Associate Justice Neil Gorsuch A Surprise On The Supreme Court

With the third term of Neil Gorsuch on the Supreme Court now complete, one must say that Gorsuch is quite a surprise in his decisions on the Court, startling many conservatives, and pleasing progressives.

It is clear that Gorsuch is, and will continue to be, unpredictable on the Court, and already, he joins Chief Justice John Roberts in siding with liberals on some cases before the Court.

He has already made observers compare him to former Justice Byron White, and even by some to former Justice David Souter.

This means that the idea that are five rigid conservatives on the Court now looks more like four liberals, three conservatives, and some of the time two “swing” Justices, mostly conservative but totally unpredictable, and therefore, not reliable all of the time for the conservative camp.

It was wonderful to see Gorsuch side with native Americans in declaring that eastern Oklahoma is native American territory, although it is not clear what that means in reality to Oklahoma’s future.

His backing of gays and lesbians having employment rights guaranteed under the Civil Rights Act of 1964, joined by Chief Justice Roberts, may be one of the most important cases in many years.

The at times unpredictability of both Gorsuch and Roberts makes following the Supreme Court much more fascinating, for sure!

Ruth Bader Ginsburg Cancer Crisis Raises Alarm For Supreme Court Future

Supreme Court Associate Justice Ruth Bader Ginsburg has been on the Court for 27 years, and is a true icon with millions of fans and supporters of her brilliant liberal perspective on legal matters.

But now, at age 87, she has suffered again a bout with cancer, having survived colon cancer in 1999, pancreatic cancer in 2009, lung cancer in 2018, and pancreatic cancer again in 2019. Now, she is diagnosed with liver cancer, so this is her fifth bout with cancer.

Ginsburg has proved to be a tough lady, doing great sessions with exercise over the past generation, and recovering from conditions most would not have survived.

She is still able to do her job, and is determined to remain, but now, there is fear she might not be able to continue, and could, god forbid, die in office or be forced to resign this fall, giving Donald Trump another appointment to the Court, which would shift it to the far right, a true disaster.

Since Barack Obama was not allowed by Senate Majority Leader Mitch McConnell and the Republican Party to replace Justice Antonin Scalia in 2016, because it was an election year, by all rights, Trump should not be able to replace Ginsburg. Any appointment should be delayed to 2021. as it was delayed until 2017, when Neil Gorsuch took the Scalia seat, rather than Merrick Garland, the Barack Obama appointee to replace Scalia in 2016.

We must all pray that Ginsburg will, once again, fight and overcome this challenge, and remain on the Court until at least January 4, when the new Congress, hopefully with a Democratic Senate, begins, and the upcoming inauguration, hopefully, of Joe Biden to the Presidency, would occur on January 20, 2021.

Then, we will know that Ginsburg’s Court seat is safely in the hands of a liberal Justice, preserving the legacy of Ruth Bader Ginsburg!

The Supreme Court Dignified Itself By Upholding The Rule Of Law Against President Donald Trump

The Supreme Court dignified itself today by upholding the rule of law against President Donald Trump.

In two cases, the Court did similar to what it did with President Richard Nixon in 1974 and President Bill Clinton in 1997.

And the two Trump Supreme Court appointees (Neil Gorsuch and Brett Kavanaugh) surprised by joining five other Justices, including Chief Justice John Roberts, in smacking Trump down, and telling he is not above the law.

So once again, Supreme Court appointees have “disappointed” the President who selected them, but in so doing, they remind us that the Court is designed to do what is proper, and quite often, although not enough, the Court surprises and pleases those who care about the law and the Constitution.

These decisions further undermine Donald Trump with less than four months to the election, which seems certain to be a massive repudiation of Trump, and lead to his prosecution on financial fraud, although much else should be the center of attention once this disgraced President leaves office!

The Unpredictable Supreme Court Due To Republican “Maverick” Appointments

The history of the Supreme Court since 1953 has been one of unpredictability, due to Republican “Maverick” Appointments, who surprise conservatives who thought having a Republican President insured their narrow minded views of the Constitution and the law.

