Roe V. Wade Almost 40 Years Later Still Debated, But Five Of Seven Justices In Majority Were Appointed By Republican Presidents Eisenhower And Nixon!

In the midst of the heated debate about abortion rights, rape, Todd Akin, Mitt Romney, and the Republican Party platform which bans ALL abortions, whether rape, incest, or life of the mother, something very significant has been ignored!

The Roe V. Wade case of January 22, 1973 was decided by a 7-2 vote, with FIVE of the seven Justices in the majority being appointed by Republican Presidents Dwight D. Eisenhower and Richard Nixon!

That was an era when Republicans could be in the mainstream, supporting voting rights legislation by vast majorities in Congress, but now 40-50 years later, leading the charge to do everything possible to repeal the legislation, or deny many categories of voters their basic human right to vote.

That was, also, a time of mainstream Republican Justices supporting a woman’s right to privacy with her own body, exactly the opposite of what is happening 40 years later in the Republican Party!

The Republican appointments who supported Roe V. Wade in 1973 were:

William Brennan, appointed by Eisehower
Potter Stewart, appointed by Eisenhower
Chief Justice Warren Burger, appointed by Nixon
Harry Blackmun, author of the decision, appointed by Nixon
Lewis Powell, appointed by Nixon

Two Democratic appointments, William O. Douglas (appointed by Franklin D. Roosevelt), and Thurgood Marshall (appointed by Lyndon B. Johnson), joined the five Republicans, with only one Democratic appointment (Byron White, appointed by John F. Kennedy), and one Republican, (William Rehnquist, appointed by Nixon) being in the minority.

How far the Republican Party has wandered from the mainstream of American politics over the past 40-50 years, and the only answer is a sound defeat of the right wing, and bringing the GOP back to the mainstream, or else they will become part of the dustbin of history, being replaced by a centrist party that resembles the proud history of the earlier Republican Party, which understood that an alliance with religion is poisonous to tolerance and the mainstream of American politics!

The Democratic Party And Human Rights Asserted Again!

The Democratic Party is the party of most of the great social, political, and economic reforms of the 20th century, and going into the 21st century. A small number of Republican political leaders, whether governors, senators, or congressmen, joined the cause, and at times Presidents Dwight D. Eisenhower and Richard Nixon joined in, but the Democrats were still the vast majority of those who promoted reforms we think we can now take for granted, but which conservative and Tea Party Republicans today wish to reverse!

The Democratic Party outside the South had to struggle against the right wing conservatism of most of its Southern members, including governors, senators, and congressmen, but in 1948, led by Mayor Hubert Humphrey of Minneapolis, they came out for civil rights in the national convention platform.

The Democrats came out for women’s rights, including the right to control their own bodies, in the 1970s after Roe V. Wade.

And now the Platform Committee of the Democratic National Convention of 2012 is moving toward adoption of a plank in the platform, backing gay rights and gay marriage explicitly!

This is a great victory, and follows in the tradition of the Democratic Party, being the party of openness, tolerance, and human compassion!

Two Prestigious Scholars Blame The Republican Party For The Stalemate In The 112th Congress

Two well known scholars, Thomas Mann of the Brookings Institution and Norman J. Ornstein of the American Enterprise Institute, have recently published a book and authored articles criticizing the Republican Party for the stalemate in the 112th Congress.

The Republican Party is blamed for its refusal to hold members of their party in Congress accountable for their wild statements; is seen as totally against compromise; refuses to accept facts, evidence and science; lacks respect for the legitimacy of the opposition party and its members; and is so far outside the mainstream as to be alarming for any hope of accomplishment of any goals or programs!

The two people most responsible for this extremism are former Speaker of the House Newt Gingrich, and Grover Norquist of the Americans for Tax Reform. But also the filibuster has been abused in the Senate, and prevented many executive branch appointments from being confirmed, both in the government agencies and in the court system.

