Gay Marriage

ObamaCare At Three Years: A Significant Moment In American History!

It has now been three years since ObamaCare became law, and the full extent of the law will take effect in 2014, but already millions of Americans have benefited from the provisions, including children covered to age 26, lower drug costs for seniors, and pre-existing conditions no longer a reason to deny a child or adult’s ability to gain health insurance coverage.

The health insurance companies have raised rates in a desperate attempt to harm ObamaCare, and the Republican House of Representatives has voted 36 times to repeal the health care legislation, but it has all been for show, and there is no way that ObamaCare will be repealed, even if the Republicans gained the Senate in 2014, as the President would be able to veto a repeal, and the GOP could never gain a two thirds override to overcome the Presidential veto.

And any attempt to repeal, were it possible to achieve, would so disrupt the health care being made available to up to 50 million or more people, that it would be a crime to take away what has been gained by those who did not have health care coverage before!

Health care has been transformed forever, thanks to the support of Chief Justice John Roberts, who had the decisive vote last June, and he will go down in history in a positive light, and it is hoped that his views on constitutional matters will become more moderate, and that he will back gay marriage, support continuation of the Voting Rights Act, and take an enlightened position on other issues.

But even if he does not, Roberts has changed the course of history, with the assistance of the four Democratic appointments to the Supreme Court!

Hillary Clinton’s Endorsement Of Gay Marriage: What It Portends

Former Secretary of State Hillary Clinton has finally endorsed gay marriage in a strong public statement, mirroring her husband’s statement that the Defense of Marriage Act, passed during his Presidency in 1996, was a mistake, and that it was time for it to be repealed.

Hillary Clinton has always been a strong supporter of gay rights, but avoided gay marriage until now.

The question is why, and there are three answers:

The Supreme Court is about to hear a case that could transform this nation on the subject of marriage, unlike anything since Loving V Virginia in 1967, which finally declared interracial marriage to be constitutional. Extra pressure on the Court at a time like this cannot help but possibly influence Justice Anthony Kennedy and Chief Justice John Roberts, either or both who could be the decisive votes on the case.

Many Democrats have endorse gay marriage, including President Obama, Vice President Joe Biden, and potential Democratic nominees for President, including Governor Andrew Cuomo of New York and Governor Martin O’Malley of Maryland, so if Hillary Clinton is soon to decide to run for President in 2016 she would, obviously, need to get into line on the issue.

Also, Hillary could be taking this step out of pure principle, and belief that the time is right for this significant social advancement.

No matter what the motivation, and it is probably all three, it is proper to salute Hillary Clinton for speaking up, once again, for human rights and human dignity!

Senator Rob Portman, Gay Marriage, And The Republican Party Future

Ohio Republican Senator Rob Portman, former Budget Director for President George W. Bush, one of the few moderate conservative voices in the Republican Party in the US Senate, has come out in favor of gay marriage, making him the first Republican Senator to do so, and unlikely to have others follow him. This seems, clearly, due to the fact that his younger son Will is gay, and Portman wants his son to have a happy life, and the rights and privileges of marriage someday.

One could point out that Portman only spoke up because of his son, which is clearly the case, but it still took courage for him to do what he did.

And it is interesting to see former Senator Rick Santorum spew his usual narrow minded hatred, and one has to wonder what if one of his children came out as gay or lesbian. As a “devout” Catholic, he probably would do what so many “devout” Christians have done, sadly, and that is to throw out their child, disown him or her, have no more contact with him or her, act as if that child no longer exists, rather than understand that gays do not choose to be what they are. Why would anyone want to be facing hate, prejudice, discrimination, and bodily threats if one could avoid it?

So for anyone claiming to be “devout” and “religious” and act like Rick Santorum and so many others, is hypocrisy, and until and when the Republican Party stops allowing the religious Right to control the party agenda, it will never win over the vote of the younger generation, which is totally tolerant on the issue of sexual orientation.

Many non office holding Republicans have come out for gay marriage rights, and Ted Olson, former Solicitor General under George W. Bush, is leading the case to be presented before the Supreme Court, and there is a feeling that the majority of the Court, led by Justice Anthony Kennedy, who made for the success in the Lawrence V. Texas case in 2003, on gay privacy rights, will declare gay marriage rights to be constitutional throughout the United States, although churches and synagogues would not be required to marry gay people. Such a decision for gay marriage would involve the right of civil marriage alone.

The Republican Party needs to change its view, or else, like in many other ways, it will go into the dustbin of history!

The Advancement Of The Progressive Agenda In 2013

With the renewal and expansion of the coverage of the Violence Against Women Act, other important ideas are coming to the forefront of the progressive agenda:

Raising of the minimum wage, which 71 percent of the American people endorse, with a minimum of $9 an hour, although bills to raise it to $10 an hour have been introduced by some members of Congress. Realize that if one was to keep up with the cost of living since 1938, when the Fair Labor Standards Act was passed with a 25 cents an hour wage, the minimum wage would have to be at $13 an hour now to be the equivalent of 75 years ago.

