Chief Justice John Roberts Has Become The “Swing Vote” On The Supreme Court Since The Retirement Of Anthony Kennedy

Chief Justice John Roberts, appointed in 2005, has become a major surprise on the Supreme Court, and is seen by many as the new, often reliable “swing vote” on the Court, enraging hard line conservatives.

He has become unpredictable after years of being seen as a solid conservative, and is evolving into the most important Chief Justice since Earl Warren retired a half century ago.

Roberts is now perceived as the new “Anthony Kennedy”, going with the liberal side of the Court about one third of the time, and staying with the conservative side two thirds of the time.

This does not please right wingers, who want a Court that is back to the Gilded Age in mentality.

Roberts saved Obama Care in 2012; and just this year backed off on conservative attempts to end abortion; to end DACA (Deferred Action on Childhood Arrivals; and backed the rights of gays and lesbians in employment, all path breaking moments.

He also prevented a citizenship question from being added to the census, and backed New York City’s strict gun control laws. And just this week, he upheld Nevada’s restriction on church attendance in the midst of the CoronaVirus Pandemic.

Roberts also was critical of President Donald Trump’s statement last year about Justices being loyal to who appointed them, when he said that there are no Bush Justices, no Obama Justices, no Clinton Justices. And of course, he presided over the Trump impeachment trial professionally, but one can see he is no fan of Donald Trump in any sense.

It seems clear that Roberts is thinking of his and the Court’s reputation and legacy, as the Court is awfully close to the point where it would seem regressive for the 21st century, were Roberts to go full right wing.

So despite strong criticism from the Right, John Roberts has been a savior on the Court at times.

Most important is that Roberts, writing for the Court majority of 7-2 on two cases has made it clear that Trump is subject to the law regarding no immunity from state criminal investigation of his taxes and also from congressional subpoenas, a stunning series of development at the beginning of July. So the President is not above the law!

Let us cheer on Chief Justice John Roberts for maintaining the reputation of the Supreme Court as NOT overly ideological, to the detriment of Americans!

Can Michael Bloomberg Ignore Iowa And New Hampshire And Have A Chance To Be The Democratic Presidential Nominee?

The quick answer to the above question is YES, but it would be a tragedy for the nation if simply having billions of dollars fortune, and spending tens of millions of dollars to run commercials, was able to elect a President.

Michael Bloomberg was an effective NYC Mayor for three terms, but he was also controversial with some of his policies, including his dealings with racial minorities, and his trying to control the size of soda bottles and other sugary drinks.

On the other hand, he has promoted gun control, and fought against tobacco and oil interests, and is a big promoter of taking action on climate change.

And he is certainly an arrogant man, who thinks he can “own” his employees and control what his journalists at Bloomberg News report and investigate.

The fact that he has gained a few percent of the vote due to his spending $57 million on commercials, while Kamala Harris was forced out of the Presidential race for lack of funding, is totally infuriating.

This is the result of the disastrous Supreme Court decision in Citizens United in 2011, destroying and corrupting our political system in a despicable manner.

Bloomberg would be a vast improvement over Donald Trump, but seriously, it is hoped that the Democrats will not be manipulated by his commercials to nominate him. His ability to draw attention from voters, without participating in many caucuses and primaries, and avoiding engagement in debates, should NOT lead to his nomination!

Two Thirds Of The Trump Term Is Gone: We Must Ensure That His Time In The Presidency Ends On January 20, 2021!

Yesterday, September 20, marked the end of 32 months of the Trump Presidency, two thirds of the entire term of 48 months.

This has been the most tumultuous 32 months in the history of the American Presidency, and with constant attacks on every institution and tradition imaginable, led by a crazed, mentally ill, morally bankrupt and totally evil man and his despicable cabinet and family.

And to imagine his attorneys in court this week declaring that the President cannot be challenged, and cannot be investigated, is an alarm bell in the night of the horrific dangers we are facing.

There is the potential of a new Middle East War, this time with Iran, in the service of a corrupt regime in Saudi Arabia.

There is the potential of a massive economic collapse after the longest economic expansion in American history, caused to a great extent by Donald Trump’s crazy tariff war with China and other nations.

