The Republican Attack On The Constitution: A Threat To American Democracy!

The Republican Party loves to assert that the Democrats, and progressives in particular, are attacking the Constitution, and that they are the experts on the Constitution.

So therefore, in this Presidential primary season, and in the party membership in Congress, there are statements constantly attacking the court system, anytime that a federal judge or court issues a decision against the conservative view of the Constitution. There are condemnations and calls to change the court system on a regular basis.

One would think that the Democrats and their progressive friends have dominated the courts in recent decades, which, of course, is the exact opposite of the truth!

One forgets that from 1969-2011, there have been only 15 years of Democratic control of the Presidency, as compared to 28 years of Republican control.

The vast majority of federal judges have been Republican appointments, as a result, and Republican Presidents have made a total of 13 Supreme Court appointments over those years, and Democrats have made only 4, two by Bill Clinton and two by Barack Obama!

But now,. Newt Gingrich calls for judges to be required to testify before partisan Congressional committees, a violation of the separation of powers, and a danger to an independent judiciary!

What it comes down to is that Newt Gingrich and all of the Republican opponents, with maybe the exception of Mitt Romney and Jon Huntsman, wish to create a court system that would move away from the path breaking changes that the Supreme Court brought about during the years of the Warren Court, Burger Court, and Rehnquist Court including:

Brown V. Board Of Education
Miranda V Arizona
Roe V Wade
University Of California V. Bakke
Lawrence V Texas

As it is, there are threats presented by the Republican growth of dominance on the federal courts to all of these issues–racial integration, rights of criminal suspects, abortion rights, affirmative action, and gay rights.

The Republicans will not be contented until there are reversals on all of these issues, and a return to the “good old days”, when minorities “knew their place”; police had unlimited rights over those they questioned or arrested; women had no control over their reproductive rights; minorities and women had disadvantages, as compared to white males, on educational and job opportunities; and gays were forced to remain “in the closet” and face open discrimination and hate without recourse!

So when the Republicans claim to understand what the Founding Fathers meant at the Constitutional Convention, they are forgetting that those esteemed leaders put into the Constitution the “Elastic Clause” to allow for expansion of the Constitution beyond the original document, in order to make the Constitution a “living document” adaptable to changing times.

The real threat is not what the federal courts have done in the past sixty years! It is the attempt of conservatives and the Republican Party to negate the great progress brought about the Supreme Court and lower courts in the past sixty years, and revert back to the years after World War II, when all of these great changes started slowly to evolve through courageous judges and Supreme Court Justices, including Earl Warren, William Brennan, Hugo Black, William O. Douglas, Thurgood Marshall, Harry Blackmun, John Paul Stevens, Sandra Day O’Connor, David Souter, Ruth Bader Ginsburg and Stephen Breyer.

Barack Obama Invokes Teddy Roosevelt And The “New Nationalism” Of The Progressive Party Of 1912

President Obama invoked Teddy Roosevelt and the “New Nationalism” program of the Progressive Party of 1912 in a speech today at Osawatomie, Kansas, the site of a speech by the former President in 1910, setting the standard for his later third party run for President in 1912.

Called a socialist, a radical, and even a Communist by many conservatives a century ago, President Theodore Roosevelt promoted a very advanced series of ideas out of office, more than when he was in, including the end of child labor, equal pay for women, a minimum wage, a social insurance program including social security and health care, a progressive federal income tax, and reforming the political system.

His program, known as the “New Nationalism” became the forerunner of much of the “New Freedom” of Woodrow Wilson, the “New Deal” of Franklin D. Roosevelt, the “Fair Deal” of Harry Truman, the “New Frontier” of John F. Kennedy, and the “Great Society” of Lyndon B. Johnson.

Obama talked of the need for a strong middle class and a raised standard of living, and the need to regulate corporations and to raise taxes as other Presidents have done, in order to promote a “fair shake” for everyone, giving everyone “equal opportunity” to succeed.

Obama emphasized that major tax cuts for the rich had led to greater inequality, lower creation of jobs, growing deficits, and the collapse of the American economy in the past ten years. He declared that “trickle down economics” had never worked in the past successfully, and that assertive actions by government were necessary to promote a bright future for all Americans.

