Enforcing 14th Amendment, Section 3, Will Eliminate Threat Of Donald Trump Being President Again!

A simple solution to the threat of Donald Trump running for President again is to enforce the 14th Amendment, Section 3, as passed and added to the Constitution after the Civil War and during the Reconstruction Era.

Congressman Steve Cohen of Tennessee, the Chairman of the Judiciary Subcomittee on the Consitution, Civil Rights, and Civil Liberties has proposed a measure to enforce this section of the 14th Amendment, and Senator Amy Klobucar, Chair of the Rules Committee, has done so in the Senate.

Section 3 of the 14th Amendment reads as follows:

No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House remove such disability.

The US Attorney General could move to enforce this section of the Constitution before a three judge panel. Such individual would be disqualified from holding public office, once clear and convincing evidence that an office holder or former office holder engaged in insurrection or rebellion. Such individuals would also forfeit all benefits derived from their service in federal office, and would be prohibited from obtaining contracts with the federal government. And a former President would not be considered such for the purpose of receiving benefits under the Act.

Additionally, members of Congress who were involved in inciting and promoting what happened on January 6, 2021, would face the same penalties and lose their rights to serve or gain benefits from their past service!

William Barr, Most Corrupt Attorney General Since John Mitchell Under Richard Nixon

Attorney General William Barr will go down as the most corrupt person in that position since John Mitchell under Richard Nixon.

Earlier Attorneys General who were disastrous include A. Mitchell Palmer under Woodrow Wilson and Harry Daugherty under Warren G. Harding; and after Mitchell, Richard Kleindienst under Richard Nixon; Edwin Meese under Ronald Reagan; Alberto Gonzalez under George W. Bush; and Jeff Sessions under Donald Trump.

Barr was Attorney General in the last year and a half under George H. W. Bush and helped to arrange the pardon of those who had engaged in the Iran Contra Affair; and now has become Donald Trump’s Attorney General, rather than the nation’s Attorney General, with his covering up on the Robert Mueller investigation into wrong doing by Trump.

While all of the above Attorneys General have besmirched the reputation of the Department of Justice, Barr will stand out as ranking with Mitchell as a person who had no issue with engaging in corruption.

Only Nixon and Trump have had two horrible Attorneys General, a sad commentary on the cabinet officer responsible for enforcement of the law and the Constitution.

Presidential Succession Law Of 1886-1947 Needs To Be Renewed!

In 1947, the Republican controlled 80th Congress, in a fit of partisanship and anti FDR sentiment, changed the Presidential Succession Law of 1886, enacted during the first term of President Grover Cleveland.

That law made the succession for the Presidency beyond the Vice President to be as follows: Secretary of State, Secretary of the Treasury, Secretary of War, Attorney General, and then other cabinet agencies, including Interior and Agriculture.

That law made sense, as it meant that in case of tragedy hitting the President and Vice President, that members of  that President’s cabinet, people loyal to him, knowledgeable in  foreign and defense policies, and domestic policies, would be next in  line, in case of an emergency.

But the Republicans after World War II were furious that Franklin D. Roosevelt had been elected four times, so not only added the 22nd Amendment, limiting any future President to two elected term, or a maximum of ten years if he succeeded during a term, but also decided to make the Speaker of the House and the President pro tempore of the Senate second and third in line behind the Vice President.  That, of course, meant, that if anything had happened to President Harry Truman, and with no Vice President for the remainder of that term of office, that Speaker Joseph Martin, a Republican, would have succeeded him.

The idea of having the opposition party gain the Presidency during a term due to a tragedy was not based on what was good for the nation, but pure partisanship by the GOP.

But now, the extremism in the GOP, including the Tea Party Movement right wing whackos, makes the idea of John Boehner, or some other Republican gaining power of the executive branch under a Democratic administration totally reprehensible, as that would mean a dramatic turn to the far Right, although the people voted in a Democratic administration.  Also, the President pro tempore of the Senate, a position which is honorary based on seniority in the majority party in the Senate, brings the danger, not only of partisanship, but also the reality of a very old Senator, unfit to serve, being third in line for the Presidency, and at the time of Truman, second in line to be President!