The reaction to Roe V. Wade after 1973 mobilized social conservatives, while the tax revolt in California in 1978 mobilized anti tax activists. Also, the South turned conservative Republican after the Civil Rights movement of the 1960s; and the rise of conservative talk radio, and the growing impact of Fox News on cable, also had a great impact on what has become a growing stalemate and gridlock.

Health care reform, climate change, economic recovery, deficits, and debt issues have become a chasm between the two major political parties. Polarization has become the norm, and is a dangerous trend which may continue, if the voters again send a confusing message of a divided Congress in the 2012 Congressional elections. The Tea Party movement, if it grows, will further create conflict at a time when we need negotiation and compromise!

This assessment is extremely worrisome, as it means that our national government may be totally paralyzed, when we need true statesmen in both parties dealing with our important national agenda!

The Tragedy Of The Republican Party: A Split Personality Outside The Mainstream!

Chris Matthews on MSNBC this evening summarized the tragedy of the Republican Party: that it has been “hijacked” by disparate groups that cause the party grief!

First, we have what Matthews calls the “Dixiecrats”, the Southern segregationists, who left the Democratic Party after the passage of the Civil Rights Act of 1964 under President Lyndon B. Johnson.

Then, due to the school prayer decision (Engle V Vitale) and abortion rights decision (Roe V Wade) of the Supreme Court, the “Moral Majority” or “Christian Coalition” or “Evangelical Right” went over to the Republican Party in the 1970s.

Finally, conservative “hawkish” Democrats, dissatisfied with the nomination of George McGovern in 1972 and President Jimmy Carter in 1976 also went over to the Republicans as the “neoconservatives”.

The result has been a “split personality” party which has marginalized itself more and more over the years, and moved away from the mainstream of America, as the Republican Party was until the mid 1970s.

Unless Jon Huntsman can, somehow, gain a surge and make a major fight for the GOP nomination, the Republican Party is going to remain outside the mainstream of America!

The Republican Attack On The Constitution: A Threat To American Democracy!

The Republican Party loves to assert that the Democrats, and progressives in particular, are attacking the Constitution, and that they are the experts on the Constitution.

So therefore, in this Presidential primary season, and in the party membership in Congress, there are statements constantly attacking the court system, anytime that a federal judge or court issues a decision against the conservative view of the Constitution. There are condemnations and calls to change the court system on a regular basis.

One would think that the Democrats and their progressive friends have dominated the courts in recent decades, which, of course, is the exact opposite of the truth!

One forgets that from 1969-2011, there have been only 15 years of Democratic control of the Presidency, as compared to 28 years of Republican control.

The vast majority of federal judges have been Republican appointments, as a result, and Republican Presidents have made a total of 13 Supreme Court appointments over those years, and Democrats have made only 4, two by Bill Clinton and two by Barack Obama!

But now,. Newt Gingrich calls for judges to be required to testify before partisan Congressional committees, a violation of the separation of powers, and a danger to an independent judiciary!

What it comes down to is that Newt Gingrich and all of the Republican opponents, with maybe the exception of Mitt Romney and Jon Huntsman, wish to create a court system that would move away from the path breaking changes that the Supreme Court brought about during the years of the Warren Court, Burger Court, and Rehnquist Court including:

Brown V. Board Of Education
Miranda V Arizona
Roe V Wade
University Of California V. Bakke
Lawrence V Texas

As it is, there are threats presented by the Republican growth of dominance on the federal courts to all of these issues–racial integration, rights of criminal suspects, abortion rights, affirmative action, and gay rights.

The Republicans will not be contented until there are reversals on all of these issues, and a return to the “good old days”, when minorities “knew their place”; police had unlimited rights over those they questioned or arrested; women had no control over their reproductive rights; minorities and women had disadvantages, as compared to white males, on educational and job opportunities; and gays were forced to remain “in the closet” and face open discrimination and hate without recourse!