There is the potential of more mass murders with firearms, and no moral leadership on Capitol Hill.

There is the ever present danger of climate change, with protests inspired by young people whose future is doomed if nothing is done to deal with the reality of what is occurring.

There is the power of religion, dividing people, and xenophobia, promoting racism and nativism on a large scale.

There is so much evil occurring, and an entire political party bows to the person who wishes to be a King, while the other party cowers in fear at standing up to the tin horn dictator and holding him accountable to the extent possible.

If Donald Trump is not impeached, it will be a sign to future Presidents of both sides of the political equation that they have been given license to extend the horrors of Donald Trump in the name of their own ambitions, rather than what is proper for the American people.

The fire is burning, and it is time for action, not only by the Democratic Party, but by all good citizens with a conscience and principles, willing to go beyond any personal economic gain that they might be having, and thinking of the nation above their own selfish interests.

The Next Speaker Of The House IF GOP Keeps Majority: Kevin McCarthy, Steve Scalise, Or Jim Jordan

If the Republican Party, somehow, holds on to majority control of the House of Representatives in the 116th Congress, they will need to select a new Speaker of the House, as Wisconsin Congressman Paul Ryan is leaving Congress at the end of this year.

At this point, there are three key contenders for the Speakership in the Republican Party:

House Majority Leader Kevin McCarthy of California

House Majority Whip Steve Scalise of Louisiana

House Freedom Caucus member Jim Jordan of Ohio

All three, honestly, make outgoing Speaker Paul Ryan look better by comparison, and yet, my readers know how much I dislike, and have denounced Paul Ryan, including when he was the Vice Presidential running mate of Mitt Romney in the Presidential Election of 2012, for which I was viciously attacked on several right wing websites at the time.

But seriously, Kevin McCarthy is practically the “lap dog” of Donald Trump, extremely loyal and obedient, and was seemingly aware of Russian Collusion in 2016, was talking about it at a Republican House conference meeting, until Paul Ryan told him to stop talking about it. He is a man without any principles other than the advancement of Donald Trump and his agenda, part of the Trump party, rather than the traditional Republican Party, and even more so than Paul Ryan, who has been unwilling to speak out against Trump’s disgraceful tweets and policies. McCarthy has refused to engage in Town Hall events in his Bakersfield, California district since 2010. He also promoted pursuit of Hillary Clinton for the Benghazi, Libya incident, where four diplomats were killed, gaining a reputation of promoting a “hit job” on her, when many more diplomats were killed at embassies during the Presidency of George W. Bush.

Steve Scalise, thankfully, recovered from being shot at the Congressional baseball game in June 2017, but it had no effect on his views on gun control, which is no regulation at all. Beyond that, Scalise used to be a friend of Ku Klux Klan Wizard and white supremacist David Duke, although now, of course, he denies it, and tries to claim it was not so. He would, in this author’s view, be a worse choice than McCarthy. However, for those who are uncomfortable with McCarthy, and might prefer a Southerner as the next Speaker, due to the strong GOP presence in the South, he might be seen as a potential favorite, and certainly less disgraceful by comparison, to the third choice, Jim Jordan of Ohio.

Jim Jordan, who is a co leader of the House Freedom Caucus, the most Far Right group in the Republican Party, has been accused of covering up abuse of athletes on the wrestling team at Ohio State University, when he was an assistant coach in the 1980s. He was one of the Republicans who promoted government shutdowns, and has done everything possible to block the House Judiciary Committee and the House Oversight and Government Reform Committee from pursuing investigation of the Donald Trump collusion with Russia in the 2016 campaign. He also pursed the Benghazi, Libya investigation of the deaths of four diplomats, targeting Hillary Clinton in a total of 11 investigations, which found no evidence of wrongdoing, and which featured 11 hours of testimony by Clinton, with no sign of weakness on her part, as compared to the performance of many others investigated by Congressional committees. Plain and simple, Jordan would be the absolute worst of the three choices being considered by the Republicans, although others might join the fray after the midterm elections.