America has been fortunate that every Republican President from Dwight D. Eisenhower to Donald Trump has made an appointment that surprised the nation, and promoted social progress long term.

Eisenhower appointed Chief Justice Earl Warren and Associate Justice William Brennan.

Richard Nixon appointed Chief Justice Warren Burger and Associate Justice Harry Blackmun.

Gerald Ford appointed Associate Justice John Paul Stevens.

Ronald Reagan appointed Associate Justices Sandra Day O’Connor and Anthony Kennedy.

George H. W. Bush appointed Associate Justice David Souter.

George W. Bush appointed Chief Justice John Roberts.

Donald Trump appointed Associate Justice Neil Gorsuch.

So ten appointments in the past two thirds of a century have made a dramatic difference in so many ways, including racial integration, school prayer, abortion rights, ObamaCare, gay rights, and other significant areas.

An Inspiring Victory For Gay And Transgender Employment Rights, As John Roberts And Neil Gorsuch Come Through!

In a year which has been so depressing in so many ways, a great and inspiring event occurred today, when the Supreme Court voted 6-3 to protect gay and transgender employment rights.

Chief Justice John Roberts (appointed by George W. Bush in 2005) and Associate Justice Neil Gorsuch (appointed by Donald Trump in 2017) voted with the four Democratic appointed Justices to bring about this victory.

A major rebuttal was issued to the decision by two of the three other Justices, Samuel Alito and Brett Kavanaugh, appointed by George W. Bush and Donald Trump, respectively.

The decision shows once again how unpredictable judges and Justices can be, as to have the two Justices appointed by both Bush and Trump split on this case.

This decision is a repudiation of the anti gay stand of Donald Trump, and one wonders whether other decisions in the next two weeks will also go against Trump.

Thank goodness that, while the Supreme Court is at times disappointing in its decisions, it also can be very surprising and advanced.

A lot of it has to do with Roberts, who clearly wants to have “his” Court have a good reputation in history, and has been helpful on some cases, including upholding the Affordable Care Act in 2013, and he likely will continue to uphold that law soon, in another challenge.

And the idea that Neil Gorsuch, who gained the position that Barack Obama appointed Merrick Garland to, and was not even given the chance for a hearing and a vote on the appointment, was also in the majority on this case, is a welcome sign of a pyrrhic victory for Donald Trump, in getting Gorsuch on the Court!

Pure Insanity: $200 Million Spent On Campaign Commercials By Michael Bloomberg And Tom Steyer!

It is pure insanity that two Democratic Presidential contenders, Michael Bloomberg and Tom Steyer, both multi billionaires, have together spent $200 million on their Presidential campaign commercials, with Bloomberg wasting $120 million, and Steyer $80 million, more than all of the other Presidential contenders combined!

Bloomberg has not been willing to contend in the February caucuses and primaries, and has not participated in any debates, and seems to think he can buy his way into the Presidency, and he needs to be repudiated for that alone.

While Steyer has been competing in the caucus and primary states in February, and has been in a couple of debates, he must, also, be repudiated for using his personal wealth in pursuit of the Presidency.

The Citizens United case of the Supreme Court must be reversed somehow, but it seems highly unlikely anytime soon, as the only method is a constitutional amendment, or another case coming to the Supreme Court and leading to a reversal, nearly impossible in the present political climate of the Court, with two new Trump appointees, Neil Gorsuch and Brett Kavanaugh.

But the Democratic voters need to give a smashing repudiation to both Bloomberg and Steyer once the voting starts in five and a half weeks from now!

The Right Wing Supreme Court Seems Ready To Declare War On Abortion, Gay Rights, Gun Rights, Immigration, Separation Of Church And State, And Presidential Power

The new session of the Supreme Court has begun, and the full effect of Donald Trump appointees Neil Gorsuch and Brett Kavanaugh will now, likely, be felt.