So when the Republicans claim to understand what the Founding Fathers meant at the Constitutional Convention, they are forgetting that those esteemed leaders put into the Constitution the “Elastic Clause” to allow for expansion of the Constitution beyond the original document, in order to make the Constitution a “living document” adaptable to changing times.

The real threat is not what the federal courts have done in the past sixty years! It is the attempt of conservatives and the Republican Party to negate the great progress brought about the Supreme Court and lower courts in the past sixty years, and revert back to the years after World War II, when all of these great changes started slowly to evolve through courageous judges and Supreme Court Justices, including Earl Warren, William Brennan, Hugo Black, William O. Douglas, Thurgood Marshall, Harry Blackmun, John Paul Stevens, Sandra Day O’Connor, David Souter, Ruth Bader Ginsburg and Stephen Breyer.

The Republican Motivation For Power: Take Away Human Rights Already Granted!

America has developed over the past two centuries into a republic promoting democratic values and the advancement of human rights.

The Republican Party of 2011-2012, however, is making clear its desire to TAKE AWAY human rights already won over the past two centuries, with blood, sweat and tears!

We have seen the acquisition of voting rights in the 15th, 19th, 23rd, 24th, and 26th Amendments, as well as with the Voting Rights Act of 1965, and yet now, the Republican Party in many states is working very hard to LIMIT the right to vote by unreasonable limitations that particularly affect African Americans, Hispanics and Latinos, college students, the elderly and the poor of all races!

Women have gained the right to control their own privacy, including control of their own bodies, through a Supreme Court decision in Roe V. Wade in 1973 and other Supreme Court decisions and legislative actions, and yet now in many of our states, the attempt to take away women’s rights, including the right of abortion, is being fiercely waged, including encouragement of violence against abortion providers and closing down of locations where a woman can pursue her reproductive rights.

Gay men and lesbians have gained the right to serve in the military openly, be married in several states, adopt children in most states, and have other basic human rights, but now the move is on to take away these rights so hard fought for!

Working people, both immigrants and those born in the US, have fought for labor protection and representation through formation of labor unions, which have now been undermined for decades, and the attempt to impoverish workers by corporations and their Republican allies is in full development!

This has been a land of immigrants, and yet the Republican Party of today believes in polarizing Americans against undocumented immigrants who they would support deporting in the millions, even with the fact that 98 percent of them have committed no crime beyond entering the nation in an illegal manner, and just want the opportunity to work toward eventual citizenship through learning English, paying fees, and waiting patiently in line for the “American Dream”, and yet now work at low wage jobs that no Americans wish to fill, particularly in agriculture, retail, and home and hotel services.

Americans in general have been able to see improved educational opportunities, better health care, and opportunities for better housing and safer environment and consumer protection due to past Democrats and moderate Republicans working to better conditions for the middle class and the poor, but now the goal of the GOP is to take away these advancements and simply promote the interests of the top one percent and the corporations that sit on money, refuse to hire, and instead use government money that saved them to give bonuses to overpaid, under worked executives, and to lobby corrupt politicians who do their bidding!

Will the nation at large continue to accept an opposition party that works to DENY all of the progress on voting rights, women’s rights, gay rights, labor rights, immigrant rights, and the advancements for the middle class and poor gained over two centuries?

Only if the people are appealed to based upon ignorance, emotion, prejudice, and manipulation! For the future of America, this cannot be allowed to happen, as it will undermine the social fabric of America for the long haul!

MASSIVE Victory For Workers’ Rights, Women’s Rights, And Voting Rights!

A massive victory for Democrats, progressives and liberals, and the American people, occurred tonight on the 2011 Election Day, and it augurs a progressive victory in 2012!

In three states, particularly, conservative Republican and Tea Party forces were set back in their power grab to take away basic rights of workers, women, and voters!