It is indeed a very sad situation when we can look back on John Boehner as being far better than Paul Ryan, Kevin McCarthy, Steve Scalise, and Jim Jordan.

Let us hope that one of the latter three will be the Minority Leader, rather than the Speaker of the House in 2019-2020.

The Double Standard And Hypocrisy Of The Evangelical Right Wing Is Infuriating, And Shows Danger Of Brainwashing Of Gullible People

The scandalous sex life of President Donald Trump is well known, and it has been accentuated by the Stormy Daniels scandal that was revealed recently.

On top of the public affairs of Donald Trump against his own first two wives, and his bragging on the Access Hollywood tapes a decade ago, it makes one disgusted that he sets such a horrible role model for young men, and has no issue in bragging openly about his love life, while denying any sexual harassment charges by more than a dozen women over the years.

More infuriating, however, is the “pass” or “mulligan” that the evangelical Right Wing gives to him, when they were leaders in denouncing the scandalous sexual behavior of former President Bill Clinton.

No one is defending Clinton’s actions, but at least he never publicly bragged about it, or flaunted, but instead kept it private, until it was revealed, creating a crisis that went on for an entire year.

This time, the attitude of “religious” people and the Republican Party is ho hum, as if to just forget about it and move on.

So we have Franklin Graham, Jerry Falwell, Jr, Tony Perkins, Pat Robertson, and other right wing so called “devout Christians”, unconcerned, as long as the court system is made extremist right wing, and tax cuts are given to the wealthy, and the nation moves toward promotion of theocracy, including the ugliness of homophobia, misogyny, racism, nativism, and Islamophobia, and their backing of the National Rifle Association and its fight against any gun control.

The double standard and hypocrisy of the evangelical Right Wing is totally against the teachings of Jesus Christ, is infuriating, and shows the danger of brainwashing of gullible people, including women who are too willing to let men dictate their way of thinking.

To think that these women, including six phony blonde hair women, can mouth such ridiculous, asinine utterances on a CNN interview is beyond all rational behavior.

In Midst Of Democratic “Morass”, Could Jerry Brown Come To The Rescue At Age 82, And Unite Democrats In 2020?

In the midst of Democratic Party “morass”, stirred up further by Donna Brazile”s new book, and the lack of leadership and a new agenda, other than to wait for Donald Trump to implode, it is alarming those who want an aggressive approach to revive Democratic fortunes.

The clear need for a new generation of leadership is clear cut, but at this point, some are starting to notice that the Governor of the largest state is actively on the attack against the Trump Administration on the issues of the environment, immigration, gun regulations, and more. He is the great progressive star. Who are we referring to?

We are talking about Jerry Brown, who is 79 years old, and will leave the Governorship a year from now at age 80.

Some are wondering could a 82 year old four time Governor of California, at age 36-44 and then 72-80, actually mount a Presidential campaign for the fourth time, after trying in 1976, 1980 and 1992–so 44, 40 and 28 years ago?

It seems crazy to imagine it, but it also demonstrates how weak the Democrats seem to be, as we start to consider Presidential candidates in 2020 for the Democrats.

All one can say is IF we are to even think about Jerry Brown, then we cannot dismiss Joe Biden (78 in 2020), or Elizabeth Warren (71 in 2020), and even Bernie Sanders (79 in 2020).

But this blogger still feels strongly that a new generation in the 40s, 50, and early 60s is the best route to travel, and would include such leaders as Senator Chris Murphy of Connecticut, Mayor Eric Garcetti of Los Angeles, Senator Kamala Harris of California, likely future California Governor Gavin Newsom, Senator Cory Booker of New Jersey, Senator Kirsten Gillibrand of New York, Senator Amy Klobuchar of Minnesota, New York Governor Andrew Cuomo, and others not often mentioned.

Doug Jones Vs. Roy Moore: A Chance For Democrats To Gain An Alabama Senate Seat In December

The special election to fill Attorney General Jeff Sessions’s Alabama Senate seat is set for December 12.

It could be a Christmas and New Year’s gift for the Democrats, if Doug Jones can win that seat from right wing extremist Roy Moore, former Chief Justice of the Alabama Supreme Court, who will cause nightmares, if elected, for the Republican Senate Majority Leader Mitch McConnell, and would be more outrageous and irritating than Texas Senator Ted Cruz.

