75th Anniversary Of Supreme Court “Packing” Plan Of FDR: Its Significance Today

Seventy five years ago on this day, President Franklin D. Roosevelt introduced his plan to reorganize the Supreme Court, becoming known as an attempt to “pack” the Court, which became a turning point in many ways, including the fact that it was repudiated by the Senate in July 1937; weakened the power and clout of FDR shortly after his landslide victory in 1936; and led rapidly to a transformation of the Court, and FDR replacing, over the next five years, all but two members of the Court he was challenging.

The Supreme Court had stood in the way of change and progress during the Great Depression, declaring many New Deal laws unconstitutional, and FDR brought the Justices under attack as a result. Bitterly criticized as acting dictatorial, FDR was put on the defensive, but the long range was the Court adapting to an expansive view of the Constitution within a short time, and leading to a Court which dealt with the expansion of federal power and greater support of civil liberties and civil rights.

Today, three quarters of a century later, the Republican dominated Supreme Court has opened up the gates of campaign spending abuse in election campaigns, by its Citizens United decision of 2010. Additionally, crucial cases, including the Obama Health Care Plan, are to be decided by June, which will determine the fate of much of what Barack Obama has done and wishes to do as part of his agenda as President. Obama already made clear his criticism of the direction of the Court two years ago, with the Justices sitting there at the State of the Union Address. And three of the nine Justices–Antonin Scalia, Clarence Thomas, and Samuel Alito–have boycotted the past two State of the Union Addresses, and represent the major challenge to the Obama Presidency, more than any other members of the Court.

No one is saying or predicting that Obama will attempt such a bold act as FDR did, and were he to do so, it would certainly cause the biggest controversy and split possible to imagine, greater than any issue so far in his administration.

But the Supreme Court IS an issue in the upcoming Presidential campaign, as the likelihood of replacements on the Court in the next term are very likely. This is particularly the case with Ruth Bader Ginsberg, who has had bouts with cancer, and would pass 80 years of age at the beginning of the next term. Her liberal vote would be lost if the Republicans win the White House and she leaves the Court. Additionally, based on aging, it is possible to imagine that Anthony Kennedy, Antonin Scalia, and Stephen Breyer could leave the Court before 2017.

So who is elected President, and who controls the majority of the US Senate, which would need to confirm a Court appointment, is very significant, although not much attention is being paid to this issue because of the troubles with the economy.

Barack Obama’s State Of The Union Address: Powerful, Inspirational, Visionary!

President Barack Obama reminded us tonight of how he inspired us when he ran for President in 2008.

His speech was powerful, inspirational, and visionary, and he made it clear that he was willing to fight for what he believed in, if the Congress continued to stand in the way of progress and change. He would take action in areas where there is stalemate, by use of his Presidential powers.

He pointed out how the economy is improving; how we are more respected around the world; how we have greatly lessened the danger of terrorism; and the work that must be done, regarding education, infrastructure spending, and other initiatives to continue the expansion of the American economy.

He gave tribute to Americans who have sacrificed for our country, particularly in the military, and called for “fairness” when it comes to tax rates and to share in the responsibilities of being American citizens. And he called for opportunities for young immigrant children who only want the chance to prove their commitment to the only country they remember, by getting a university education or serving in the military,and thereby gaining the chance for citizenship.

He called for a sense of renewed commitment, and a shared one, in the future of our nation, which he said can never be regarded as having passed its peak, but still has greatness in its future if we all do our part in advancing America.

The speech made one proud that Barack Obama has been our President for the past three years, and it marks the inception, more formally than before, of the Presidential Election campaign of 2012!

Samantha Garvey: A Model For Our Nation Of Overcoming Adversity!

Samantha Garvey is a senior in high school in New York, whose family has suffered hard times due to her mother being injured and unable to work, and her father unable to pay the bills and losing their home, resulting in the family living in a homeless shelter.

Samantha is a semifinalist in an Intel Science Talent Search competition, and her story of accomplishment in the midst of tragedy and turmoil is so inspiring that she has been invited as the guest of President Barack Obama for his State of the Union address next week. She has applied for admission to Yale and Brown Universities.

This is a bright moment in the midst of tremendous economic tragedy, not just for her family, but for millions suffering from the collapse of the economy under George W. Bush, and the slow recovery occurring under Barack Obama.

Gun Rights Gone Mad: Are There Any Limits? :(

Just three weeks after the tragic shootings in Tucson, Arizona, the gun rights movement is in full swing, reacting to the tragedy by trying to promote gun rights EVERYWHERE without limit! πŸ™

Even former Vice President Dick Cheney has expressed the need for some gun control, after never believing in it in the past, and President Obama has stated he will address the issue, after totally ignoring it in his State of the Union address earlier this week.