Ohio rejected the anti public union bill passed by the Republican legislature with the backing of Governor John Kasich by a vote margin of about 60-40, therefore restoring collective bargaining rights for police, firefighters, teachers and other public employees. This is a warning to Scott Walker in Wisconsin, Rick Snyder in Michigan, Rick Scott in Florida, and Paul LePage in Maine, who also have been working against the rights of public employees, that the people will NOT tolerate the loss of labor rights won over the years, which have helped to grow and sustain the middle class! It also shows that conservative talk radio, Fox News Channel, and even the Koch brothers and other greedy, selfish, self centered billionaires are not going to be allowed to shape the country in their image. The Republican Party in Washington, DC should see this as a warning that if they continue to refuse to help job creation and just set out to defeat Barack Obama, they will pay the price in next year’s election!

At the same time in the conservative state of Mississippi, the proposed “personhood” amendment that would define a fertilized egg as a person was also soundly defeated by about 57-43 percent, a tremendous victory for women’s rights and Roe V Wade, and a strike against the extreme anti abortion fanatics who have no concern for the health and well being of women, and wish to take away their privacy rights!

And in Maine, we saw the defeat of legislation that ended the practice of allowing registration on the day of the election, a move being copied in other states to cut back voter registration and participation. This is another Republican and conservative attempt to cut back on voting rights with the false claim of massive voter fraud, which has never occurred anywhere in reality!

So it is clear that the conservative and Republican victories in 2010 and their abuse of power in the months since has been rejected. So in a way, it was necessary to have this occur to wake people up as to the need to be involved, to participate, to pay attention, to organize, and to realize that if one does not work at protecting their basic human rights, those rights can be taken away from them!

It is certain that the 2010 Republican victories will be overcome by a tremendous counter reaction in 2012, with 2011 being the first strikes against the right wing!

The Mississippi “Personhood” Ballot Initiative: A Threat To Women And Common Sense!

The state of Mississippi, infamous for its long history of extreme racial violence and discrimination, is now attempting by ballot initiative to take down Roe V. Wade, the 1973 Supreme Court decision which allows women the right to control their own reproductive lives.

It is one thing to claim that a five month fetus is seen as a “person” which might be able to live outside the womb. It is another thing to claim that a fertilized egg is to be seen as a “person”, and to declare that using an IUD, birth control pills, or the morning after pill (RU 486), all contraception methods is murder. It is outrageous that doctors, nurses, and the women themselves could be brought up on murder charges if an abortion is used to save the life of the mother in a situation where the pregnancy endangers her existence.

It is ironic that Mississippi, the state judged the MOST RELIGIOUS, would be the state that has no concern for women’s rights, and treats women as being controlled by men, who have no concept of what a pregnancy does to a woman, and to take the sexist view that every act of sexual intercourse should lead to a potential child.

It is also par for the course that Mississippi has the most violent record of mistreatment of African Americans of any state, and should hold its head in shame collectively for having the gall to promote such an initiative! Also, Mississippi is infamous for having many more capital punishment cases than most states.

Mississippi, close to the cheapest state in its attitude toward the poor, is also demonstrating yet again that it only is concerned about the birth of a fetus, rather than the health and welfare of its women and its poor population!

What hypocrisy, but it demonstrates just how significant the issue of the Supreme Court is in the upcoming Presidential Election of 2012, as if the Republican nominee wins, the rights of women will be curtailed by right wing Court appointments over time, and we will be back to the level of back alley abortions and unnecessary deaths of women who will not allow their personal lives to be controlled by religious zealots and theocratic fanatics

Kansas: Historic Center Of Massive Battles And Turmoil Does It Again!

The state of Kansas, center of the Great Plains, is one often overlooked or ridiculed, but it has been a center of massive battles, turmoil, and struggles throughout its history.

Blessed and cursed by its location in the Wheat Belt, Kansas has seen tornadoes, blizzards, drought, hail, floods, and grasshoppers, and was the center of the Dust Bowl of the 1930s, forcing many farmers to leave the state and go west to California for salvation!

It is the territory and state where the Civil War began over slavery in the 1850s, before that war erupted nationally, and it was the center of struggles between Indians and whites from 1860-1890.

