Civil Liberties

Foreign Policy Debate Tonight Is Crucial In So Many Ways!

There is a tendency among many observers to think that foreign policy is not an important campaign issue this year, but they are wrong.

Foreign policy affects the American economy and its future, as it often adds massively to the national debt.

Foreign policy affects civil liberties, much more than we realize, as our rights are being chipped away in the name of “national security”.

Foreign policy affects the military, and the likelihood of more military engagements and military spending, in a nation which already spends more on the military than the next 10 nations combined.

Foreign policy under Mitt Romney is more likely to bring about a revival of the “neoconservative” influence, and intervention in Iran, Syria and elsewhere, which only benefits the war industries and wealthy people, who are too willing to send poor, unemployed men and women in as cannon fodder for economic gains that make the plutocracy ever more powerful.

What we need is a measured and rational hand on foreign policy, and the record of Barack Obama makes him far better qualified to be our Commander in Chief and our Chief Diplomat.

Mitt Romney would be a massive gamble, a man who knows little about foreign policy, leans on George W. Bush advisers too heavily, and loves to shoot at the hip with his rhetoric, antagonizing even our friends, as well as our rivals. He does not deserve to be in charge of America’s role with the outside world!

The Supreme Court: The MOST Crucial Issue In The Presidential Election Of 2012!

Plenty of attention is being paid to economic and domestic policy in the Presidential campaign of 2012.

Also, now with the Middle East crisis that erupted this week, foreign policy is, suddenly, being given tremendous emphasis.

It is right that attention is being paid to both areas of national policy, as they really matter!

But an area which still is NOT being focused on adequately, if in fact at all, is the effect of the election on constitutional matters, which are determined primarily by the Supreme Court of the United States, along with the federal circuit courts.

First, the circuit courts consistently have vacancies, even in a one term Presidency, which can have a dramatic effect on constitutional law. Also, it must be remembered that the tradition has been to appoint Supreme Court Justices from this level of the judiciary, although that was certainly not the norm in the long history of the Supreme Court.

Ultimately, however, it is the Supreme Court which is the final arbiter of the Constitution, as the nine members of the Court, once they have made a determination, rule the day, unless a constitutional amendment can be passed to overrule a Supreme Court decision, or the members of the Court, through changes of personnel, decide to revisit areas of controversy already decided by an earlier Court.

After a decade of no changes on the Court, from 1995 to 2005, suddenly, in a period of five years, from 2005-2010, there were four changes on the Court–Chief Justice John Roberts in 2005 and Associate Justice Samuel Alito in 2006 under President George W. Bush; and Associate Justice Sonia Sotomayor in 2009 and Associate Justice Elena Kagan in 2010 under President Barack Obama.

Now in 2012, there are four Justices in their 70s, who are seen as possible or likely retirees from the Court over the next four years—Associate Justice Antonin Scalia (76), appointed by President Ronald Reagan in 1986; Associate Justice Anothony Kennedy (76), appointed by Reagan in 1988; Associate Justice Ruth Bader Ginsberg (79), appointed by President Bill Clinton in 1993; and Associate Justice Stephen Breyer (73), appointed by Clinton in 1994.

By the end of the next term, if none of these four Justices left the Court, they would range in age from 77 to 83!

It seems certain that one or more will retire, or unfortunately, die, in the next four years, and who is appointing their successors, is all important for the future of constitutional law!

If Obama makes one to four appointments, it will, at the least, keep the present balance, slightly toward the conservative side, but if Mitt Romney makes the choices, it could make the Court more conservative, more to the right, than it has been since at least the 1920s, if not the Gilded Age of the late 19th century!

This is NOT a minor matter, considering the areas of criminal justice, affirmative action, abortion, gay rights, and the constitutionality of laws passed under the New Deal of the 1930s and the Great Society of the 1960s, and recent actions on health care, campaign fund raising, and many other touchy, controversial areas of policy, and of civil rights and civil liberties!

The Court could turn back a century of political, social and economic reforms, if it turns in the direction of the far Right, a danger with Mitt Romney in office!

We can expect that by 2020, if not 2016, all of the members of the Court will be those appointed in the previous 15 years, with the possible exception of Associate Justice Clarence Thomas (64), appointed by President George H. W. Bush in 1991, and stating he would not retire or leave the Supreme Court until he breaks the all time record of Associate Justice William O. Douglas, appointed by President Franklin D. Roosevelt in 1939, and serving 36 years on the Court under seven Presidents, until he left in 1975!