But meanwhile, many state legislatures are going off the deep end to prevent any restrictions and promote gun rights in every possible location! πŸ™

In Florida, a legislator is suggesting that medical doctors should be punished with felony charges just simply by asking a patient about their ownership or use of guns! The punishment for a doctor would be prison time or up to $5 million in fines–absolutely insane! πŸ™

In Michigan, a legislator wants someone, anyone, to be able to carry weapons on their person EVERYWHERE–including day care centers, stadiums, schools, churches, bars and hospitals! This is advocated despite the fact of gun incidents reported in hospitals, bars, churches and schools already around the country, but now even where large crowds and young children are found is being promoted–absolutely loony! πŸ™

In Minnesota, a bill is being pushed which would no longer allow police to conduct background checks on people who apply for gun permits–again, absolutely nutty! πŸ™

Wyoming is considering legislation which would allow it to join three other states–Alaska, Arizona, and Vermont–which do not require a state permit for a concealed weapon–extremely scary! πŸ™

Finally, Nebraska has a bill pending to allow school employees to carry guns for protection, and Indiana has legislation being considered to allow employees of any company in the state to carry guns in their cars in the parking lots of the places of employment “in order to defend their lives”–both proposed laws which indicate an element of paranoia in the sponsors! πŸ™

Anyone who thinks that such legislation as above will stem gun violence, and cut down the number of deaths and injuries, is living in a dream world of illusion and fantasy! πŸ™

Sarah Palin And Michele Bachmann: The Advancement Of Ignorance, Stupidity And The Destruction Of The Republican Party! :(

The Republican Party has a major problem that will destroy all chances of its success in the future, and will be a “gift that keeps on giving” to the opposition Democratic Party: former Alaska Governor Sarah Palin and Minnesota Congresswoman Michele Bachmann, both potential candidates for the Presidential nomination in 2012!

Both ladies, admittedly attractive in appearance, are a true nightmare for the party, and both are a major blow to the promotion of women in politics!

They are a true embarrassment to womanhood itself, as they personify total ignorance and stupidity, not only about science but also about history, and really, it seems, about ANY area of human knowledge!

It is not an issue of conservatism being attacked, as indeed the concept of women as conservatives can be legitimate. It is simply the reality that every time either of these women open up their mouth and speak, they make the eyes roll into the back of the head of any intelligent person who observes and listens.

Does either lady have the ability to EVER express anything that makes sense or shows knowledge, or is seen as rational, sane thinking? Apparently, the answer is NO! πŸ™

Michele Bachmann had just asserted that the Founding Fathers ended slavery, failing to realize that the Civil War 75 years later ended slavery. She had just come from a lecture about the Constitution from Associate Justice Antonin Scalia, who had “lectured” a group of Tea Party members of Congress about that sacred document, which he has totally distorted with his ridiculous “originalist” interpretation, including supposedly, his recent statement that the Constitution did not protect women, because they are not mentioned in the Constitution! That statement by Scalia also makes one roll his eyes to the back of the head! Can Scalia really believe that, and if so, why is he on the Supreme Court?

But, for now, getting away from the loss of status and prestige of the Supreme Court by the behavior of some of its members, a subject that will be addressed again in the near future, before we can recover from Michele Bachmann and her inane, ludicrous statements for the “umpteenth time”, before we can fully calm down, along comes Sarah Palin, again attempting to “hog” the spotlight with her moronic statements and tweets! πŸ™

In reaction to President Obama’s State of the Union address, Palin reacted to the “winning the future” line of the President, by employing WTF as an obscene statement that everyone knows what it is, but which I will not explain here! LOL

Is that appropriate for a potential Presidential candidate to use in political discourse out loud with the media? Is this dignified and acceptable for someone who wants to be taken seriously as a legitimate voice? Is there a need to answer this? πŸ™

Adding insult to injury, Palin proceeded to state that the “Sputnik” reference of Obama was not appropriately used, as the Soviet Union of old had “won” the space race, but that it had led to their downfall!

Such an assertion makes one want to gag and throw up! Oh really, the Russians won the space race? It was the Soviets who landed on the moon in 1969? And their being involved in competition in space is what caused their downfall, rather than their involvement in Afghanistan, and their reckless military spending, a policy that is the major cause of our national debt and deficit today, and which Palin fails to see and understand?

The responsible leaders of the Republican party have to be dismayed by these two women, both endorsed by the Tea Party Movement, who are separately and together destroying the credibility of the Republican Party for the long haul!

One would wish, somehow, that we could put a muzzle on their mouths, and send them the message, shut up and be gone! πŸ™

But, of course, there is freedom of speech, and neither lady will shut up, and so the Democratic Party sits by observing events, having a lot of good laughs, and enjoying “the gift that keeps on giving!”