It was also the original home of the prohibition movement against liquor, and a center of the Populist movement of the 1890s and the Progressive movement of the early 20th century.

Kansas also became the rare example of a non Southern state which adopted racial segregation legally, and it was a case brought by a young black girl, Linda Brown, in Topeka, Kansas, which led to the famous Brown V. Board of Education Supreme Court decision in May, 1954.

And abortion has become a major controversy in Kansas, with Dr. George Tiller, an abortion doctor, murdered in Wichita a few years ago by an anti abortion fanatic.

Now the state government, under right wing conservative Republican Sam Brownback, former Senator, has passed restrictions on abortion, which has led to only ONE abortion center being available in the entire state, a major victory by the so called Pro Life movement, and a major blow to the Roe V. Wade decision of the Supreme Court in 1973.

So the abortion debate rages on in many states, with Kansas again being the center of controversy, as it often has been in its history over the past 160 years!

Senator Rand Paul Of Kentucky: Center Of Controversy And Nightmare For The Republican Party! :(

Senate Minority Leader Mitch McConnell of Kentucky has had to learn to live with fellow Kentucky Senate colleagues that have both embarrassed him and made his life miserable! If only one could read his mind, as his body language regarding past Senator Jim Bunning and his successor Rand Paul reveals discomfort, it would be an interesting analysis of how a party leader must survive both fools and loons! 🙁

Rand Paul may only have been in the Senate now for one month, but he is like a hurricane in his promotion of ideas that almost no one will accept, even in his own party, but yet saluted by the Tea Party movement!

Rand Paul seems to love introducing legislation that will never pass, just to draw attention to his looniness and his weird libertarian ideas which will never go anywhere, except into the minds of those who believe that government is a total evil and that we must isolate ourselves from the outside world! 🙁

Rand Paul, in association with Senator Roger Wicker of Mississippi, is promoting a Life at Conception Act, which he believes would overrule Roe V. Wade, and in the process take a woman’s right over her own body totally away! 🙁

He is also sponsoring legislation to prevent the children of illegal immigrants born in America from being citizens, thereby introducing a new interpretation of the 14th Amendment, which grants birthright citizenship!

Additionally, Rand Paul wants all foreign aid to our ally, Israel, ended, as part of his proposal to cut $500 billion from the present year’s national budget with only eight months left in the fiscal year. He wants the $3 billion aid to Israel ended, along with massive cuts in education, housing and energy programs, the most extreme idea of cuts proposed by any Republican, with the party shooting for only $100 billion cuts this fiscal year, with no cut in aid to Israel and other foreign aid, which he wants cut by $20 billion!

Republican leaders such as House Majority Leader Eric Cantor of Virginia and House Foreign Affairs Chairwoman Ilena Ros-Lehtinen of Florida have condemned a cutoff of aid to Israel, and Jewish groups in both major political parties, and both conservatives and liberals have made clear their opposition to such a cutoff, so Rand Paul’s advocacy has no chance of success, anymore than his other ideas mentioned above!

And get this: this past week, the Senate unanimously, except for Paul, adopted a measure making it a federal crime to aim a laser point at an aircraft, with the Kentucky senator feeling that should be an issue for states to handle individually, even though aviation is interstate, and there has been a growing problem of such incidents, thankfully without a disaster occurring!

It is clear that Rand Paul will be a center of attention over the next six years with his outrageous statements and actions, and imagine this. It is rumored that his father, Congressman Ron Paul of Texas, may run for the soon to be open seat in that state after Kay Bailey Hutchison decided not to run for re-election in 2012!

If Ron Paul were to win that seat, he would be the oldest first time freshman at age 77 to take a seat in the US Senate!

Can one imagine having two Senators Paul at the same time? 🙁

The only worse scenario is the nightmare of either Sarah Palin or Michele Bachmann as President of the United States in 2013!

If both scenarios were to occur, the nation would be in a living hell of its own making, due to stupidity, ignorance, and lack of common sense of the American people! 🙁