He called for more investment in education, research, technology, infrastructure, and manufacturing, rather than in banking and finance which leads to phony manipulation of financial figures and causes financial “bubbles”!

His speech, as usual, was well delivered, and was designed to inspire the American people to take on the struggle that was fought during the Progressive Era by Theodore Roosevelt to promote a bright future for America!

And remember that Theodore Roosevelt was a Republican who believed in the role of government to make a better society, something regrettably not the viewpoint of the transformed Republican Party of today, which speaks only for the wealthy and the corporations, and spends time dividing people and gaining support based on social conservatism issues, including gay rights, abortion rights, gun rights, illegal immigration and affirmative action. Meanwhile, the lives of the masses of Americans who vote on their emotions, rather than their reason, for the GOP, does not lead to better lives for those people!

A Generation Of Justice Clarence Thomas: Its Negative Impact!

Supreme Court Associate Justice Clarence Thomas has now been on the Court for a generation, and his impact is clear.

This is a man who was enmeshed in controversy when he was appointed by President George H. W. Bush to replace Associate Justice Thurgood Marshall as the second African American in the history of the Supreme Court. He was clearly the “anti Marshall”, and has remained in controversy ever since 1991.

Thomas was accused by African American law professor Anita Hill of sexual harassment, and accused liberals of a “lynching”, and only was approved by a vote of 52-48 in the Senate, the closest of the 20th century. He has, in a memoir in 2007 and before and since, continued to have bitterness and resentment toward liberals and his other critics, and said when he was confirmed that he would confound the “damn liberals” by staying on the Court for 43 years, the age he was when appointed, which would surpass Justice William O. Douglas’s 36 years on the Court, the longest in Supreme Court history. His wife strangely contacted Anita Hill last year to ask for an “apology”, which was not forthcoming, but continues to simmer in his wife’s mind after a generation.

Thomas’s wife has been involved in ethical problems as the head of a conservative organization working against the Obama Health Care law, and in other ways, working with the Tea Party Movement, while her husband is involved in decisions where his wife’s activities create ethical problems for him, although he is unwilling to react to any criticism by recusing himself from cases, as creating a conflict of interest. He does not care what his critics say!

On the Court, he is seen in many ways as the MOST conservative member, even more than Antonin Scalia in some ways. He is well liked by his colleagues, but almost never asks any questions in oral arguments before the Court. He gives lectures around the country, but avoids the news media. He comes across as bitter and odd in many ways, but also arrogant and hard to fathom.

Thomas has shown willingness to strike down case law going back decades, and sometimes even a century. He is the only one to argue for consistent return to the “original” meaning of the Constitution when it was adopted in 1789, even more than Antonin Scalia. He sees the Court as having gone the wrong way in many areas of the law, and wanting reversal of past rulings.

Thomas alone believes that states should be able to establish an official religion; believes teenagers have no free speech rights at all; believes business should not be regulated and their commercial speech and campaign activities should not be regulated; wants to strike down a key provision of the Voting Rights Act; and backs the President’s ability to hold an American citizen in prison indefinitely without charges or review by the courts.

Thomas refuses to see prisoner rights as legitimate and is against affirmative action to the extreme, even though he benefited from it himself! He spends his time only with people who agree with his hard line views, which many think is a shame, as it indicates he has a closed mind.

So Clarence Thomas continues to have a long range, in many ways deleterious effect on the Supreme Court, and probably will for close to another generation, as he predicted!

The Supreme Court, 2011-2012 Term: Likely To Be Momentous, Historic, Path Breaking!

The US Supreme Court begins its new term tomorrow with expectations of major decisions likely to be issued on the Obama Health Care Plan, illegal immigration laws, gay rights and gay marriage, and affirmative action, among other cases.

Rarely has a term opened with such potential major impact on the future of many hot button issues, expected to occur by June of 2012 at the latest!

What seems more likely than anything else is that Justice Anthony Kennedy, appointed by President Ronald Reagan in 1988, and with a reputation as a “swing vote” on the evenly divided Court, will be the decisive fifth vote on many cases!

To imagine that one man should have such great influence, more than the other eight, including the Chief Justice John Roberts, is an indication of how tenuous constitutional law is in the age of a Court dominated until recently by conservative appointments of Reagan and both Presidents Bush.