But we must also mourn the destruction of both science and history that these women, and those who believe in them, represent, and in fact the destruction of KNOWLEDGE!

As Bill Maher, the comedian, expressed a few weeks ago, if the Founding Fathers were to come back today and witness the mediocrity of today’s Republican leadership, and the role of these two women, and a few members of the Supreme Court, they would be stunned, and certainly comment that women should never have been given the right to vote, let alone to run for public office!

And that would be indeed sad, as many women have contributed a great deal to our political discourse, and they stand by and mourn the embarrassment to their gender represented by the two morons, Bachmann and Palin! πŸ™

A Time Of True Leadership Versus Demagoguery! Obama Versus Ryan And Bachmann!

President Obama last night delivered one of his greatest speeches as he gave us the State of the Union, not easy for a man known for great oratory.

He appealed to our better nature, speaking up for the DREAM Act, for commitment to modernization of technology, commitment to education, research and development, and to bipartisanship as we face the challenges of dealing with the deficit and national debt.

The only disappointments in the author’s view were his failure to face the reality of the Afghanistan War, and his decision not to use the Tucson tragedy to call for new regulations on assault weapons, magazines, and the need to have new controls on who is able to buy weapons legally.

Meanwhile, the GOP response was, predictably, disappointing. Congressman Paul Ryan of Wisconsin, chair of the Budget Committee, came across as an appealing person who really introduced himself for the first time to a national audience, and accomplished the goal of making us realize that not all Republicans are loony and lacking in credibility!

But his ten minute response to the State of the Union Address was broad and vague, and he hid from us the horrific details of his plan to cut taxes for the wealthy and, despite what he claimed, destroy the safety net of the New Deal and the Great Society. What he believes in is seen as radical by most observers, and an attempt to negate 75 years of social and economic reform, and therefore, totally unacceptable, and really dead on arrival in practical terms!

Meanwhile, Michele Bachmann, Congresswoman from Minnesota, could only write her own version of history, a warped view, to say the least, although in her five minute Tea Party Movement sponsored address, she avoided the outrageous historical fantasies that she had enunciated earlier in the day. This was probably a reaction to the bitter attacks and condemnations of observers to her ridiculous and ignorant assertions about slavery in American history a few hours earlier. But she did her cause and that of the Tea Party no favors, because she is a horrible representative for her party and the movement, and the thought of her likely being on the campaign trail for the Presidency is enough to engender a massive headache! πŸ™

Total Ignorance About American History: Michele Bachmann, Pat Buchanan And Other Republicans! :(

Minnesota Congresswoman Michele Bachmann is demonstrating her total ignorance of American history and the history of her Republican party, based on the text of her speech to be delivered tonight after President Obama’s State of the Union Address!

She says slavery was ended by the Founding Fathers, showing she is unaware of the role of her Republican Party, Abraham Lincoln, and the Civil War in ending slavery. She is, as always, demonstrating her total lack of knowledge of the American past and the American Constitution, joining many other Republicans, including Sarah Palin, in this regard! πŸ™

But now, Pat Buchanan, former challenger for the Presidency against George HW Bush in 1992, and running for President as a third party party candidate in 2000, has also demonstrated his lack of knowledge, by asserting there were more slaves in the Union states that had slaves (Maryland, Delaware, Kentucky, Missouri) than in any of the Confederate States that broke away from the Union! He also said incorrectly that George Washington freed his slaves after his wife died, but the reality is that his wife outlived him by over two years! πŸ™

The ignorance and lack of knowledge of these and other Republican leaders is shocking and reprehensible! πŸ™

The Founding Fathers (Washington, Adams, Jefferson, Madison, Hamilton, Franklin) and the statesmen of the pre Civil War era (Daniel Webster, Henry Clay, Stephen Douglas, William Seward, Charles Sumner, Abraham Lincoln) would be shocked and mortified if they came back today and witnessed the TOTAL STUPIDITY AND IGNORANCE of many GOP leaders, and Republicans of the Lincoln, Theodore Roosevelt, and Dwight D. Eisenhower era would also be ashamed of what their party has become: a party without legitimacy, ethics, character, and morality! πŸ™

Barack Obama’s “Sputnik Moment”: Promote Technology, Research And Development, And Education!

Word has leaked out that President Obama will call, in the State of the Union Address, for the nation to meet its present “Sputnik moment”, a reference to the challenge that the Soviet Union presented when it went into space ahead of the United States a half century ago.

That shocking moment motivated the nation to move ahead, and Obama will promote the idea of investment in technology, research and development, and education as essential for the nation’s future.

Already, the GOP has made clear it wants no such agenda, as it means increased government spending, but without any such investment, including in infrastructure of the nation, there is no way to create enough jobs or economic growth to recover from the Great Recession we have suffered in the past three years!