So this issue needs to be addressed in the Presidential debates in October, as it is an issue for voters to consider, and to recognize its significance!

The Potential Future Of Former Michigan Governor Jennifer Granholm: Supreme Court Or Justice Department?

Jennifer Granholm is a political figure to watch in the second term of Barack Obama, assuming that he wins reelection.

Granholm is the former Governor of Michigan and, earlier, was Attorney General of the Motor City state. She faced tough economic times, but managed to get reelected in 2006.

Since she left the Governorship, she has become a talk show host on Al Gore’s CURRENT channel on cable, and her show is well received for its analysis of the news, and her colorful personality.

That personality was very evident at the Democratic National Convention, when among all of the exceptional oratorical performances, her denunciation of Mitt Romney, and her description of the total number of jobs saved or created by Barack Obama’s rescue of the auto industry, both in Michigan, and in many other states, reverberated throughout the convention hall. She put on a magnificent, virtuoso performance, showing evidence of the acting ability she has, which, when she was young and a contestant on THE DATING GAME in 1978 at age 19, she indicated an interest in a Hollywood career.

Granholm’s speech and her background as Governor and Attorney General of Michigan bring attention to her potential future.

There is speculation that she could be on the short list for the Supreme Court and for Attorney General, as both positions can be expected to have vacancies.

The most likely first vacancy on the Supreme Court could be that of the seat of Justice Ruth Bader Ginsberg, who will be 80 next year, will have served 20 years on the Court, and has suffered from two bouts of cancer and lost her husband in recent years. Granholm would be an excellent selection to take Ginsberg’s seat, and would insure that the liberal approach of Ginsberg would remain on the Court.

But also, it is likely that Attorney General Eric Holder, under attack by the Republicans on many fronts, might decide one term is enough, and Granholm, with her service as Michigan Attorney General for four years, would be an excellent successor, and would have no problem at all in going into combat with Republicans in Congress.

Granholm is one tough lady, and would be certain to be an Attorney General who would fight the good battle for the American people against the power of big business and special interests, and with concern for the rights of average Americans through strict enforcement of civil rights and civil liberties!

The Middle Class Reacting To Romney-Ryan, And Their Promotion Of The Oligarchy

Both Mitt Romney and Paul Ryan are being besieged by demonstrators at campaign events, who reject their attack on the middle class, and their promotion of the oligarchy, the top two percent, who already have more concentration of wealth than at any time in American history, including the Gilded Age and the 1920s.

It is clear that nearly 80 percent of the American people, based upon polls, do not want Medicare turned into a voucher system. It is also clear that women are not going to accept the limits on their rights that Republicans are promoting in Congress and in many Republican controlled state legislatures.

The growing feeling is that this Romney-Ryan team could be the most radical right wing combination we have seen in Republican Party history, with the exception of Barry Goldwater in 1964, and even he came out for an attack on social conservatism and the power of religion in the GOP, backing gay rights and abortion rights, in his older years.

It is not promising when Paul Ryan is revealed to have agreed with radio talk show host Glenn Beck that progressivism and liberalism was a “cancer”, in a radio interview in 2010.

In other words, what this author said over the weekend about the inflexibility and ideological extremism of Paul Ryan is not just theory, but based on evidence, not only in that radio interview, but in the dealings of the House Budget Committee majority under Paul Ryan’s leadership, adopting a budget with massive tax cuts for the wealthy, while cutting Medicare, Medicaid, Social Security, Pell Grants, Food Stamps, and many other programs!

Notice that the popularity rating of the Congress, particularly of the House and its leadership, is at an all time low, hovering around 12 percent.

If Mitt Romney thought selection of Paul Ryan was going to invigorate his campaign, he was right in a certain sense. It has caused the beginning of the outrage of middle class Americans who are not going to allow the GOP team to destroy America as a land of opportunity, and the last great hope of mankind, and instead just promote the elite wealthy!

The Tea Party Movement had its opportunity to confront and challenge Barack Obama and his health care plan in 2009-2010, in a very vigorous and disruptive manner at political rallies and town halls.

Now, those who are opposed to the narrow mindedness of the Tea Party Movement are getting their opportunity to express their anger, as if we allow one side to be outspoken, the other side has the same opportunity. Freedom of speech and freedom of the press still exist, even for those who disagree with Glenn Beck and Paul Ryan! This is a democracy, not a dictatorship of the RIght!