Moore is supported by the Alt Right and Breitbart News, headed by Stephen Bannon, and he has extremist views about women including anti abortion advocacy, anti gay rights for gays and lesbians including marriage, anti Muslims, pro firearms including wielding his gun at a campaign rally, nonbeliever in global warming and evolution, promoter of the Barack Obama Birther Conspiracy beliefs, advocate of nativist and racist beliefs, and calls America a “Christian nation” governed by God, not by the Constitution, and insisted on a Ten Commandments Monument at the Alabama Judicial Building while he served as Chief Justice, before his removal.

Doug Jones is a former US Attorney, who pursued and prosecuted two Ku Klux Klansmen involved in the infamous Birmingham, Alabama Black Church Bombing in 1963, which killed four young African American girls, including friends of Condoleezza Rice, who lived in Birmingham and was around the age of these young girls when they were killed. Jones was able to gain convictions and imprisonment for these two individuals in 2001 and 2002, nearly four decades after the murders, a major accomplishment.

Jones has gained awards for his civil rights and environmental commitment, and would add to the possibility of a Democratic party takeover of the US Senate in the midterm 2018 elections, as ordinarily, it would seem highly unlikely that the Democrats could gain this particular Senate seat, and will have a very difficult time to gain three seats, since there are so few Republicans seeking reelection in 2018.

But, hard to believe, as outrageous as Jeff Sessions was in this Senate seat, Roy Moore would be far worse and more despicable than Sessions, so Democrats need to do everything possible to promote Doug Jones to the US Senate over the next two months.

Revolutionary Moment In History Of House Of Representatives, Unmatched Since 1910 “Revolt” Against Speaker Joseph Cannon!

A century ago, in October 1910, Democrats and progressive Republicans united to state a “coup” in the House of Representatives, stripping Speaker of the House Joseph Cannon of his absolute power to decide committee appointments and control the legislative agenda all by himself.

Now in June 2016, the Democrats have staged a one day sit down, demanding a vote on a gun control measure. They proceeded to prevent normal routine in the House of Representatives, and to shout down any attempt at taking action on other legislative business.

While Speaker of the House Paul Ryan was befuddled, and waited until 10pm to attempt normal legislative business, which failed, and led to the end of the official session until after the 4th of July recess, the Democrats have drawn attention to the issue of gun regulation, and it is clear they will defy Ryan again when the House of Representatives comes back into session next month.

The effect will be to put the Republicans on notice, that it is time that they stopped being captives of the National Rifle Association and Wayne La Pierre. The issue will be a major one in November, and hopefully, might cause a massive switch of seats, putting the Democrats into the majority again, although that is still highly difficult to do, as 30 or more seats would need to be gained.

But taking action, led by the icon civil rights leader Congressman John Lewis of Georgia is better than just doing nothing! Hope springs eternal!

Top 10 Political Stories Of 2015

As the year 2015 ends, we look back on the major political stories of this eventful year.

The ten major stories of the year are as follows:

The rise of Donald Trump, and the threat he represents to the Republican Party, the conservative movement, and to the American people in general. He is promoting a Fascist agenda, including nativism, racism, misogyny, and a belief spreading among white working class men that somehow he is the new Messiah, who will solve all of the problems brought about by the failings of the George W. Bush Administration.  These  include the Afghanistan and Iraq Wars, which fueled terrorism; and the Great Recession of 2008, which is still reverberating among those less educated and more suspect to demagoguery. And also,those who refuse to accept Barack Obama as a legitimate President find Donald Trump appealing.

The surprise appeal of Vermont Senator Bernie Sanders, who is gaining support among the millennial generation, and men and women under 45, who are more educated than average Americans, and find his democratic Socialist ideas appealing.  There is no question that the younger generation is much more liberal than other Americans, and this bodes well for the Democratic Party, if Hillary Clinton continues her move to the left, pushed that way by Sanders’ agenda.

The final acceptance of gay marriage and the advancement of gay rights on all fronts, including the rights of transgender people, but with much discrimination still evident by those who resist change.

