Supreme Court Once Again Stands Up To Presidential Assertion Of Executive Privilege, And Limits It!

The Supreme Court of the United States for the third time in 48 years has stood up to a President who asserted “Executive Privilege”, and was smacked down by a court including members appointed by the President who was involved in the Court case.

First, we had US V Nixon in July 1974, having to do with Richard Nixon and the Watergate tapes, which the Court unanimously, 8-0, ordered them handed over to the Watergate Special Prosecutor and the House Judiciary Committee. This led within weeks to the resignation of Richard Nixon. Associate Justice William Rehnquist recused himself from the case, appropriately, as he had worked earlier in the Nixon Justice Department, but the other three Nixon appointees, Chief Justice Warren Burger, and Associate Justices Harry Blackmun and Lewis Powell, joined the unanimous decision.

Next, we had Clinton V Jones, 1997, which involved the issue of whether Bill Clinton could be required to testify in a civil trial while in office, a case brought by Paula Jones against Governor Clinton for sexual harrassment. The Court unanimously, 9-0, including his two appointees, Ruth Bader Ginsburg and Stephen Breyer, ruled that he had to give testimony, and this helped to lead to his impeachment in 1998. So there was no immunity from civil law litigation for acts done before taking office, and unrelated to the office.

And now, we have Trump V Thompson, a lawsuit brought by Donald Trump against the January 6 House Committee investigation of the January 6, 2021 Insurrection, in the name of Chairman Bennie Thompson. So documents to show the series of events leading to the Insurrection are now to be made available to the House committee, as it investigates the wrong doing of the 45th President. This is a major victory, and all three Trump Supreme Court nominees—Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett—voted with the majority 8-1, with only Clarence Thomas in oppostion.

This is a conflict of interest by Thomas, who should have recused himself, as William Rehnquist did in the Nixon case. Since Thomas’s wife was involved in the planning of the January 6 Insurrection, encouraging lawlessness, this should be grounds for removal of Clarence Thomas from the Supreme Court, highly unlikely, but would be appropriate!

One Term Presidencies That Mattered: Jimmy Carter, George HW Bush!

President Joe Biden stated at his end of first year press conference yesterday, that he planned to run for a second term in 2024, and that Kamala Harris would again be his running mate.

That is to be expected at this time, but by early 2023, Biden will need to make a final decision on running, so as to open the race to alternative choices if he announces he will retire.

The concept that a President must seek reelection was not the case with three Presidents, who decided not to run–James K. Polk in 1848, James Buchanan in 1860, and Rutherford Hayes in 1880. But Polk, despite not running for another term, is considered to have accomplished his goals, and as it turns out, his health was not good, and he died 105 days after leaving office in 1849.

Buchanan and Hayes are not considered to have had successful terms, and they may have sensed that they could not win reelection.

Other one term Presidents, such as Benjamin Harrison and Herbert Hoover, had horrible depressions to deal with, helping to cause their defeats in 1892 and 1932, and William Howard Taft had a split in his party with former President Theodore Roosevelt, which doomed his campaign for reelection in 1912.

Gerald Ford was a special situation, having not been elected, succeeding Richard Nixon, and having a bad economy, which doomed his desire for election to a full term in 1976, although he is considered in a kind manner at this point, having worked to unite America after the Watergate Scandal and resignation of Nixon.

But the two most recent Presidents defeated for reelection, before Donald Trump, had real accomplishments in office, although they were unable to win a second term, Jimmy Carter in 1980, and George H. W. Bush in 1992.

Clearly, all Presidents since Rutherford Hayes in 1880, who have survived a term, have attempted to be reelected, but since Biden will be 82 years old weeks after the Presidential Election of 2024, he might decide not to run, or his health might be such that he is told he should not run.

First Year In Oval Office Under Most Presidencies Problematical, And Joe Biden Better Than Many!