That is why there is a need to repeal the 1947 law and return to the 1886 law, which makes the most sense, as the Speaker of the House, while elected, is only chosen by one Congressional district out of 435, and is therefore NOT representative of the nation, as much as a cabinet member, selected by the President but subject to Senate confirmation, is representative of the policies and ideals of the elected President!

The likelihood of this happening short term is near zero, but it is worthy of consideration for the near future!

37 Days To The Extremely Important Midterm Elections Of 2014!

With the crisis of ISIL (ISIS) having emerged as the most dangerous threat to America since September 11, 2001, and with this being the greatest world crisis since World War II, it is now 37 days to the extremely important Midterm Elections of 2014, both in foreign and domestic policy!

We need cooperation on the foreign policy front between Congress and the President, but that is unlikely if the GOP wins control of the Senate, even if they are still able to hold on to control in the House of Representatives!

Such a scenario will undermine the war effort, and the need to deal with many domestic issues, that are desperately in need of attention!

The possible appointment of a Supreme Court Justice before the next Presidential election, and of a new Attorney General in the next few months is riding on the ability of the Democrats to keep control of the US Senate, which thankfully, seems highly likely right now!

The ability to bring about immigration reform; to protect the environment; to gain funding for infrastructure projects; to see further advancements in civil rights; to promote support for those who are in poverty to have a higher minimum wage, extension of unemployment compensation and expansion of Medicaid; to promote equal pay legislation for women; and so many other initiatives, is hanging in the balance!

It is urgent that those who believe in progressive reforms must get out the vote, and make people who are apathetic voters realize the importance of their voting, and not just for Congressional elections, but also for state governors and state legislatures, as we have seen much evidence of the damage done by Tea Party Republican Governors on so many issues!

Attorney General Eric Holder Leaving The Obama Cabinet: A Major Loss Of One Of the Greatest Attorneys General In American History!

One of the longest serving Attorneys General in America, Eric Holder, announced today that he was leaving the Obama cabinet as soon as a successor is confirmed, probably at the beginning of the 114th Congress in January!

By then, Eric Holder will have served six years, the third longest term as Attorney General, only trailing second place Janet Reno under Bill Clinton, and William Wirt, who served longer than anyone under James Monroe and John Quincy Adams in the early 19th century!

Holder has been bitterly attacked for his performance and his own character by right wing whackos of the Tea Party Movement, and joined by Republican leaders in both houses of Congress, who have stopped at nothing to degrade him, including citing him for contempt of Congress, and threatening impeachment.

Through it all, Holder has acted with dignity  and class, just like his boss, President Obama.  Both of them have refused to take the bait and get angry, and have made their critics look what they are—prejudiced, biased, racists, and not giving a damn about civil rights and civil liberties of all of the American people.

Holder has worked to try to restore the Voting Rights Act, after the shameful reversion on much of it by the Supreme Court in 2013.

Holder has worked to promote prison reform, and to lower the prison population by freeing people who were wrongfully convicted or kept in prison way beyond all reasonable sentences.

Holder also prosecuted hundreds of terrorism cases, tackled financial fraud, and worked against violent crime and corruption, as well as working to promote the environment.

Holder was the first African American Attorney General, and he should be succeeded by retiring Massachusetts Governor Deval Patrick, another African American.

That will be difficult if the Republican opposition wins control of the Senate, another reason for everyone to vote in the midterm elections.  We are bound to see open racism by many Republicans if Patrick is nominated to succeed Holder, even if the GOP does not win the Senate majority!

This nation was blessed to have a great man as our Attorney General, and Eric Holder will be ranked among the top Attorneys General in American history over time!