Universal Background Checks for all gun purchases, which 88 percent of those polled want, including 85 percent of gun owning households.

More tax increases to reduce the deficit, a balanced approach with spending cuts that are fair and just, and do not hurt those on the bottom more than those on the top of the economic scale, with 76 percent agreeing with this.

Infrastructure Investments to repair and replace our deteriorating physical plant, and creating hundreds of thousands of new jobs. This is the best job creation policy, and is important for the nation’s economic growth and national security.

A pathway to citizenship for undocumented immigrants, particularly for children brought to America and knowing nowhere else, and 70 percent agreeing with this in polls, and 60 percent of Republicans. This is the right thing to do, and is a way for Republicans to improve their image electorally.

Expansion of the Medicaid program, so that all Americans will be able to have accessible health care, a basic goal of human decency and compassion for those less fortunate.

Marriage equality, so that gay Americans no longer face discrimination legally in any aspect of their lives, including the right to have their marriages seen as legitimate.

Providing of Early Childhood Education, including universal Pre Kindergarten coverage, as a way to assist in the goal of early educational intervention, which will reap benefits in the future.

If all eight of these goals can be achieved, we will have major progressive victories in 2013!

Associate Justice Antonin Scalia And “Entitlement” To Voting Rights: An Outrage!

Associate Justice Antonin Scalia, who has been on the Supreme Court for 27 years now, has become a literal nightmare with so many inappropriate, arrogant statements on and off the Court in the past few years!

His latest outrage was in oral argument on the Voting Rights Act today in the Supreme Court, when he stated that the Voting Rights Act was a “racial entitlement”!

In so stating, he demonstrated that he has learned nothing about past racial discrimination and denial of the right to vote, which necessitated passage of that law in 1965!

With the record of many Republican states, particularly in the South, infamous for past discrimination and Jim Crow segregation laws when they were Democratic states, moving to make it more difficult to vote, as with Florida and Governor Rick Scott as just one example, how can anyone justify getting rid of the requirement of accountability on voting law changes by the federal government?

Voting should not be an “entitlement”, as it is a right that all Americans over the age of 18 should have, and no voter ID laws should be used to disenfranchise anyone, or require a 102 year old woman to have to wait six hours to vote in Florida or anywhere else!

Sadly, the Republican majority Supreme Court is likely to knock down the Voting Rights Act, which will stain the court of Chief Justice John Roberts, if it happens. Roberts’s reputation, improved by his support of ObamaCare last June, rides in the balance of what happens on this, as well as the gay marriage and expansion of the Citizens United cases that are before the Court!

It also could be argued that Scalia may be showing signs of instability at his age of 77 next month, and it will be a great day when this most right wing member of the Court in nearly a century finally retires from the Court at some point in the future!

As Rosa Parks Statue Is Unveiled In The US Capitol, Voting Rights Act Comes Under Review By Supreme Court!

This morning, a 9 foot statue of Rosa Parks, the “Mother” of the Civil Rights Movement, for her heroism in allowing herself to become the center of the Montgomery Bus Boycott in 1955-1956, was unveiled in Statuary Hall in the US Capitol Building.

This is a wonderful event to commemorate the greatest human rights movement in American history, and the excitement over how far we have come, with President Barack Obama leading in commemorating the event, and the feeling of satisfaction that we have gone far enough in the half century since 1955, that we have an African American President in his second term in office!

But at the same time, ironically, a challenge by the state of Alabama, which arrested Rosa Parks for refusing to change her seat on a bus in Montgomery, is arguing a case before the Supreme Court today, which if successful, will negate Section 5 of the Voting Rights Act of 1965, which requires nine Southern states and portions of seven other states, which have been shown to be discriminatory in voting regulations in their past, to have to submit any voting law changes to the Justice Department before they can be put into effect.

The argument is that the law is outmoded and no longer necessary, but that is not the case, as last year, there were attempts in many states to make it more difficult for African Americans, Hispanics and Latinos, young people, the elderly, and the poor to be able to register and or vote, plus restrictive days and hours of voting, designed to help Republicans and Mitt Romney gain an unfair advantage in the elections.

Just because Alabama claims the law is no longer needed is belied by history and recent events, and the Congress has renewed the Voting Rights Act multiple times, and it should not be the right of the Supreme Court to repeal a law in effect for nearly a half century!