One could argue that Joe Biden has accomplished a great deal in the first year, while often having disappointments and shortcomings.

Two major pieces of legislation were accomplished (The American Rescue Plan, and the Physical Infrastructure legislation), and the only reason why the Build Back Better bill and voting rights have failed to be accomplished is the opposition of two Democrats–Joe Manchin and Kyrsten Sinema–and the reality of an equally divided Senate for only the third time in American history!

While inflation has become a major problem, the stock market dramatically rose, more jobs were created in the first year of a Presidency than any other administration, and the unemployment rate has dropped to a very low rate.

There are still the issues of the COVID 19 Pandemic, and the disaster of Afghanistan withdrawal, but the first issue was unpredictable as the worst health crisis in a century, and the second would have been the same result had Donald Trump stayed on as President, since he had made a deal with the Taliban without Afghanistan government involvement, to leave in May 2021, NOT as occurred in August 2021!

So some disappointing developments in the first year of a Presidency are not unique to the 46th President!

When one looks back at other Presidencies, it is actually quite common that the first year of a Presidency is a learning curve, and does not reflect on whether such Presidents will be, in the long run, successful, and also have the possibility of successful reelection.

The following Presidents had very successful first years—Theodore Roosevelt, Woodrow Wilson, Franklin D. Roosevelt, Lyndon B. Johnson, George H. W. Bush!

Three Presidents had what could be described as mixed records in the first year in office–Dwight D. Eisenhower, George W. Bush, and Barack Obama.

The following Presidencies in the 20th and 21st century were far from successes in their first year:

Gerald Ford 1974-1975
Jimmy Carter 1977
Ronald Reagan 1981
Bill Clinton 1993
Donald Trump 2017

Among these eight Presidents, four—Truman, Nixon, Reagan, Clinton–won reelection.

So it is not time to say that Joe Biden will fail to succeed, as he already has in many respects, and it is not time to say he cannot win reelection fo a second term!

Jimmy Carter Closing In On 15,000 Days In Retirement From Presidency On Valentine’s Day!

Former President Jimmy Carter (1977-1981) keeps adding to his record as the longest lived American President, being now 97 years, 3 months, and 17 days, at this writing!

His wife, Rosalynn Carter, is 94, and 5 months, as this writing, and the couple are married more than 75 years!

On January 20, Carter will have been out of the Presidency for 41 years, nearly ten years more than Herbert Hoover!

And hard to believe, Carter will be closing in on 15,000 days in retirement from the Presidency on Valentine’s Day, February 14!

Carter is amazing, and the longer he lives, the more his stature rises, as he is certainly considered the greatest retired President, in the sense of his contributions to American society and the world community, through his commitments to the Carter Center in Atlanta.

Carter is such a good, decent human being, and he will always stand out for his major accomplishments, including the Camp David Accords between Israel and Egypt; the Panama Canal Treaty; diplomatic relations with China; the promotion of human rights in foreign policy; his presiding over three Cabinet agencies being created (Education, Health and Human Services, Energy); his promotion of diversity in his appointments to all kinds of posts; and his exceptional environmental record, the greatest of any one term President, and considered the third best by Environmental historians, after Theodore Roosevelt and Richard Nixon!

Concept Of Political Coalition Against Donald Trump: Does History Tell Us It Could Work In America?

Thomas Friedman, esteemed columnist for the NEW YORK TIMES, suggested in a recent column that the concept of a political coalition against Donald Trump might be the way to prevent him from coming back to power in the Presidential Election of 2024.

So Friedman suggests the following possible coalition tickets of a Democrat and an anti Trump Republican:

Joe Biden–Liz Cheney

Joe Biden–Lisa Murkowski

Kamala Harris–Mitt Romney

Stacy Abrams–Liz Cheney

Any Klobuchar–Liz Cheney

Friedman makes the comparison to the present coalition government in Israel, but Israel has a Prime Minister and a parliamentary system, which is totally different than our Presidential-Congress system of separation of powers.