Libertarian Gary Johnson For President: What Effect Might His Candidacy Have In 2012?

Former New Mexico Republican Governor Gary Johnson is the candidate of the Libertarian Party for President in 2012.

Johnson has been pretty much ignored, and was only allowed in two GOP Presidential debates during the primary season.

Johnson, however, will be on the ballot in all 50 states, and the question is whether he could be an effective third party candidate, and be a threat to either Barack Obama or Mitt Romney, and even reach the threshold of 15 percent required to be part of the three Presidential debates in September and October, as Ross Perot was able to accomplish in the 1992 Presidential campaign.

Right now, that possibility seems highly unlikely, but who knows what might transpire over the next three months, as disillusioned Americans might start to look at Gary Johnson’s candidacy!

Johnson’s views are a mix which COULD draw support from voters who are unhappy with Obama and Romney.

Among his views are:

Creating a balanced budget by cutting 43 percent of the Medicare and Medicaid budget in one year.
Abolishing the federal income and corporate taxes, and instituting a national sales tax based on consumption, instead.
Opposition to the ObamaCare legislation and the Prescription Drug Plan under George W. Bush.
Desire to withdraw from overseas engagements in Afghanistan and elsewhere, and was opposed to our involvement in Iraq and Libya from the beginning.
Opposition to the Patriot Act, and belief in civil liberties without interference by the American government.
Belief in states rights to deal with issues in their borders.
Opposition to abortion and the death penalty.
Belief in legalizing marijuana use, and the lowering of the drinking age, and believes the war on drugs has failed, and should be abandoned.
Opposition to measures for gun control legislation.
Belief that the Arizona law on illegal immigration was wrong, and would have vetoed it had it passed the legislature in New Mexico.
Support of same sex marriage and gay rights, including in the military.
Opposition to public funding of stem cell research.

This is a mix of issues that has the capacity to draw support , particularly among young people, and disillusioned voters with the major political parties.

So the question remains: Will Gary Johnson have an impact on the election, and if so, in what way?

The guess of the author is that Johnson could actually harm Mitt Romney in certain states, and possibly throw the election in those states to Barack Obama, including the states of Arizona, Idaho, Montana, Utah, Oklahoma, West Virginia, Kentucky, South Carolina, Alabama, Mississippi, and Alaska, all states believed to be RED or Republican!

So Gary Johnson COULD effectively become the Ross Perot of 2012, even without gaining 19 percent of the total national vote, a feat only a wealthy person such as Ross Perot could manage. However, Gary Johnson is said to be worth about $40 million, not a measly amount, to say the least!

Most Crucial Week In Supreme Court Since Gore V. Bush In 2000 Coming Next Week!

There is no doubt about it! Next week, the last of the Supreme Court’s present term, will have an impact on America unseen since Gore V. Bush in 2000, which decided that George W. Bush would be our President, instead of Al Gore, who had a 540,000 popular vote lead in the Presidential Election Of 2000.

The week is crucial to both Barack Obama and his Democratic Party, and also to the opposition Republican Party.

It will have a massive impact on millions of Americans who may lose their chance to have health care, and could take away benefits that have already gone into play in the past two years, since the passage of the Affordable Care Act, known to many as “ObamaCare”!

After a century of struggle for health care for all, since the first suggestion under Republican President Theodore Roosevelt, we could see America finally coming to the level of available health care that all advanced industrial nations in Europe, Australia and Canada already have, or else we could go backwards and have a long wait before it can possibly happen again!

It would be a great tragedy if the main purpose of the Obama Presidency is wiped out, or weakened considerably, by the conservative Supreme Court. But this is one of the long range results of the Bush V. Gore case of 2000, rearing its ugly head now, a dozen years later If Al Gore had appointed two Justices to the Supreme Court, they would not have been John Roberts and Samuel Alito!

Also, the Supreme Court will decide if the discriminatory immigration laws of Arizona and Alabama will be allowed to stand, and if it is that result, it will be a major blow to human freedom, liberty, and dignity!

The lives of millions of undocumented immigrants will be put into a situation similar to what African Americans suffered from until the civil rights era started to challenge the prejudice, discrimination, and bias that existed for nearly a century!

Are we about to go backwards on human rights, and victimize immigrant groups, as often we have done in the past of American history?

These two cases are a battle for the future, against the past, and it could be a very tragic week!