As always, the Court, while seemingly trying to avoid politics, in actual fact plays politics, and will have a decisive role in what happens in the Presidential Election of 2012.

And what many forget is that IF a Republican President is elected in 2012, the Court will be turned more hard Right than it is right now, and that will have a destructive, deleterious effect on constitutional law for at least a generation!

It is the most important impact of the Presidential election, something many ill informed voters do not recognize, but which has a long range effect on their lives!

Progressives will be on tenterhooks wondering if Justice Kennedy will side with the left side of the Court, or the right side of the Court. For the advancement of America, let’s hope he swings to the left on these important issues mentioned above!

The 87th Birthday of Jimmy Carter: A Look Back At His Much Maligned Presidency!

Today is the 87th birthday of former President Jimmy Carter, and it is proper to send good wishes to him!

By reaching the age of 87, and in good health, Carter becomes the seventh President to reach that advanced age, with former President George H. W. Bush having reached that pinnacle on June 12 of this year.

Other than the first Bush, only Gerald Ford and Ronald Reagan (both 93), John Adams and Herbert Hoover (both 90) and Harry Truman (88) have lived longer.

Jimmy Carter has also had a longer retirement after his Presidency than anyone except Herbert Hoover, and will pass him in longevity in retirement in less than a year, on September 8, 2012.

Jimmy Carter has been much ridiculed, lambasted, and condemned by his critics, and this post is not an attempt to deny the weaknesses and mistakes of his Presidency. Carter has learned how to accept the reality that he is shown little respect for his virtues and accomplishments, with a lot of it due to his defeat for reelection in 1980 by the charismatic Ronald Reagan, who is often now seen as a deity in many circles. There is the reality that IF a President loses reelection, his reputation in history suffers dramatically, no matter what he had achieved in office.

But while there is much controversy over Carter’s Presidency, on his birthday, it is worth it to point out his major successes in office.

1. Carter was able to negotiate the impossible–an agreement between Egypt and Israel, the Camp David Accords, which brought peace, recognition, and security for Israel for the past third of a century.

2. Carter also negotiated the Panama Canal Treaty, much berated at the time, and causing loss of seats for the Democrats and assisting the conservative takeover, but in retrospect, one realizes that the treaty was not harmful and against our national security, but actually helped to improve relations with Latin America, and is now seen as non controversial a third of a century later.

3. Carter’s promotion of human rights as a major foreign policy goal was ridiculed by conservatives and Ronald Reagan, but later it turned out that future Presidents, all of them, utilized the concept in some form as part of their foreign policy goals.

4. Carter made us aware of the energy crisis, and the need to expand energy resources beyond oil, and while it has not been pursued as he emphasized by later Presidents, it is clear that Carter was correct in his emphasis on alternative sources of energy being essential for America’s future.

5. Jimmy Carter had the best one term environmental record of any President, greatly expanding national parks and forest land, and focusing on the environment as an issue in a very admirable manner.

6. Carter appointed more minorities to appointed positions than any President before him, and fully backed affirmative action, which became a controversy during his Presidency due to the Bakke case.

7. Three new cabinet agencies were started during his Presidency, although now under attack by conservatives in 2011–Department of Education, Department of Health and Human Services, and Department of Energy.

8. Carter presided over the smallest increase in the national debt during his administration, attempting to have very tightly negotiated budgets, although all were with deficits.

9. Carter issued an executive order on his first day in office, granting amnesty to Vietnam draft evaders, which however caused a rift with military supporters who opposed this courageous act.

10. Carter negotiated the SALT 2 (Strategic Arms Limitation) Treaty with Soviet leader Leonid Brezhnev, which was never ratified by the US Senate because of the Soviet invasion of Afghanistan, but its details were obeyed by both sides despite the rejection of the agreement in the Senate.

It would be easy to list the faults and shortcomings of Jimmy Carter, and as the years go by, and eventually Carter passes from the scene, there will be much more research done on him and his Presidency. When that happens, it is likely that a reassessment of Carter in a much more sympathetic manner, will occur.

For now, Mr. President, Happy Birthday and many more!

The “Social” Issues In The Presidential Campaign Of 2012: Are They Really Gay Marriage, Abortion, Affirmative Action, Gun Rights, School Prayer, And Immigration?