And if one looks at past past attempts to have a Vice President who is not part of the majority party at the time, just look at John Tyler, not a Whig, under William Henry Harrison, who then had horrible time and constant turmoil after Harrison died after one month in office in 1841.

Or even better, Andrew Johnson, NOT a Republican, running with Abraham Linoln in 1864, and succeeding him after six weeks, and the horrible relationship and disaster of Johnson as President, facing impeachment and constant vitriol, much of it incited by his own prickly personality.

There was talk in 1968, of Hubert Humphrey selecting Nelson Rockefeller; of 2004, of John Kerry selecting John McCain; of 2008, of John McCain selecting Joe Lieberman. None of those would ever have been able to work out, and elect Humphrey, Kerry, or McCain.

Also, in the run up to 2020, some thought of a John Kasich-John Hickenlooper unity ticket, as an alternative to Donald Trump, and it never got off the ground!

And really, Liz Cheney, with strong right wing views on every topic except the danger of Donald Trump, paring with Biden? That is NOT serious, and Stacy Abrams or Amy Klobuchar paring with Cheney, so two women on the ticket, really?

And Mitt Romney running with Harris, really, with his strong criticism of Biden policies, and unwillingness to even back voting rights legislation?

The only one of these pairings that sounds at all logical, but really is not so, is Biden with Lisa Murkowski, the most acceptable Republican in national office, but how would Biden convince Harris why he has to “dump” her as Vice President?

Senator Lindsey Graham: A Toady To Donald Trump, Who John McCain Would Condemn And More!

South Carolina Senator Lindsey Graham has long been controversial in so many ways, but when his good friend, former Arizona Senator John McCain, passed away in 2018, the world witnessed a man who had totally lost all credibility, after being a massive critic of Donald Trump.

It is embarrassing to see the denuncations of Graham regarding Trump, followed by total obsequiousness to Trump since McCain’s death.

Even when Trump continued to denounce John McCain in the years since his death, Graham had nothing to say.

It is clear to any intelligent person that if McCain was still alive and in the Senate, he would have, at least symbolically, been motivated to slap Graham front and back and in the head, for his traitorous behavior!

And now, Graham says unless Senate Republican leader Mitch McConnell of Kentucky makes obedience to Trump a priority, that Graham will vote against McConnell remaining as the leader of the party, whether minority or majority status!

As much as McConnell has been a disgrace and a disaster as Republican leader, he still has enough self dignity that he will not be likely to bend to Donald Trump.

And if push comes to shove, at this time, it would seem that the Republican caucus would NOT join Graham in replacing McConnell as their Senate leader!

Republican National Committee Threatening To Refuse To Participate In Presidential Debates In 2024!

The Republican National Committee is threatening to refuse to participate in Presidential debates in 2024, as they complain that the nonpartisan Commission on Presidential Debates is one sided and favors Democrats, and that the moderators selected are biased.

Ronna McDaniel, who happens to be a niece of Senator Mitt Romney, is making these threats, which even her uncle thinks is outrageous!

It is clear the Republican party does not want to expose itself to any criticism of Donald Trump, or whatever lackey of Trump ends up as the GOP Presidential nominee.

This is another step in the Republican Party moving toward Fascist authoritarianism, as they seem to feel why should people be able to vote, therefore promoting voter suppression laws in Republican controlled states, and now the refusal to face the challenge of their opponents.

There should be a way to prevent such a threat, as it undermines American democracy, the Constitution, and the rule of law!

Kevin McCarthy: A Traitor To Truth And Country, And Lackey To Donald Trump, Needs To Be Prosecuted!

House Minority Leader Kevin McCarthy is a traitor to the truth and country, and a lackey to Donald Trump, and needs to be prosecuted!

McCarthy desperately wants to become Speaker of the House, more important than the truth about Donald Trump that he uttered on January 13, 2021, one week after the January 6, 2021 Insurrection.