One thing is very clear, no matter what the decisions, and that is that the MOST IMPORTANT reason to support Barack Obama and promote a Democratic controlled Congress is the future of the Supreme Court, with four members being ages 73-79, and at least a couple of them likely to be replaced in the next Presidential term.

We cannot afford a President Romney who would move the Supreme Court further to the right, making constitutional challenges on the issues of civil liberties and civil rights, and the power of the corporate world, unable to be resolved in a proper way for the next generation and more!

Michelle Obama And Mitt Romney Give Commencement Addresses: The Massive Difference!

May is the season for commencement addresses at colleges and universities, and famous people, often political types, are recruited as a symbol of stature for those colleges and universities.

Today, Michelle Obama, the First Lady, gave the commencement address at Virginia Tech, the university which suffered through the worst murder rampage in the history of higher education, five years ago, with 32 students and faculty murdered.

Now, five years later, Mrs. Obama visited, and applauded the students who came to Virginia Tech since the massacre, and told them to be proud of their university, and how the school should never forget what happened, but continue to promote higher education and advancement as the best way to commemorate the tragedy. Her presence was inspiring to all who attended, a positive step to overcome hate and violence.

Tomorrow, Mitt Romney, the presumptive Republican Presidential nominee, will deliver the commencement address at Liberty University in Virginia, the school founded by television evangelist Jerry Falwell, and now operated by his son, Jerry Falwell, Jr.

It would be great to say that Liberty University keeps the tradition of its name, and is an open minded, tolerant place, but it was not under Jerry Falwell, and is no more so under Jerry Falwell, Jr.

Instead, it promotes censorship, including the banning of a student Democratic Party organization on campus.

The school will not accept or keep students in residence who are declared homosexuals, and just as the father preached, the son and his school preaches that being gay is a guarantee of entrance into hell as a sinner.

The school also is vehemently anti abortion, and preaches strict sexual morality, and treats women as second class citizens, attacking, as Jerry Falwell did, the whole feminist movement, and the promotion of equal rights for women.

This is a propagandistic, narrow minded university, a disgrace to the concept of a liberal arts education, and instead promotes an intolerant view of Christianity, no change since the first Jerry Falwell riled many people with his prejudices, and hate filled sermons!

The question is WHY Mitt Romney would give ANY dignity to a university which is a mockery of the purpose of higher education!

Does he not realize that this bigoted university dislikes the Mormon beliefs that he so zealously advocates?

Does he not know that this university gets federal funding despite its violations of the Bill of Rights, including freedom of speech and press, banning free discussion and debate?

What kind of message does Mitt Romney think he is sending? Can he not understand that his presence at this university, which can only add status and stature to this so called place of higher learning, makes his public image among independents, women, minorities, and intelligent young people, look all the worse?

What is it about Mitt Romney that he cannot understand that his actions and words do matter, and that he is sowing defeat by his refusal to abandon the hateful right wing wingnuts in his party?

Mitt Romney is an embarrassment to himself, to his party, to his nation, and to decent human behavior!

Rocker Ted Nugent, Mitt Romney, And Threats Against Barack Obama

Ted Nugent is a long time singer and musician, defined as a hard rocker and hevy metal musician, performing since age 10 in 1958.

Nugent has been a great influence on others in the hard rock and heavy metal music business, and has become well known for his conservative views on politics and public affairs over his long career.

Nugent is certainly entitled to have his views and to express them, but as with any public figure, and really any person, there is such a thing as going too far, if one threatens anyone, and particularly a public figure, and most significantly the President of the United States, whoever he happens to be.

In other words, there is the concept of “clear and present danger’, which allows government to prosecute anyone who threatens the breakdown of law and order, the promotion of bloodshed and violence and anarchy by one’s use of language.

Ted Nugent has reached that level of objectionable and dangerous language, and is being investigated, appropriately, by the Secret Service.

What did Nugent say?

At the National Rifle Association conference this past weekend in St. Louis, Missouri, Nugent said that if Barack Obama is reelected, he (Nugent) will either be dead or in prison. He spoke to a group of mostly young men, riling them up, by talking about decapitating Barack Obama and calling him a piece of excrement. He also bitterly criticized Hillary Clinton, Joe Biden, and Attorney General Eric Holder, and used threatening language against them.

One could sense that Nugent was provoking these gun enthusiasts with feverish language against the Commander in Chief, and could certainly have the effect of making some young man, similar to John Hinckley, Arthur Bremer, or Lee Harvey Oswald, be motivated by the comments of this famous rock star to attempt to bring harm against President Obama, or actually assassinate him, which would be a horrible tragedy beyond belief.