If you listen to Republican Presidential candidates and “social” conservatives, many of whom claim to be “good Christians”, one would conclude that the social issues for the nation in 2012 are:

1. Gay Marriage
2. Abortion
3. Affirmative Action
4. Gun Rights
5. School Prayer
6. Immigration

All of these issues are extremely controversial, but what are the REAL social issues in America?

1. Homelessness of so many Americans, including those once middle class citizens.
2. Hunger, where many Americans, millions of them children, have inadequate nutrition, which will affect them long term.
3. Unemployment long term of millions, many of them over 40 and through the 50s and early 60s in age, who will never be able to gain employment at all at any time, or at the most, never make anywhere near the same income they had been earning in good times.
4. The destruction of the retirement funds and plans of millions of senior citizens, who now have to work many more years than planned just to survive.
5. The lack of health insurance and coverage of many millions of people who cannot afford to go to a doctor or hospital, or afford extremely expensive medication that would prolong life.
6. The lack of educational opportunity for those who are in poverty stricken neighborhoods, and receive an inferior education due to local property taxes being the main source of educational funding.
7. The discrimination against the children of undocumented immigrants, who discover when becoming adults, that they cannot attend college or join the military, and are threatened with deportation, along with discrimination visited against them and their parents and family members in states, such as Alabama and Arizona, because of illegal immigration laws which are being challenged in the federal courts.
8. The continuing challenge for disabled Americans, whether from birth or as a result of accidents or health problems, who, despite the Americans With Disabilities Act passed under President George H. W. Bush in 1990, still face barriers to equality of treatment.

These eight problems listed above are the REAL social challenges, but the Republican Party and so called “religious” people totally ignore these issues, instead promoting a new version of the old Social Darwinism and Laizzez Faire Economics prevalent in the Gilded Age of the late 19th century!

In other words, they want to go back to the 19th century, wipe out the 20th century, and promote good old “Christian” and “Unbridled Capitalism” values, which made America a nation ripe for reform and change, including the Progressive Era, The New Deal, and The Great Society!

This attempt to return to the old conservatism is a great evil which must be defeated by all good, really “religious” people of all faiths, who believe in equality of opportunity and fairness and consideration of others less fortunate than those of us who are lucky and successful, and do not experience the hardships of others!

The past is the past, and we need to look to the future, and realize if one American is homeless, hungry, denied health care and education, or discriminated against, then we are all worse off because of those realities!

This must be a country of WE, rather than simply ME!

The Week Of Reckoning For GOP Candidates–Three Challenges

The week from today, Labor Day, through next Monday, will have a dramatic effect on the Republican race for President.

Today, in South Carolina, six of the candidates (all but Rick Santorum and Jon Huntsman) will participate in a Palmetto Freedom Forum, in which each candidate will sit on the stage for 21 minutes, and have questions shot at them by South Carolina Senator Jim DeMint, Iowa Congressman Steve King, and conservative constitutional scholar Robert George of Princeton University.

DeMint will ask questions on how to make government smaller, while King will challenge the candidates on the subject of immigration. George will touch on the hot button social issues: abortion, gay marriage, and affirmative action. He is also likely to ask questions about federalism, the idea that some government agencies on the national level are not needed or allowed under the Constitution, such as the Education Department.

This is the kind of challenge that could make or break candidates, and then on top of that, there are two debates by next Monday night–one sponsored by MSNBC on Wednesday and the other by CNN next Monday, and it gives Rick Perry his first time on the national stage debate; but also allows Jon Huntsman his last real chance to start gaining notice and move up in the national polls; Michele Bachmann the chance to outshine Perry; Mitt Romney the chance to come back from second place in the polls after seeing Perry rise above him; the opportunity for Ron Paul to look like more than a fringe candidate; and the last chance for Newt Gingrich, Herman Cain and Rick Santorum to look as if it is worth going on as candidates.

So this next week is one in which Sarah Palin will be watching, and probably being thankful she has not entered the Presidential race, and solidifying her decision to stay out of it, as running for President is for those who are unafraid of challenge, which Sarah obviously is, having quit as Alaska Governor in the middle of her one term!

Rush Limbaugh And The Ultimate Right Wing Agenda: Reverse The Social And Economic Progress Since World War II!