But this conservative Court just might do that, which would be a miscarriage of justice, and another example of how the Court has started to get out of control of promotion of true justice! Their decision on this case, along with the move to make Citizens United just the beginning of special interest investments to fix elections, and the gay marriage case, will make the Court’s decisions in the next few months extremely significant, and worrisome for those who believe the John Roberts Court is reckless and dangerous, with its conservative majority put on it by Ronald Reagan, George H. W. Bush, and George W. Bush!

Florida Senator Marco Rubio: His Record Not A Positive One For The Presidency In 2016!

Florida Senator Marco Rubio is very charismatic, handsome, youthful, and charming, and Time Magazine called him “The Republican Savior”.

Then he gave the response to the State of the Union Address, and showed total hypocrisy when he stated that government gets in the way, and cannot solve people’s problems or help them in a major way.

But then, he also said in the same speech that he would never have finished his own education without the federal government loans program, and that his mother depended on Medicare for her health care, although now the federal government should be cutting both programs and others as well.

In so doing, being contradictory, Marco Rubio messed up his chance to be impressive, just as Bobby Jindal, Governor of Louisiana and the same age as Rubio, did when he responded to the State of the Union Address in 2009.

And when one examines the Rubio record, he discovers the following facts:

Rubio has had huge personal debt problems and was implicated in a political credit card scandal.

Rubio has lied and exaggerated about his family history, including the idea that his grandfather escaped Fidel Castro and Cuba, when he actually migrated in 1957, when Fulgencio Basista was still in power.

Rubio backed Florida Governor Rick Scott in his scheme to limit the hours and participation of voters in the Sunshine State.

Rubio voted against the extension of the Violence Against Women Act.

Rubio has been involved in support of groups that are vehemently anti gay rights and marriage.

Rubio supported a bill to allow employers to deny birth control insurance coverage to employees.

Rubio has called for Defense Secretary nominee Chuck Hagel to withdraw, denying President Obama the right to select his own cabinet officers, as long as there is no corruption involved.

Rubio has denied science, questioning climate change and evolution

Rubio signed the Grover Norquist tax pledge.

And the list of faults and shortcomings goes on beyond this short list above, and disqualifies Marco Rubio as a serious Presidential nominee in 2016.

And yet, when compared to Jindal, Senator Ted Cruz of Texas, Wisconsin Congressman Paul Ryan, and many others, Rubio probably has a better chance to be the GOP nominee in 2016, and lose to Hillary Clinton, Joe Biden, or whoever else the Democrats nominate!

Republicans Seem To Be Suicidal In Reluctance To Change Course

The Republican Party is in its death throes more and more each week.

The country is no longer interested in their agenda, in their candidates, in their goals, and in their promotion of fear and hate!

The GOP has lost five of the last six popular vote totals for President, despite spending inordinate amounts of money, the most ever in 2012, due to the Citizens United case of the Supreme Court in 2010.

But they have elements that are destroying them from within like a cancer!

These destructive elements include:

The right wing conservative talk show hosts on radio and Fox News Channel, who are making massive amounts of money promoting hate, fear and division, and until the GOP tells Rush Limbaugh, Glenn Beck, Sean Hannity, Bill O’Reilly, Mark Levin, Michael Savage, Ann Coulter, Michelle Malkin, Laura Ingraham and their ilk to go somewhere, they will be going down the road to destruction!

The power of the National Rifle Association and Wayne La Pierre, and its campaign to defeat any candidate who wants any reasonable gun regulations, is going to cause the defeat of Senators and Congressmen, who are unwilling to sell their souls to this powerful pressure group!

The Tea Party Movement, which wants to wipe out Social Security, Medicare and Medicaid, and is furious at Republican Governors, including the latest convert on ObamaCare, Florida Governor Rick Scott, making it a total of seven Republican Governors who have decided to accept that program, has plans to run candidates against anyone who does not wish to support their desire to go back to the 19th century and wipe out all aspects of the welfare state, so Maine Senator Susan Collins is on a hit list, as is even Senate Minority Leader Mitch McConnell, for not being conservative enough! Do not forget that the Koch Brothers and other wealthy billionaires are the brains behind this movement, which is lower class populism gone wild, but they have the ability to harm the Republican Party establishment! And Rand Paul and Ted Cruz are the lead elements in this Tea Party uprising, who might cause the Republican Party to go down to defeat in many races, because of their loony libertarianism!

The right wing evangelical Christian movement, which will fight any move toward acceptance of gay rights and gay marriage, abortion rights, immigration reform, and gun regulation, as well as their desire to promote religion in the education curriculum, rejecting science and history, and promotion of a theocracy in states that have large numbers of their believers.

The “NeoCons”, Neoconservatives, who want more money spent on defense, advocate overseas military interventions, and glorify wars in the name of American capitalism and profits! They had power under George W. Bush, but are now trying to defeat Chuck Hagel for Defense Secretary.