While it is true that Gorsuch and Kavanaugh are not “twins”, to expect any major surprises in constitutional law in this 2019-2020 term are highly unlikely, as right wing law looks in the ascendancy.

What the Court decides ends up as the law of the land, and for progressives, it does not bode well on the issues of abortion, gay rights, gun rights, immigration, separation of church and state, and the growth of Presidential power.

The fulcrum of the Court, Anthony Kennedy, is now retired for a year, and the only hope to avoid extreme right wing judgments is if Chief Justice John Roberts, who has been a surprise a few times in his views on the Court in recent years, becomes the new “swing” vote on the Court this term.

Roberts might also preside over an impeachment trial of President Donald Trump, who he, clearly, has been critical of in a number of ways, and the Court could limit Trump’s Abuse of Power, beyond Roberts presiding over an impeachment prosecution.

Since Roberts is worried about the image of “his” Court, some surprises may be in the offing, and of course, progressives will be watching the health and stability of Ruth Bader Ginsburg, now 86, having survived a third and fourth cancer, and wondering if she will be able to continue on the Court into the next Presidential term in 2021.

A Way To Promote End Of Political Polarization: Nominate Merrick Garland A Justice Of The Supreme Court

Assuming that the nomination of Brett Kavanaugh to the Supreme Court fails to gain a majority of the US Senate, the future of the Court and its reputation remains at stake.

One way to resolve it is for both Republicans and Democrats to work toward the end of polarization, and call upon President Donald Trump to nominate Merrick Garland to the empty seat on the Supreme Court, three years after he was summarily dismissed and ignored by the Republicans, when President Barack Obama nominated him to replace Antonin Scalia, who died in February 2016.

Merrick Garland was seen by Obama as a compromise choice, whom the Republicans would accept, as he is seen as a moderate, and has a distinguished background as the Chief Judge of the US Court Of Appeals for the DC Circuit, the highest court next to the Supreme Court.

Garland is technically the “boss” of Brett Kavanaugh, and also was of Supreme Court Justice Neil Gorsuch, and both of them have always been very positive in their views of Garland.

Being in his mid 60s. Garland would serve far less than the theoretical 30 years that Gorsuch might serve, and that Kananaugh might serve if he was confirmed.

Garland is perfectly qualified to keep the Court balanced, and would likely replace Anthony Kennedy as the “swing vote” on the Court, and would prevent the kind of polarization represented by an extreme right wing choice for the Supreme Court, keeping it as four liberals, four conservatives, and Garland as the crucial vote, sometimes siding with one or the other side, as Anthony Kennedy did, and earlier, Sandra Day O’Connor did.

Why could not the two parties agree to a truce, to work toward cooperation, and return the US Senate to what it was under Lyndon B. Johnson and Ronald Reagan, when Senator Everett Dirksen worked with LBJ, and Speaker of the House Thomas “Tip” O’Neill did with Reagan, working across the aisle on many matters?

It is proper that Merrick Garland be put on the Court, as a distinguished, and accomplished man, who deserves, belatedly, three years late, to give his service to our nation’s highest Court.

The Kavanaugh Supreme Court Battle Increases Chances Of Democratic Controlled Senate In 116th Congress

The battle over the Supreme Court nomination of Brett Kavanaugh, who now faces further scrutiny, due to sexual assault charges, improves the chances of the Democrats being able to win the US Senate for the 116th Congress.

As a result of this situation, none of the ten “Red State” Democrats need to feel political pressure to back Kavanaugh, as three of them did for Neil Gorsuch in 2017.

And it seems highly likely that two Republican women Senators, Susan Collins of Maine and Lisa Murkowski of Alaska, will now be able to justify refusing to support Kavanaugh, if he does not withdraw.

Even two Senators who are leaving at the end of the year, Bob Corker of Tennessee and Jeff Flake of Arizona, might also reject Kavanaugh if he comes up for a vote after next week’s hearings for his accuser, as well as for Kavanaugh himself.