Mitt Romney has been endorsed by Ted Nugent, but he needs to make a clear statement of condemnation of Nugent, and repudiate his endorsement, as who would seriously wish to have the backing of an unstable public figure who, despite his right to criticize, shows a total lack of respect for the office of President, if not the individual in that office.

But don’t bet on Romney taking a principled stand, as he has failed to do that constantly during his political career.

The Destruction Of Civil Liberties: Anyone Arrested For Any Charge Can Be Strip Searched Multiple Times, By Declaration Of The Right Wing Majority Of Supreme Court!

An extremely shocking, disastrous decision of the US Supreme Court today will bring the power of the legal system down heavy on ANYONE arrested and detained, no matter how minor the infraction, including traffic violations!

By a straight 5-4 conservative majority of the Supreme Court, a person arrested for failure to pay traffic fines, which he had actually paid, led to six days of detainment in a local jail, and constant, repetitive strip searches that left the person involved feeling a loss of his masculinity, self esteem and self image.

This is not for serious criminals who are accused of murder and rape and robbery alone; it is for ANY charge, no matter how minor, and not only for convicted criminals, but any suspect on any accusation that leads to arrest and detention.

The local police gain unusual powers and control, and what makes it any different than a dictatorship, one may ask?

It is one thing if someone is thought to have contraband on his person, but for everyone for any minor offense or accusation? This is absolutely CRAZY, but nothing can be done about it, and all of us will face the fear that if by chance we are ever detained for ANY reason, we will lose our sense of dignity and self worth!

And realize this includes not only men, but women and CHILDREN as well!

This is insanity, and shows the dangers when the “wrong” President is in office!

This is the result, long term, of the Bush V. Gore case, where the Supreme Court, on a purely partisan basis, gave George W. Bush the Presidency over Al Gore, which led to Chief Justice John Roberts and Associate Justice Samuel Alito in 2005 and 2006!

These two men are proving to be hard line conservatives, and now we must wonder if Roberts, who supposedly worries about the image of the Court, will do what is right on the Obama Health Care legislation in June, and prevent a purely partisan decision by 5-4.

But it also makes one wonder about Associate Justice Anthony Kennedy, a Reagan appointee, who sometimes goes against the conservative majority on the Court, and who could have prevented this nightmare decision today, but chose not to do so.

Will he stay with the conservative majority again on the Obama Health Care law? This is crucial, since if he joins the four liberals on the Court, it is seen as likely that Roberts would join that side, but if Kennedy stays with the conservatives, Roberts assuredly will stay with them as well.

These are the consequences of electing a President, and makes the re-election of Barack Obama even more urgent, as otherwise, the Court will become no better than a Fascist Court in spirit, if not in name!

This decision of the Court will damage the reputation of that body, and it is something all of us who care about civil liberties will mourn for a long time!

Just be very careful NEVER to face arrest, as if we can control that!

Grim, Tragic Anniversary: 70 Years Since Executive Order 9066 Forcing Japanese American Internment Camps

Today is a grim, sad anniversary, 70 years since President Franklin D. Roosevelt signed Executive Order 9066, forcing the internment of about 110,000 Japanese American men, women and children, two and a half months after Japan attacked Pearl Harbor, bringing America into World War II.

This denial of the Bill Of Rights, one of the worst violations of civil liberties in US history, was imposed out of hysteria and panic after the Pearl Harbor attack, and very few people or groups denounced it, and it was later upheld as a necessary war action by a wartime US Supreme Court decision.

It is shocking in itself, but even more so when one considers the fact that first Lady Eleanor Roosevelt, highly disturbed by the decision of her husband, complained to him, and was angrily told never to bring up the issue again.

This shows how the Presidency can give one, even as outstanding in other ways as Franklin D. Roosevelt, a sense of cockiness and arrogance, that he can lose a sense of what is right and wrong, and what is necessary.

This is one of the most despicable acts of FDR in office, and compensation for the surviving victims came only in 1988, when President Ronald Reagan signed into law an apology, and compensation of $20,000 per survivor.

Meanwhile, the Japanese Americans who served in segregated units in World War II were heroes, who accomplished more than any other military units of that war, and were finally given recognition by the US Mint in 2011 with a special medal commissioned for public sale to commemorate their heroism.