And finally, the no tax increase crowd, led by Grover Norquist of Americans For Tax Reform, a group which is starting to see some Republicans abandon them, but not enough, and willing to back corporate loopholes and the wealthy, at the expense of the middle class and the poor, these two groups failing to understand that this elite has no concerns, except to back the establishment on Wall Street and in the corporate world, even at a time when corporate profits are soaring, and the stock market has doubled under Barack Obama!

These are the destructive elements in the Republican Party, and will cause its total dissolution very soon if the direction of the party is not changed to appeal to the moderate center, the tradition of the party under Abraham Lincoln, Theodore Roosevelt, Dwight D. Eisenhower, and YES, even in the time of Ronald Reagan, when moderates were still a major part of the party success, and Reagan a conservative but not an extremist, as these various elements of the party are in 2013!

The “New” Generation Of Democrats: Led By Andrew Cuomo Of New York And Martin O’Malley Of Maryland!

As the next Presidential term begins in a few days, the focus has been on Vice President Joe Biden and outgoing Secretary of State Hillary Clinton as the two most likely front runners for the Democratic Presidential nomination in 2016.

While certainly that is possible, it is also conceivable that a “New Generation” of leadership may be emerging to contest their front runner status, and just might be the alternative to either Biden or Clinton.

Two Northeastern Governors have likely plans to announce for President, and both are working very hard to establish their credentials in similar fields of endeavor.

These two gentlemen are New York Governor Andrew Cuomo and Maryland Governor Martin O’Malley.

Both have become leaders in promoting gay rights and gay marriage in their states, and both have taken leadership in the area of gun regulations in wake of the Sandy Hook Massacre in Connecticut.

Both are very bright, articulate leaders of the future, whether or not they enter the contest for the Presidency, and both have extensive executive experience in public office.

Both will certainly be heard from in the future, and will be discussed regularly over time on this blog! So stay tuned!

Progressive Victories In 2012

As the year 2012 comes to an end in the next few days, it is worth looking back to what progressive victories there have been in 2012.

The clear cut victory of Barack Obama is an event still reverberating in the emotions of this blogger, and the strong belief that the Obama coalition is solid, and will carry beyond him and affect politics over the next one to two generations! Any Democrat who is nominated for President in 2016 would be the favorite to win the White House, as the nation becomes more “blue” in states such as Arizona, Georgia and Texas.

The likelihood of the US Senate staying Democratic is also a conclusion from the events of 2012, as it was truly miraculous that every seat was retained, three gained, and only Nebraska lost to the Republicans in 2012. While 2014 again will see more Democratic seats (21) up than Republican seats (14), the odds of the Democrats losing a net total of six seats and losing control is extremely unlikely, and the possibility of gaining more seats is also very likely with the Republican party turning ever further to the Right politically, and further alienating the rapidly changing demographics of the country.

The biggest surprise of the year was the decision of Chief Justice John Roberts, a Bush II appointee, to back ObamaCare, guaranteeing its survival and success despite many barriers past, present and future. This was the most important decision of the Supreme Court in a long time, in the sense of its long range impact on the nation!

The great progress of gay rights and gay marriage was a wonderful event, with the likelihood of gay marriage being upheld by the Supreme Court, at least in some limited fashion, by June of next year.

The rise of the prominence and numbers of women in politics was exciting, and the true star of the year in that regard was Elizabeth Warren, the newly elected Senator from Massachusetts, who could become a Presidential possibility very quickly.

The massive contributions of Vice President Joe Biden and Secretary of State Hillary Clinton make them the two best decisions on personnel that President Obama made four years ago, and they have had an extremely positive effect on the historical record and reputation of Barack Obama.

The power of wealthy millionaires and billionaires to control the politics of America suffered a smashing defeat, an event thought unlikely after the Citizens United decision of the Supreme Court in 2010.

The reactionary and hateful agenda of the far Right, both politically and religiously, also suffered a great repudiation, and proved once again that optimism and progress win out over fear and regression, as long as the American people become engaged and involved in the agenda, and realize the threat to the great progress made in the past 80 years by the New Deal, Great Society, and the many political, social and economic reforms brought about by forward looking Democrats and Republicans in Congress, and by the leadership of Presidents of both parties who saw the need for more government intervention and regulation–including Franklin D. Roosevelt, Harry Truman, Dwight D. Eisenhower, John F. Kennedy, Lyndon B. Johnson, Richard Nixon, Gerald Ford, Jimmy Carter, George H. W. Bush, Bill Clinton and Barack Obama. Notice that Ronald Reagan and George W. Bush are not included in this list, as they both set back the concept of fairness and equity that all of the other Presidents, including some Republicans, made part of their agenda, to the dismay of the right wing forces in America!

So 2012 has been a triumph in many ways for progressivism, liberalism, and the goals of the Left in American politics to make a society of justice, equity, and compassion!