So it now seems likely that there will be no new Supreme Court nominee before the election, and probably not before the new Congress, and if the Democrats can win Arizona, Nevada, Tennessee, and Texas, or at least two of those states, and keep all 49 of their Senators, then they have the ability to tell Donald Trump, that they will refuse to accept any appointment to the Court, except Merrick Garland, who was denied a hearing in 2016.

Since Garland is a moderate centrist, and in his mid 60s, his appointment to the Court would be shorter in duration, but it would keep a balanced Court, and allow a good man to gain what he was entitled to two years ago.

So there may be yet some justice in this whole situation, or else Trump may have to live with a long term eight member Court.

The Record And Views Of Supreme Court Nominee Brett Kavanaugh Could Determine Constitutional Law To 2050!

Tomorrow, the contentious hearings on the nomination of Supreme Court nominee Brett Kavanaugh will begin in the Senate Judiciary Committee.

These will be the most controversial set of hearings since 1987 and Robert Bork, and 1991, with Clarence Thomas.

On both of those occasions, the Democrats controlled the Senate, and Bork was rejected by a vote of 58-42, while Thomas was confirmed by a vote of 52-48.

The effect of Justice Clarence Thomas for the past 27 years has been profound, with many future potential Circuit Court or Supreme Court candidates having clerked for him.

Thomas has been trying to take us back to the Articles of Confederation in many ways, but also admiring Presidential power at the same time.

This is the danger of Brett Kavanaugh, that he would take America domestically back to the Gilded Age, wiping out the New Deal, Great Society, and everything Barack Obama changed.

He comes across on the surface as a pleasant, nice man, but it is all very misleading.

This is a man who worked for Ken Starr in the impeachment of Bill Clinton, and now Kavanaugh has changed his view of Presidential power 180 degrees.

This is a man who worked in the White House for George W. Bush, and helped to plan the idea of an anti gay marriage amendment, that was part of the campaign of Bush in 2004. And now, Donald Trump has used executive privilege to prevent 100,000 documents from Kavanaugh’s time in the Bush White House from being made available, which is another controversy now created, as why should the Senate be unable to examine all pertinent material about a nominee?

This is a man who worked to deny September 11 victims the ability to sue for damages, limiting unsuccessfully that intent.

This is a man who in his Circuit Court decisions has come out against abortion rights, against ObamaCare, against the Consumer Financial Protection Bureau, against labor union rights, and willing to support limitations on voting rights.

This is a man who might be able to vote on whether Donald Trump can be indicted or prosecuted, and should recuse himself on any such matters as a conflict of interest, but likely will not do so. Justice William Rehnquist, when new on the Court as an Associate Justice, recused himself from the US Vs. Richard Nixon case in 1974 (after which Richard Nixon resigned), because Rehnquist had worked in the Justice Department under Nixon. So that famous and significant case was 8-0, not 9-0 or 8-1, and at the least, a Justice Kavanaugh should recuse himself from any case involving possible legal action against Donald Trump.

Kavanaugh could affect future decisions on campaign finance, climate change, election gerrymandering, and travel bans, and regulation of guns.

He would also create a right wing conservative Court, unlike any since 85 years ago.

And being only 53, he could be on the Supreme Court until 2050, when he would reach 85 years of age.

This would be the most long range effect of Donald Trump, no matter how much longer he remains in the Presidency, along with the 26 and more Circuit Court confirmations already accomplished by Senate Majority Leader Mitch McConnell, along with Supreme Court Justice Neil Gorsuch.

The Democrats’ only hope would be IF all 49 Democrats hold fast (highly unlikely); Susan Collins and Lisa Murkowksi (both pro choice on abortion) abandoning the party ties on this vote (highly unlikely); and the person who replaces John McCain in the Senate (maybe Cindy McCain) joining the two women Republican Senators in voting against Kavanaugh (highly unlikely).
