.

Face the facts: Romney is NOT Thomas Jefferson; Romney is NOT Andrew Jackson; Romney is NOT Grover Cleveland; and most certainly, Romney is NOT Richard Nixon, who had broad experience and expertise. The Harrison comparison does not matter, as Harrison only served one month as President in 1841.

The best thing Mitt Romney could do is continue doing what he does best: making money faster than one can say one-two-three, as he is not going to be able to outlive his failure to run a decent, honest campaign, and he will NOT be the next Richard Nixon!

Same Sex Marriage Now Legal In Nearly Three Fourths Of Nation’s Population, With Florida Becoming The 36th State To Allow It!

The rapid move toward same sex or gay marriage is nearly complete, as Florida became the 36th state to establish it, beginning on January 6.

Many states have resisted it, but federal courts have mandated it, and soon, the Supreme Court will need to deal with the concept, and the likelihood of declaring it to be a national right seems very close, likely in the next six months.

The main holdouts are mostly Southern and Great Plains States, but also Michigan and Ohio.

When one looks back just 12 years ago, when the Supreme Court ruled that gay couples have a right to privacy and to avoid prosecution, in the Lawrence V. Texas case of 2003, the rapidity of change is absolutely amazing!

Public opinion has rapidly come around, with more than 70 percent supporting gay marriage. This is particularly true among young people, any one under the age of 40 in particular.

Highly religious people still oppose it, and many senior citizens are unhappy about it as a group, but with the passing years, and eventual disappearance of the senior citizens of today, eventually, one will look back and wonder why the great opposition for so long to a basic human right being extended to gay and lesbian couples, just as interracial marriage was not made legal nationally until Loving V. Virginia in 1967.

Even today, there are those who are appalled by interracial marriage and relationships, but the answer is, with that and gay marriage, that it is none of anyone’s business who someone chooses to love and to marry. One has the right to disagree, but also realize that personal feelings do not make what is legal!