There can be no compromise with lunatics, and that is how the GOP is coming across with its impossible and reckless attempts to gut the federal budget! πŸ™

It is reassuring to see that Obama has a vision of the future, and he and his party must fight “tooth and nail” for the principles and programs they believe in!

The Republicans And The State Of The Union: Not The Time For Obama To Cave In To GOP Threats! :(

The Republicans have declared war on the federal budget, and the House membership of the party today unanimously backed a resolution giving Wisconsin Congressman Paul Ryan, the Chairman of the Budget Committee, total control over the House budget bill for the remainder of the fiscal year 2010-2011.

This is fascinating for a party that is against centralized power and for states rights, that now they are willing to hand over total control to one Congressman over the federal budget. This makes Ryan a “Czar”, a title that Republicans are very willing to assign to advisers to President Obama who deal with different issues, but suddenly it is alright to have a financial “Czar”! πŸ™

But Ryan, who will give the GOP response to President Obama’s State of the Union Address tonight, has already made clear that he wants to privatize Social Security, gut Medicare and Medicaid, and dramatically lower taxes on the wealthy, even more than they have already by deals between President Obama and the GOP leadership last month.

And the Republican Study Group, a group of Congressional Republicans even MORE conservative than Speaker of the House John Boehner, House Majority Leader Eric Cantor, and Paul Ryan, wants more draconian cuts in the federal budget immediately and long term, including gutting Amtrak, PBS, NPR, the National Endowment for the Humanities, the National Endowment for the Arts, and funding for research on many diseases, including cancer, AIDS, and heart disease. And also the goal is the wiping out of the Department of Commerce, the Department of Housing and Urban Development, the Department of Education, and the Department of Energy! πŸ™

And to add insult to injury, Michele Bachmann of Minnesota, the Tea Party favorite, will give her own response to the President’s State of the Union address, after Congressman Paul Ryan gives the official response!

And Eric Cantor, House Majority Leader, has made it clear that the Congress will NOT give any aid to any state or city to avoid layoffs of police, firefighters, teachers, and other public servants, therefore guaranteeing massive losses of jobs, and adding to the unemployment rate!

Rather than working to create jobs, the GOP is warring on the job market as it is, and has only destructive intentions as part of a war, not only on Barack Obama’s health care plan and other reforms, but also with the express purpose of destroying the Great Society of Lyndon B. Johnson and the New Deal of Franklin D. Roosevelt! πŸ™

Senate Minority Leader Mitch McConnell of Kentucky said today that if President Obama offers a message that includes all of what the GOP wants, they will be glad to support him!

What gall and nerve, without any indication that the Republicans in Congress are willing to make any concessions, but just expect Obama to cave in ! πŸ™

The answer is that the President needs to make clear that he is willing to work and negotiate with the opposition party, but will not surrender the right to disagree and use his Presidential powers to protect government programs and the historic accomplishments of Roosevelt, Johnson and even Richard Nixon!

The President and the Democratic Party and progressives and liberals everywhere MUST understand that this is a battle for the heart and soul of the American nation, and they cannot cave in to the destructive tendencies of the Republican party, and must stand and fight to the bitter end, and stop worrying about those who say they are unwilling to negotiate and compromise, and tell them to look in the mirror at themselves! πŸ™

Senator Arlen Specter’s Farewell Speech: Condemnation Of Chief Justice John Roberts And Associate Justice Samuel Alito On Judicial Activism, And Of Right Wing Republicans! :(

Senator Arlen Specter of Pennsylvania is retiring after a distinguished 30 year career, plus having served in local government, and on the staff of the Warren Commission investigating the assassination of President John F. Kennedy almost a half century ago.

Specter, often seen as a difficult man to work with, and possessing a large ego, lost his Senate nomination race to Joe Sestak after switching back to the Democratic Party that he had long ago been a member of, until he converted for a long time to the Republican Party.

Specter was head of the Senate Judiciary Committee during the hearings for the nominations of Chief Justice John Roberts and Associate Justice Samuel Alito, and today he denounced both Justices for violating their testimony during the hearings, which indicated they believed in precedent (stare decisis), but then proceeding to use judicial activism and violating the separation of powers doctrine, particularly in the Citizens United Case in January of this year, allowing unlimited spending by corporations after nearly a century of strict regulation by Congress of such actions.

So Specter joined the criticism of President Obama, enunciated by the President in his State of the Union Address, which annoyed both Roberts and Alito, with Roberts making a clearcut statement of dissent, amid hints that neither Justice might attend future State of the Union Addresses, which if actually done, would be highly inappropriate.

Specter also condemned right wing Republicans such as Jim DeMint of South Carolina, who worked against moderate Republicans in a number of states, causing the loss of seats for the party.

One thing about Specter–he does not worry what others think of him, and his leaving Congress will make it a less interesting and principled place for sure!