McCarthy screamed and cursed at Trump on the day of the US Capitol Insurrection, and held Trump accountable for the events, and said Antifa had absolutely no involvement in the events, which even now a year later, the Republican insurrectionists in Congress keep on claiming, and right wing news channels continue to pontificate, led by Laura Ingraham, Tucker Carlson, Sean Hannity, and other right wing propagandists.

But they, themselves, were trying to reach Trump through Mark Meadows to tell him to call off the violence and bloodshed, and are also liars!

McCarthy gave up his promotion of the truth on January 28, 2021, when he went to Mar a Lago to meet with Trump, and now refuses to testify before the January 6 House Committee investigating the events of January 6, and this after in May 2021, saying he would testify if called to explain the events of the day, which he well knows what happened, but now lies about it.

McCarthy should be expelled from Congress, under the 14th Amendment, Section 3, and prosecuted for the damage he has done by lying for Donald Trump, after first doing the right thing by denouncing him!

His name in history will be one of a traitor and seditionist, who cares more about his own advancement, than preserving American democracy, the Constitution, and the rule of law!

Sad 44th Anniversary Of The Passing Of Hubert Humphrey, My Original Political Hero!

On this day, January 13, 1978, 44 years ago, my original political hero, Senator, Vice President, and Presidential nominee Hubert H. Humphrey passed away from cancer at the young age of 66.

When I was young, Humphrey became my political hero, with his strong liberal championship of views on civil rights, and introducing many ideas that became part of Lyndon B. Johnson’s Great Society in the mid 1960s.

Not well utliized by Johnson, Humphrey became the nominee of the Democratic Party for the Presidency in 1968, a divided party that had elements rallying around Senator Robert F. Kennedy before his tragic assassination, and also those who backed fellow Minnesota Senator Eugene McCarthy.

In a three way Presidential race, Humphrey would fall short, losing to Richard Nixon, and with George Wallace being a strong third party candidate.

Humphrey, who had been Mayor of Minneapolis, and then a US Senator from 1949-1965, returned to the Senate in 1971, replacing the retiring Senator McCarthy, and competed unsuccessfully for the Presidential nomination in 1972, and remained a major figure until his untimely death in 1978.

This author and blogger literally wept when Humphrey died, as I was drawn to his humanity, empathy, decency, and compassion.

And once he passed away, I looked around the US Senate for a successor leader I could believe in, and found the young Delaware Senator Joe Biden, still in his first term at age 35.

I feel fortunate that although there were many barriers to Joe Biden’s advancement to the Presidency, that after serving in the Senate for 36 years, and as Vice President under Barack Obama for eight years, that four years later, on his third try for the Oval Office, Biden finally won, and saved the nation from the menace of Donald Trump.

Neither Humphrey nor Biden were or are perfect, no such situation exists, but the two men shared characteristics that caused me to fall in love with them as political leaders.

I am sure that Humphrey would be very proud of Joe Biden, and the two men stand out as uncommonly models of leadership!

Republican Party Scammers Of Gullible Voters: From Trump To Republican Members Of Congress!

The Republican Party has become a group of scammers, taking advantage of gullible voters, who are asked to give their hard earned money to wealthy politicians, who tell them lies and mistruths.

The leading scammer, of course, is former President Donald Trump, who has gained hundreds of millions of dollars from those who have come to believe the “Big Lie”, that Trump won the election.

But also, Republican senators including Rand Paul and Ted Cruz and others, and Republicans in the House of Representatives, including Marjorie Taylor Greene, Lauren Boebert, Madison Cawthorn, Matt Gaetz, and others, and really all of the traitors–seditionists of January 6 are taking advantage of people who believe anything they say!

There should be prosecution of all these scammers, and prison time, and banning of such scammers from serving in Congress in the future!

And Donald Trump should face incarceration!
