Chief Justice John Roberts Has Become The “Swing Vote” On The Supreme Court Since The Retirement Of Anthony Kennedy

Chief Justice John Roberts, appointed in 2005, has become a major surprise on the Supreme Court, and is seen by many as the new, often reliable “swing vote” on the Court, enraging hard line conservatives.

He has become unpredictable after years of being seen as a solid conservative, and is evolving into the most important Chief Justice since Earl Warren retired a half century ago.

Roberts is now perceived as the new “Anthony Kennedy”, going with the liberal side of the Court about one third of the time, and staying with the conservative side two thirds of the time.

This does not please right wingers, who want a Court that is back to the Gilded Age in mentality.

Roberts saved Obama Care in 2012; and just this year backed off on conservative attempts to end abortion; to end DACA (Deferred Action on Childhood Arrivals; and backed the rights of gays and lesbians in employment, all path breaking moments.

He also prevented a citizenship question from being added to the census, and backed New York City’s strict gun control laws. And just this week, he upheld Nevada’s restriction on church attendance in the midst of the CoronaVirus Pandemic.

Roberts also was critical of President Donald Trump’s statement last year about Justices being loyal to who appointed them, when he said that there are no Bush Justices, no Obama Justices, no Clinton Justices. And of course, he presided over the Trump impeachment trial professionally, but one can see he is no fan of Donald Trump in any sense.

It seems clear that Roberts is thinking of his and the Court’s reputation and legacy, as the Court is awfully close to the point where it would seem regressive for the 21st century, were Roberts to go full right wing.

So despite strong criticism from the Right, John Roberts has been a savior on the Court at times.

Most important is that Roberts, writing for the Court majority of 7-2 on two cases has made it clear that Trump is subject to the law regarding no immunity from state criminal investigation of his taxes and also from congressional subpoenas, a stunning series of development at the beginning of July. So the President is not above the law!

Let us cheer on Chief Justice John Roberts for maintaining the reputation of the Supreme Court as NOT overly ideological, to the detriment of Americans!

Half Of Nightmarish 2020 Completed, With Half To Occur: What Is Next?

Half of the year 2020 is gone, and it has been an horrific six months:

The impeachment trail of Donald Trump, where his Republican Party refused to recognize the danger he presents, and his being in office since early February has been a series of disasters.

The outbreak of the Corona Virus Pandemic, with Trump not taking it seriously from Day One onward.

The economic collapse, which has caused the second Great Depression, but affecting a population three times larger, and no ending to be seen, with so much more desperation, homelessness, and hunger as the result.

The racial discord which has developed over the George Floyd murder by police in Minneapolis, and Trump inciting more racial animosity.

The refusal of Trump to protect Americans in combat, and labeling the bounty paid by the Russians to Taliban fighters to kill Americans in Afghanistan, as a hoax.

Five nightmares and four months to Election Day, 125 days from today, and then 78 days to Inauguration Day!

Will America survive intact over the next 203 days is the issue, extremely worrisome!

The health, safety, and lives of Americans is at stake!

Trump Is Clearly A National Security Risk After Revelation About Russian Payments To Taliban To Kill American Military In Afghanistan

Donald Trump is proving what any sane American knows: that he is a traitor tied to Russia’s President Vladimir Putin, and has been from the beginning of his Presidency.

The revelation that Russia made payments to Taliban fighters to kill American soldiers in Afghanistan, and that Trump has done nothing about it, and claims no knowledge had ever been given to him regarding this, is totally infuriating, and requires a swift removal from office.

If only Vice President Mike Pence had guts and courage, and worked to gain the support of a majority of the Trump cabinet, Trump could be forced out, but clearly, that is not about to happen.

There are rumors that Trump might resign, due to his poor reelection polls, but that is still hard to believe, and one has to wonder what Mike Pence and cabinet members knew, and whether they have been in on the scam.

America is in a very bad time, with the CoronaVirus Pandemic, the economic depression, the racial animus, and now this national security issue.

This is, more now than when the Impeachment trial took place, the most crisis ridden moment since the Great Depression, and possibly more so than the events of the 1930s.

There are signs of some Republicans in Congress starting to stir in anger, but the party has been so feeble, one wonders what will come out of the situation.