The disappearance of John Boehner and the rise of Paul Ryan to the Speakership of the House of Representatives, and the issue of whether Ryan can be any more effective in dealing with the Tea Party Movement, which helped to bring Boehner to the point of resignation.

The growing racial tensions in the nation, due to increased examples of police abuse toward African American men, and even women, along with Latinos, and the growing militarization of law enforcement, a dangerous trend.

The rise of more domestic terrorism, including in Charleston, San Bernandino and elsewhere, some of it inspired by ISIL (ISIS), but also by right wing Christian extremism.

Barack Obama’s changed foreign policy, including opening up to Cuban diplomatic relations; making a deal with Iran’s government on nuclear weapons; attempts to cooperate with other nations to deal with Islamic terrorism, meaning ISIL (ISIS) in Iraq and Syria; and trying to work with a hostile Israeli government, led by Benjamin Netanyahu, who made life more difficult for Obama by openly consorting with Republicans over the President.

The growing impact of social issues on American politics, including not only gay rights and gay marriage, but also abortion, gun control, immigration reform, and climate change.  All of these controversies will impact politics in a dramatic fashion in 2016 and beyond.

The issue of individual rights to privacy, and the growing role of intelligence gathering and government snooping, including the Central Intelligence Agency, Federal Bureau of Investigation, National Security Agency, and other government agencies, who feel that they must intrude and investigate all social media and phones and computers, to protect us.  This is seen by many critics as a violation of our civil liberties.

The evident deterioration of the effectiveness and competence of the Secret Service, in its role as protector of the President and his family; the Vice President; the Speaker of the House of Representatives; and all Presidential candidates, as the Presidential Election year of 2016 awaits us.  The last thing we need is any incident that affects the health, safety, and lives of any of the candidates or the top leadership of government.  If such were to happen, it would undermine our whole political system and stability in massive ways!

 

Donald Trump Democrat, Donald Trump Independent, Donald Trump Republican: Which Is The Real Donald Trump? None Of Them!

At this point, Donald Trump is surging ahead for the Republican Presidential nomination, but one has to wonder if he has the staying power to go all the way to the convention in Cleveland with enough delegate support to become the GOP nominee for President.

Right now, Trump sounds like a conservative Republican, but he has been a public figure for decades, and when one investigates his entire public record, Trump comes across as inconsistent, and wishy washy in his political views and statements.

Trump has been a declared Republican,then an Independent, than a Democrat, then a Republican although registered as an Independent.

Trump gave money to Hillary Clinton’s campaign for President in 2007-2008.

Trump once praised a single payer health care system, similar to Medicare for all, but now he opposes ObamaCare, although ten years ago he supported “health marts” very close to RomneyCare and ObamaCare.

Trump opposed the war in Iraq, but now says he would use military force to fight ISIL (ISIS).

Trump once supported a surtax on the rich, but now want the top income tax rate cut in half, and is against the inheritance tax.

Trump is best at attacking everyone personally, but has no set stands or details on most public issues, and prefers to use slogans and emotion to gain public support of those disillusioned with government as it is.

Trump has become most notorious for his “Birther” claims about Barack Obama, but otherwise is constantly contradictory on many issues.

Trump is hard to figure out, as he supports private sector labor unions; is against cutting Social Security and Medicare; reluctant to send military forces all over the world; and against the Trans Pacific Partnership trade deal.

But he is against teachers unions and public employee unions generally; against an increase in the minimum wage; against those who claim there is climate change; against gun control; and against any path to citizenship for undocumented workers, and already infamous for his attacks on Mexican immigrants and Mexico.

Ultimately, Donald Trump is for Donald Trump, a person who will prostitute himself and change his views when it is convenient; a man who is a publicity hound who is more in this race for the attention he gains; a man who appeals to fears and frustrations and discontent among average voters unhappy with their government, and easily accepting conspiracy theories.

In that regard, Donald Trump is a demagogue, in ways like Huey P. Long on the left; and like George C. Wallace on the right, and sadly, we know what happened to these two men, one assassinated, and the other paralyzed for life by an assassin.