Radio talk show host Rush Limbaugh is on a roll with the Debt Ceiling Crisis and the Stock Market Crisis of the past few weeks, and he has declared war on all social and economic progress for the past 65 years, since World War II! Other right wing radio talk show hosts also promote what he does!

Actually, showing his total ignorance, Limbaugh probably means the past 80 years, since the New Deal of Franklin D. Roosevelt in the 1930s!

By declaring, in any case, that it is time to reverse the past 65 years, that means the following:

1. The Harry Truman improvements on the New Deal programs of FDR.
2. Reversal of Truman’s executive order to enforce racial integration in the military.
3. Reversal of racial integration as ordered by the Supreme Court and enforced by Presidents Eisenhower, Kennedy and Johnson.
4. Reversal of Eisenhower’s acceptance of the New Deal and institutionalizing it.
5. Wiping out of the programs of the New Frontier of JFK and the Great Society of LBJ–including Medicare, Medicaid, Federal Aid to Education, Consumer Protection Laws, Civil Rights and Voting Rights Act, programs to fight poverty, Environmental laws, National Public Radio, Public
Broadcasting, and other programs.
6.Ending of Richard Nixon’s domestic reforms–including the Occupational Safety and Health Administration, Environmental Protection Agency, Consumer Products Safety Commission, Affirmative Action programs, and others.
7.Ending of programs to aid the disabled and handicapped, begun under George H W Bush.
8. Other reforms passed under Jimmy Carter, Bill Clinton, and now Barack Obama.

This is totally insane, and the progressive movement MUST fight tooth and nail to prevent such total destruction of everything which has made America a better nation, a more tolerant nation, a more compassionate nation!

We cannot afford to go back to the 1920s, and there is no way that this agenda of Rush Limbaugh and his ilk can be allowed to triumph!

The Sharply Divided Supreme Court And The Future: Crucial Cases Coming Up!

The US Supreme Court demonstrated two tendencies in the past term just ended: Support of corporation rights at the expense of the public interest, and absolute worship of the First Amendment right to freedom of speech in ways many just shake their head at in wonderment!

But if there is controversy over some of the Supreme Court decisions of the term now over, just wait to the next session of the Court in 2011-2012!

What kinds of “hot” issues are to show up for oral argument and decision in the next term?

1. The Obama Health Care Plan’s constitutionality
2. Affirmative Action
3. Illegal Immigration
4. Gay Marriage

It seems as if no one is leaving the Court, although one would have thought that Ruth Bader Ginsberg might have retired, so it will be the same nine member, equally divided Court, with Anthony Kennedy the swing vote on many cases, deciding some of the most controversial areas of political debate in this country, and deciding if we are moving ahead, or falling back into the 20th, and maybe, the 19th century!

Time For Barack Obama To Utilize Executive Order To Stop Deportations Of Young Immigrant Children Victims Of Failure To Pass DREAM Act!

It is long overdue for President Obama to halt deportations of young immigrant children facing deportation from the only country they know, since the DREAM Act, designed to allow them to become citizens through miltary service or college graduation, has not been passed by Congress due to strong nativist sentiments!

These young people were brought here through no fault of their own, by parents who were trying to better their lives. Many are being forced from the country now, to go back to a nation they have no memory of, and in many cases, have no relatives to return to.

These young people have broken no laws, and just want to work toward citizenship through serving in the military, or attending college, so that they can contribute to the future of America.

The use of the executive order is not something new, and this President has already been bold in many ways, so instead of talking about immigration reform, it is essential that the President now take action to stop this violation of human rights!

Executive orders to promote the end of oppression and denial of human rights is part of the long tradition of American history, as witness the following:

1. Abraham Lincoln’s Emancipation Proclamation in 1863.
2. Franklin D. Roosevelt’s establishment of the Works Progress Administration during the Great Depression in 1935.
3. Harry Truman’s promotion of integration of Washington, DC and of the military in 1948.
4. Dwight D. Eisenhower’s intervention in the Little Rock School Desegregation crisis in 1957.
5. John F. Kennedy’s promoting affirmative action in employment by government contractors in 1961, along with his interventions in Mississippi in 1962 and Alabama in 1963 with the National Guard.
6. Lyndon B. Johnson’s promotion of Equal Employment Opportunity in federal employment in 1965.

So, Mr. President, it is time for immediate action on immigrant children!