More than ever, for sure, it is urgent that Joe Biden defeats Donald Trump by a massive margin in November, or the nation is doomed long term!

7 Months To Inauguration Day: Fears Grow Of Potential For Disastrous Events Before Election Day, And Up To Inauguration Day

America has gone through 41 months of the Trump Presidency as of today, June 20, and faces 7 more months until Inauguration Day, and 4.5 months until Election Day.

It is well known that events in the next 4.5 months could dramatically change the results of the Presidential Election of 2020, from what they might seem to be today.

This would not be the first time that “last minute” events, often called the “October Surprise”, transformed what happened on Election Day.

With all of the tumult and conflict we have witnessed under Donald Trump’s Presidency, it now looks as if Joe Biden is a clear cut front runner, but this is not a time to relax, as no result is certain, and people need to exercise their right to vote.

Somehow, with a first nearly six months of 2020 being so unbelievable, with the impeachment trial; the CoronaVirus Pandemic coming upon us: the resultant complete collapse of the American economy; and the escalating violence by law enforcement against black men, leading to widespread demonstrations and some violence, one has to have trepidation about what the rest of this year portends!

Alabama Democratic Senator Doug Jones Deserves Everyone’s Support For Reelection For His Courage In Voting To Convict Donald Trump

Senator Mitt Romney of Utah deserves a lot of credit for his decision to convict Donald Trump on one impeachment count.

But Democratic Senator Doug Jones of Alabama deserves equal respect and financial support from anyone who realizes what a gamble he took in voting to convict Trump on both impeachment counts, in a state where the Republican Party has such a strong hold.

Jones is one of only three Democratic Senators in the states that made up the Civil War Confederate States, only joined by Virginia’s two Senators, Tim Kaine and Mark Warner.

Jones has distinguished himself as a “Profile in Courage” in his two years in the Senate, succeeding the infamous Jeff Sessions, and defeating the equally infamous Roy Moore, former Alabama Supreme Court Justice, in the special election that followed.

Jones faces either Sessions or Moore in November, and is the one really endangered Democratic Senator up for reelection.

Let us hope that many contribute to keep Doug Jones in the US Senate!

Realize that Jones was able to have a successful prosecution of those involved in the infamous 16th Street Baptist Church Bombing in Birmingham in 1963, which killed four African American young girls, bringing the perpetrators to justice in 2001 and 2002, nearly four decades after the horrific event.

This is a good, decent man, and Alabama and the nation deserve him to stay in the US Senate!

Mitt Romney, A Profile In Courage, First Senator In American History To Vote To Convict President Of His Own Party!

Senator Mitt Romney of Utah, the 2012 Republican Presidential nominee, was a true “Profile in Courage” yesterday, by voting to convict Donald Trump on the impeachment charge of “Abuse Of Power”.

This blogger and author was not a great fan of Mitt Romney in his failed 2012 Presidential bid, considering him a hypocrite for criticizing ObamaCare, which was based to a great extent on RomneyCare in Massachusetts. I did not want him as President, and think he lacked enough concern for the average American.

But that is the past, and Romney knows he will suffer attacks and condemnations from within the Republican Party for his action to be the first US Senator in American history to vote to convict a President of his own party in an impeachment trial. That took guts and also showed the true religiosity of Romney with his Mormon faith, whether one agrees or likes the Mormon Church and its teachings.

The accusation that he plans to run for President again is preposterous, and Romney may, very well, not run for reelection in 2024, but the future is not important as the present, to take a stand against the lawlessness and arrogance of Donald Trump.

The fact that Romney’s own niece, Ronna Romney McDaniel, is chair of the Republican National Committee, put her in an awkward position, and she did, indeed, make clear her objection to her uncle’s decision. But that does not matter, and whatever one thinks of Romney in the past, it is clear that his vote is based upon principle and courage, so it is proper to applaud and salute Mitt Romney for a decision that will live in history, and could be another chapter, updated, of John F. Kennedy’s famous “Profiles in Courage” book in 1956!

Romney will withstand the storm of criticism, and if moronic son Donald Trump, Jr is able to have Romney expelled from the Republican Party, as he called for in anger yesterday, the party will be the loser, not Romney.

If Romney is a true independent, he will be a greater Senator long term than being captive to a corrupt political party, so bring it on, is my thought!

Nine Months To The Most Urgent Election In American History!

Nine months from today, November 3, is the most urgent election in American history, as America will never be the same if Donald Trump is reelected to a second term in the White House!

Yes, there have been other crucial elections, including 1860 (Abraham Lincoln); 1932 (Franklin D. Roosevelt); and 1940 (FDR).

These elections centered around the upcoming Civil War; the tragedy of the Great Depression at its lowest moment; and the upcoming US involvement in World War II.

But while the Civil War, the Great Depression, and World War II were all massive crises for America, we now face a true demagogue out of control after an impeachment trial in which much of the evidence and essential witnesses to the wrongdoing of Donald Trump were not permitted to be included, due to the corruption and abandonment of the oaths taken by Republican Senators to uphold the Constitution and rule of law.

The Republican Party has besmirched the historic reputation of the US Senate for all time, and have lost all credibility as a viable political party.

It is essential for the party to be soundly defeated in as many House and Senate races as possible, and for the total repudiation of Donald Trump, who will go down in history as the worst and most dangerous President we have ever had, having abandoned all common decency and respect for the law!

Donald Trump needs to be held accountable for his transgressions, and for accountability under the law when he leaves the White House, having worsened the lives of tens of millions of Americans with his vindictive, lawless, and uncaring agenda!

Lamar Alexander No Profile In Courage, Unlike His Mentor, Howard Baker, In The Watergate Scandal

Retiring Senator Lamar Alexander of Tennessee, unlike his mentor, Senator Howard Baker of Tennessee, is clearly no Profile in Courage.

Baker stood up against his party’s President, Richard Nixon, in Watergate in 1973-1974.

Alexander chose instead to state that what Donald Trump has done in the Ukraine Scandal is wrong, but that it is up to the voters to decide whether Trump should stay in office.

In so deciding, Alexander prevented the possibility of a 51-49 majority in the US Senate calling for additional witnesses and testimony, which has been so in previous Presidential impeachment trials, as well as Federal Judiciary trials.

Alaska Senator Lisa Murkowski likely would have voted for such witnesses and testimony, had Alexander done so, but instead the vote was 51-49 against having such additional witnesses and testimony.

So Lamar Alexander’s obituary some day will make clear that he was NO Profile in Courage, putting party over principle, a big disappointment.

Alan Dershowitz Trashes Laurence Tribe, Fellow Harvard Law Professor, But Only Undermines His Own Credibility On Presidential Power

Retired Harvard Law Professor Alan Dershowitz went out of his way yesterday, in the first of two days of questioning of the prosecution and defense lawyers in the Donald Trump Impeachment Trial, to trash fellow Harvard Law Professor Laurence Tribe.

Dershowitz has come under fire for arguing that Trump has NOT committed an impeachable offense, and he went further yesterday to claim that anything a President does to help his political campaign, even using foreign nations’ assistance, is legal and not an abuse of power, a startling statement with zero merit!

Dershowitz has undermined his own credibility as an expert on the subject of impeachment, with his complete reversal from the time of the Bill Clinton impeachment trial, and with almost all law professors and historians taking the completely opposite view.

According to the view of Dershowitz, Presidential power is unlimited, and if that is the trend of the future, then the Constitution is in shreds, and the idea of a republic is destroyed!

To trash a respected professor such as Tribe is a terrible tactic, and shows the lack of ethics and common sense of Alan Dershowitz!

The Witness And Testimony Issue Can Be Resolved If The Republicans Wish It In The Donald Trump Impeachment Trial

John Bolton, the former National Security Adviser, and other witnesses, including Mick Mulvaney at the least, need to testify in the Donald Trump Impeachment Trial, and Chief Justice John Roberts needs to step in and rule on this matter, with the help of at least three Republican Senators.

It seems as if Mitt Romney, Susan Collins, and Lisa Murkowski are ready to vote for witnesses and testimony, and also, Lamar Alexander, Pat Toomey, Rob Portman and Jerry Moran seem leaning that way.

If all of these seven support each other, or at least four, then it will occur, but if not, Roberts needs to intervene if there is a 50-50 tie in the Senate.

It may not change the final vote on conviction, requiring two thirds to remove Donald Trump, but the trial, in order not to be a sham, MUST have witnesses and testimony, and Roberts has the responsibility to intervene if necessary!
